BOARD MINUTES OF MAY 2010

Board of Supervisors - May 17, 2010

Call to Order.  Chairman Leo W. Zipperer called the meeting to order
at 7:00 p.m.

Pledge of Allegiance.  The Chairman asked all to rise and join in the
Pledge of Allegiance.

Roll Call/Quorum.  Present:  Chairman Leo W. Zipperer, Supervisors
John Staveness, Dan Woelfel, Tom Girman, Chuck Tice and
Clerk/Treasurer Linda Wait.

Meet ‘n Greet - Door County Sheriff’s Deputy Program.   None
available.

Public Participation.  The clerk thanked Betty Kiehnau for donating
the flower baskets at the front door and as that we remember Roger
Peterson, who recently passed away—Roger served as an election worker
for many years.  Zipperer also recognized Roger for his years of
service on the Door County Board of Adjustment and introduced  new
Advocate correspondent, Samantha Hernandez.

Agenda/proper notice/adopt.  Upon verification that the agenda has
been properly noticed, motion by Tice and second by Girman to adopt
the agenda.  Motion carried.

Approval of Minutes.  Motion by Staveness and second by Woelfel to
approve the Board minutes of April 19, 2010.  Motion carried.

Clerk/Treasurer Monthly Report –April 2010.  The account balances
reflecting unreserved and designated funds, the transaction list by
date and the budget vs. actual reports were accepted as submitted and
will be placed on file.

Approval of Vouchers, Bills and Claims.  Motion by Girman and second
by Tice to approve the payment of vouchers, bills and claims for the
period March-April 2010.  Motion carried, unanimously.

Oral Committee Reports.  Girman reported that Charter Communications
has reconstructed some of its cable channels and suggests that
customers use their auto channel update to reset their digital TVs.

Committee Minutes.  The following committee minutes were accepted and
placed on file:
Plan Commission - March 10, 2010 and April 8, 2010; and Dam, Park &
Rec Board  - March 9, 2010 and April 6, 2010.

Pending Business/Status:
Clark Lake Ramp and Dam:  Woelfel reported that the Town Line ramp
installation at Clark Lake is complete and that users appreciate the
recent repairs.  He also reported that the riprap project and fencing
at the dam are both finished.   Jim Hlavacek expressed his
appreciation for the work that was done at the launch.

School gravel road:  Woelfel reported that some of the bus traffic has
been moved to the north side of the School for better traffic flow and
that other options are being explored to address the speed and safety
concerns on the gravel road running along the park grounds.

American Transmission Company:  A recent email from Ben Hock,
representative for ATC, indicates that they will be relocating the
transmission pole to the north and outside of the right-of-way on Old
Highway Road.

DeGroot Grant of Variance:  Staveness reported that the Board of
Adjustment approved the DeGroot petition for grant of variance for an
addition to the second floor of their residence on West Shore.

Schultz and Peterson Zoning Amendments:   Staveness reported that the
County Board will consider the Schultz petition to change their zoning
classification at 4766 Hwy 57 from prime agricultural (PA) to
countryside (CS).  Also, a report from the Door County RPC recommends
approval of Jeff Peterson’s petition for a zoning amendment to allow
home business use by conditional use permit in PA and that the County
Board approved the text amendment on April 20, 2010 by ordinance. 

Door County Coastal Byway:  The DCCB was approved by the Wisconsin
Transportation Secretary Frank Busalacchi on April 6, 2010.  Wait
indicated the next step would be to develop an intergovernmental
agreement among the participating municipalities to establish a
constitution, by-laws and activities of the DCCB  Council.  A meeting
date has not yet been scheduled.

Sturgeon Bay Fire Department:  Girman will be contacting Fire Chief
Tim Herlache to discuss response times and sectors.

New Business – Discussion & Action:
Road Work 2010 – RFP (request for proposal):  Zipperer reported on the
May 15th road inspection tour and Board members identified the
following roads in need of repair:
•  Nelson Lane north of Clark Lake/WD, approx.   0.5 miles north
beyond Moeller Road -
wedge and sealcoat;
•  Nelson Lane south from Clark Lake/WD to Whitefish Bay – wedg and
sealcoat;
•  Bay Shore Heights Circle from Harder Hill to termini, wedge and
sealcoat;
•  West Whitefish Bay from HH to curve west of Harder Hill (review
prior survey) – wedge and
sealcoat;
•  Ripp from STH 57 to Mathey – wedge with overlay;
•  East Sylvan View Circle from West Shore to Dunes Court – overlay;
•  Rock Ridge from STH 57 to termini – wedge, chip and sealcoat.
The Door County Highway Department must meet prevailing wage
requirements and provided the estimated prices for 2010.  Following
discussion, motion by Girman and second by Woelfel to proceed with
Door County Highway Department for roadwork 2010.  Motion carried,
unanimously.
Zipperer will request quotes by June 21st with work to be
accomplished in July.  He also called attention to recent vandalism on
our stop signs and urged residents to report suspicious activity to
the Sheriff’s Department.  Also, signs will need to be reflectivity
and size appropriate over the next few years and should be addressed
at budget time.

Wis DOT Urban Program 2011-2014:  Only roads classified as “collector”
or higher are eligible for funding and can include projects such as
bicycle and pedestrian enhancements.  Sevastopol would be entitled to
funding of $15,787.88 for this year.  Although the deadline is June
14, 2010, entitlements can be accumulated to the year 2014. 

Zipperer indicates that he has contacted both Whitefish Dunes State
Park and County of Door personnel for possible financial assistance on
improvements to Schauer Road.

Burning Permit:  The permit booklet has been revised and forwarded for
printing.

Kafka Change of Use Ag to Single Family Residential (SFR):  Ann Kafka
explained her intent to occupy the existing lounge/tack area of the
stable as a SFR.  Zipperer explained that, although a zoning permit
has been issued by Door County Zoning Administrator Kay Miller, there
is also a process for building inspections and permits at the Town
level.  Zipperer suggested Ms. Kafka cooperate with Building Inspector
Brett Temme so that she can remain at the location and come into
compliance with all State and local building codes.

Resolutions.  Motion by Tice and second by Staveness to approve No. 04
– 2010 TB  “Affirming Commitment to Remain a Member of the Door County
Tourism Zone Commission after December 31, 2011” so that the DCTZC can
continue with the room tax collection.  Tice explained that Door
County has the only county-wide commission in Wisconsin, with all
municipalities participating, and that making a commitment now will
help budget for the coming years.  Motion carried, unanimously.

Ordinances.  No. 01 - 2010 “ Demolition of Structures.”  A draft was
presented for discussion purposes so that specifications and
regulations relating to the demolition and razing of buildings can be
formalized.  Zipperer indicated we will have legal counsel review and
bring back for future action.

Correspondence.  Although not enumerated during the course of the
meeting, the following items of correspondence will be placed on file:
April 2010 fire report • building and zoning permits April • Board of
Adjustment decision on Johnson • DNR aids in lieu of tax payments •
private drives snowplowing 2010 winter season • U.S. Coast Guard
communication tower and request for exemption • 2009 tax rate
summary.

Announcements:
•Open Book – Friday, June 4th 10 am to 12 noon
•Board of Review – Monday, June 21st 1 pm to 3 pm
•Board of Supervisors – Monday, June 21st – 7 pm
•Door County Unit WTA – Thursday, June 24th – 7 pm at Forestville Town
Hall (in Maplewood)
•Staveness urged residents to participate in the Open Book, as their
opportunity to speak directly with the assessor.

Adjourn: Motion by Tice and second by Girman to adjourn.  Motion
carried, adjourned at 8:07 p.m.
