Board of Review-2010

Call to Order:  Leo W. Zipperer, Town Board Chairman, called the
meeting to order at 1:04 p.m.

Establish Quorum/Roll Call:
In attendance were Supervisor Tom Girman, Supervisor Chuck Tice,
Supervisor John Staveness, Supervisor Dan Woelfel and Chairman
Zipperer.  Also in attendance were Attorney Randall J. Nesbitt,
Clerk/Treasurer Linda Wait and Wisconsin Certified Assessor Bryan
Andersen.

Selection of Chairperson:
Staveness nominated Girman for Chairperson of the 2010 Board of Review
and  Woelfel seconded the motion.  There were no other nominations. 
Motion carried, unanimously.

Approval of May 17, 2010 Initial Minutes:
Motion by Zipperer and second by Staveness to approve the minutes of
the initial Board 
of Review held on May 17, 2010.  Motion carried, unanimously.

Verification of Training:  The clerk affirmed that Tice had completed
training on February 20, 2010, as mandated by the Wisconsin Department
of Revenue and that an affidavit is on file.

Verification of Assessment Roll:  Ryan Andersen, Level 2 Wisconsin
certified assessor of Associated Appraisal Consultants, Inc.,
Appleton, Wisconsin, was duly sworn by the Clerk as the assessor for
the 2010 Board of Review.  Mr. Andersen verified the 2010 assessment
roll and the final report, signed and dated, with Open Book changes
flagged and incorporated therein.

2010 Board of Review Objections:

1)  JKGolf LLC
Vincent Statz, on behalf of JKGolf LLC, was duly sworn at 1:10 p.m.
and objected to the assessment on the golf course and improvements
located at 5905 Dunn Road, Sturgeon Bay, Wisconsin Parcel
Identification No. 022-02-20282614QQ. The Board reviewed the objection
form and accepted testimony from Mr. Statz and from Assessor Bryan
Andersen.  

Following discussion and deliberation and exercising its judgment and
discretion as to the evidence provided, motion by Woelfel and second
by Staveness that the assessment is reasonable, that no substantive
evidence was presented to alter the assessment and to affirm the
Assessor’s valuation as follows:

Motion carried, unanimously (5-aye).  Mr. Andersen provided Mr. Statz
with the “Notice of Board of Review Determination.”

2)  JKGolf LLC
Vincent Statz, on behalf of JKGolf LLC, having been previously duly
sworn, objected to the assessments for Cherry Hills Fairway Condo
Units 5-10, 15-34 (26 unimproved lots), located on West Madeline Lane,
Sturgeon Bay, Wisconsin.  The Board reviewed the objection forms and
accepted testimony from Mr. Statz and from Assessor Bryan Andersen.  
Following discussion and deliberation, and exercising its judgment and
discretion as to the evidence provided,  motion by Woelfel and second
by Zipperer that:  (i) as to Parcels/Units 5 through 10 and 15 through
26, the assessments are reasonable and no substantive evidence was
presented to alter the assessments and to affirm the Assessor’s
valuation at $4,000 each; and (ii) as to Parcels/Units 27 through 34
the assessments shall be modified and the new valuation set at $1,000
for each parcel, as follows:

Motion carried (4-aye, 1-nay).  Mr. Andersen provided Mr. Statz with
the “Notice of Board of Review Determination” for each of the 26
lots.
 

3)  Vincent E. Statz
Vincent Statz, having been previously duly sworn, objected to the
assessment of his condominium residence located at 4400 West Madeline
Lane, Cherry Hills Fairway Condo, Sturgeon Bay, Wisconsin.  The Board
reviewed the objection form and accepted testimony from Mr. Statz and
from Assessor Bryan Andersen.  
	Following discussion and deliberation, motion by Staveness and second
by Tice that the assessment is reasonable and no substantive evidence
was presented to alter the assessment and to affirm the Assessor’s
valuation as follows:

Motion carried (3-aye, 2-nay).  Mr. Andersen provided Mr. Statz with

There being no further objections presented, the Board of Review
recessed at 2:50 p.m.

Adjourn:
Motion by Zipperer and second by Staveness to adjourn.  Adjourned at
3:01 p.m.
