BOARD OF SUPERVISORS - Monday, November 15, 2010 at 7:00 p.m. - Town Hall 4528 STH 57

Call to Order:  Chairman Leo W. Zipperer called the meeting to order at 7:05 p.m.

Pledge of Allegiance:  The Chairman asked all to rise and join in the Pledge of Allegiance.

Roll Call/Quorum:  Present Chairman Zipperer, Supervisors Tice, Girman, Woelfel and Staveness.  Also in attendance:  Clerk/Treasurer Wait, Pat Miller, Laddie Chapman, Betty Kiehnau, Bob Stracka, Jerri Girman, Arlene Woelfel, Jim Hlavacek, Frank Keller, Tom Luebker, Jane Luebker, John Boston, Mary Boston, Nancy Schrank and Robert Schrank.

Meet ‘n Greet- Door County Sheriff’s Deputy Program:  None available.

Public Participation:  None.

Agenda/proper notice/adopt:  Motion by Tice and second by Girman to adopt the agenda, as posted.  Motion carried.

Approval of Minutes:  Motion by Staveness and second by Tice to accept the Board of Supervisors’ minutes of October 18, 2010.  Motion carried.

Financial Reports:  Motion by Girman and second by Staveness to accept the clerk/treasurer monthly reports on account balances reflecting unreserved and designated funds, the transaction list and the budget vs. actual for September 2010.  Motion carried.

Approval of Vouchers / Bills / Claims:  Motion by Tice and second by Girman to approve the payment of vouchers, bills and claims for the period October/November  2010.  Motion carried.

Oral Committee Reports & Committee Minutes:  The following minutes were accepted and placed on file:  Plan Commission of 9/82010 and Parks & Rec Board of 9/22/2010.

Pending Business/Status:

1)  Tourism Zone Commission.  Tice reported that the next DCTZC meeting is scheduled for December 16th at 9:00 a.m. at the Nasewaupee town hall.   September room rentals for the Town were $25,336 compared with $22,368 last year.  The Town’s 30% share of room tax collections for September were $7,841 and YTD total $55,728.  Tice reported that County tourism is up approximately 4.7% YTD and total rentals of $2,676,304, with Sevastopol collecting $185,598 which is a 9.2% increase over last year.  Girman asked if statistics on restaurants, golf courses, etc., were available and Tice indicated that the Door County Visitors Bureau will take a while to compile those numbers and make them meaningful.  Tice indicated that Door County Visitor Bureau traffic as of September 2010 was 53,000 visitors, compared with 38,000 the previous year, with less visits to websites.  The 3-year contract with the Sturgeon Bay Visitor Center gives Sevastopol businesses equal ground for our contributions to them.

2)  Road Work 2010 Progress Billing.  Zipperer reported that approximately $16,013.80 remains to be billed for shouldering and sweeping.  He will follow up on Nelson Lane to see if it can be swept again.

3)   Property Management Committee Draft Ordinances & Attorney Comments.  Tice has incorporated the suggestions by Town attorney Randy Nesbitt.  The matter will be addressed by the Property Management Committee and eventually set for a public hearing.  If you would like copies of the draft ordinances, please contact the clerk.

4)   Building Ordinance & Demolition provision status.  Zipperer will be contacting Independent Inspections President Tom DeLacy to schedule a date for a closed session to review the contract and demolition provisions.

5)   Door County Coastal Byway status.   Board members were provided with “What is the Door County Coastal Byway” synopsis.  The clerk reported that the DCCB is waiting fine-tuning of the intergovernmental agreement, with the Villages of Sister Bay and Egg Harbor and the Town of Sevastopol having yet to sign.  The official DCCB website will go live any day and an updated press release will go out to the media.  The 3-year timeframe on the interpretive plan and standardized kiosks were explained at the last meeting and the Council will be looking for commitments from each of the communities on their 20% share of the grant process.  DCCB is hoping to sponsor an informational meeting on grant opportunities and the application process, with a tentative date of December 8th at 7 pm in Baileys Harbor.  Tice indicated there will be start up costs for paperwork, legal advice, advertising and a physical location, similar to the tourism zone.  Girman would like to know the return on investment for Sevastopol business.

6)   Hwy 57 & Rock Ridge intersection lighting by WPS.  At the request of Rock Ridge Road residents, a contract has been entered into at a monthly cost of $19.72 for a lamp at this intersection, with no installation charges.

7)   Clark Lake at Town Line Boat Launch.  Woelfel reported that the ramp and pier were removed this past week and placed so as to deter use.  Signage has been posted to access the lake at the Town beach property which has been prepared for use with snow fence and chain link fence. 

8)   LNRP “We All Live on the Water” Signage.  After reviewing the LNRP website and taking into consideration the Parks and Rec Board’s recommendation, motion by Staveness and second by Girman that an investment in signage will not be made.  Motion carried, unanimously.

New Business – Discussion & Action:

1)   Robert & Nancy Schrank petition for a zoning amendment (map) for the west 660’ of Parcel No. 022-02-33282642 (Hwy 42-57 & Egg Harbor Road) from Countryside (CS) to Commercial Center (CC).  Staveness reported that the Plan Commission heard testimony from the Schranks on November 16th and it was their unanimous decision that a positive recommendation be forwarded to the Town Board.  In discussing the request, it appears to match the commercial designation in accordance with the Town’s smart growth plan.  Following discussion, motion by Staveness and second by Girman to recommend approval of Mr. and Mrs. Schrank’s petition for a zoning amendment from CS to CC.  Motion carried, unanimously.

2)  Town of Liberty Grove possible text amendment and overlay for Formula (chain) Restaurants and Lodging Establishments.  Staveness reported that the Plan Commission took no action since the issue has not been addressed in our Town to date and that no direction would be given at this time.

3)  Wisconsin Retirement System Inclusion/Exclusion.  The matter was addressed earlier in the special meeting and no action will be taken at this time.

4)  Indoor and Outdoor Tree Trimming.  Everyone is invited to join in the outdoor and indoor Christmas decorating on Saturday morning, November 27th.

5)  2011 Proposed Meeting Schedule.  Zipperer has prepared a draft meeting schedule for review by Board members.  Please advise if changes should be made.

Resolutions:

Resolution No. 05-2010 TB “Establish Tax Rate 2010” (to be paid in 2011).  A 2010 tax levy of $579,586 having been adopted at the Special Town meeting held earlier, motion by Woelfel and second by Girman that the tax (mill) rate in support of such levy and budget be established at $.80781711 for the year 2010 (to be paid in 2011).  Motion carried, unanimously.

Zipperer also provided a status report on the use of the City’s recycling/compost site by our residents.  A tentative agreement would allow drop off of brush and yard clippings for an annual fee of $25 per parcel, and also permit the purchase of mulch at $5 per yard.  He will plan to appear before the next meeting of the Community Protection & Services Committee and hopes to have it in place by January 3, 2011.
