Board of Supervisors - Minutes of June 21, 2010

Call to Order.  Chairman Leo W. Zipperer called the meeting to order
at 7:00 p.m.

Pledge of Allegiance.  The Chairman asked all to rise and join in the
Pledge of Allegiance.

Roll Call/Quorum.  Present Chairman Zipperer, Supervisors John
Staveness, Dan Woelfel, Tom Girman and Chuck Tice, Clerk/Treasurer
Linda Wait.  Also in attendance:  Laddie Chapman, Mary Lou
Fitzsimmons, Bob Stracka, Mark Richard.

Meet ‘n Greet - Door County Sheriff’s Deputy Program - no one
present.

Public Participation:
	Mary Lou Fitzsimmons, President of Whitefish Bay Association,
expressed her concern about the property in the 4800 section of South
Cave Point Drive, believing it to be a fire hazard with a collapsed
barn and accumulated brush and debris.  Chairman Zipperer responded
that Fire Chief Tim Herlache did conduct an inspection and has been in
touch with the owner by letter.  Failure to comply with clean-up
requests may result in the issuance of a citation. 
	Mary Lou also mentioned the aggressive trimming as a result of the
last snowfall and Zipperer indicated that the Town has spent monies to
clean up fallen trees and branches along road and ditches in many
areas.
	Bob Stacka reported that the Clark Lake buoys are installed.

Agenda/proper notice/adopt.  Upon verification by the Clerk of proper
notice, motion by Tice and second by Girman to adopt the agenda. 
Motion carried.

Approval of Minutes.  Motion by Woelfel and second by Staveness to
approve the Road Inspection minutes of May 15, 2010.  Motion carried. 
Motion by Staveness and second by Tice to approve the Board minutes of
May 17, 2010.  Motion carried.

Clerk/Treasurer Monthly Report – May 2010.  Motion by Tice and second
by Girman to accept the account balances reflecting unreserved and
designated funds, the transaction list by date and the budget vs.
actual reports.  Motion carried and the reports will be placed on
file.

Approval of Vouchers / Bills / Claims.  Motion by Staveness and second
by Tice to approve the payment of vouchers, bills and claims for the
period May/June 2010.  Motion carried, unanimously.

Oral Committee Reports & Committee Minutes:
Tice reported that he has been in contact with the Door County Visitor
Bureau on the prospect of an informational kiosk at the Town Hall. 
The DCVB would pay for the computer equipment and installation of
electrical and phone lines and possibly help with signage.  The Town’s
responsibility would include a shelter and the monthly cost of
utilities (phone and electric).  There was some discussion on
location, possibility of Wi-Fi and security.  The kiosk would be
connected directly to DCVB and visitors could make and check on
reservations, vacancies and location of various services.  In the age
of cell phones, perhaps we could do without a phone line.  Tice will
get some photos of other kiosks and check on costs.  This may be an
item for future discussion among our businesses.

Woelfel reported that Kyle Volkmann was recently hired as the new
part-time Park employee, replacing Kit Schartner who left for full
time employment elsewhere.

Committee  Minutes.  The following Committee minutes were accepted and
placed on file:  Dam, Park & Rec Board of April 6, 2010 and May 11,
2010; and Plan Commission of April 8, 2010.

Pending Business/Status:
1)  The DeGroot petition for variance at 5308 West Shore was granted
by the Door County Board of Adjustment on May 11, 2010 to allow a
second-story addition on a nonconforming lot and located 72’ from the
ordinary high water mark.
2)  Schultz Petition for Zoning Amendment.  The Door County Board of
Supervisors amended the zoning district classification of the Randy
and Linda Schultz property at 4766 Hwy 57 from prime ag/wetland to
countryside/wetland.
3)  Tourism Zone Commission.  Tice reported that the following
officers were elected at the recent annual meeting of the Commission: 
Bob Kufrin as chair, Elizabeth LeClair as secretary, Bryan Nelson as
treasurer and Bill Weddig as vice chair.  It was decided that the
Commission will meet every other month, with the Executive Board
meeting monthly for payment of bills.  Sevastopol received $1,516.72
in March room tax collections.  Work is starting on the 2011 visitor
guides and we hope to have better identification for our Town.
4)   Road Work 2010.  Motion by Girman and second by Woelfel to accept
the estimates as provided by Door County Highway Commissioner John
Kolodziej and proceed with the following projects.  Motion carried,
unanimously and Zipperer will make the call to proceed.

Harder Hill.   A previous site plan indicates that the stone wall and
power pole fall within the road right-of-way.  However, if the curve
is widened, there is concern with increased speed.  Perhaps an overlay
would suffice for now. 
Schauer Road.  A search by Title Services of Door County indicates
that “the owners of the road would be the State of Wisconsin DNR and
Door County.”  Joe Schroedl/Peninsula Land Consultants submitted a
location survey showing the current blacktop, the proposed centerline
per legal description and the proposed right-of-way.   Zipperer has
discussed the matter with the Door County Airport & Park Committee for
their response and possible contribution; a previous conversation with
Dick Ostrowski of Whitefish Dunes State Park indicates he is in favor
of correcting the problem.   Door County Corp Counsel will be provided
with the information for his review and the matter will be brought
back next month.
5)  Kafka Change of Use at 4604 Bechtel Road.  Zipperer gave Building
Inspector Brett Temme an “atta boy” for doing an excellent job in
outlining items needed in order to come into compliance for a proposed
dwelling space within the Kafka agricultural building.  We will be
kept posted on the status. 
6)  Sturgeon Bay Fire Dept.  Girman prepared a report reflecting
emergency response times by sector within the Town, ranging from 7.5
minutes to the south and up to 16.7 minutes to the northwestern
boundary.  The matter will be held in abeyance and he will continue to
monitor.

New Business – Discussion & Action:
1)  Original & Renewal Applications for Alcohol Beverage License. 
Renewal applications were received from 14 establishments. Clerk
reported that all sums due have been paid, with one exception as to
McClellan Holdings for delinquent real estate taxes.  Following
discussion, motion by Tice and second by Girman to approve all
applications submitted to date, conditioned upon compliance with our
Ordinance No. 2007-01 by June 30, 2010.  Motion carried, unanimously. 
The Clerk reported that a temporary Class B license had been issued to
Door Devils Motorcycle Club for their summer event on July 16-18,
along with a burn permit subject to Fire Department approval.
2)   Town Subdivision/Conservation Ordinance.  Staveness reported that
the ordinance, when finalized, will be presented for Board approval. 
Tice expressed concern for potential transfer of common areas/green
space to tax-exempt status and Girman responded those efforts to sell
would be in violation of the ordinance.  Plan Commission member Pete
Hurth is staying in touch at the County level.
3)   Nuisance Control.  Tice submitted four draft ordinances for the
purpose of discussion:  Public Nuisance, Regulation of Outside
Storage, Unsightly Premises & Hazards, Keeping of Animals and Control
of Dogs.  There was discussion on enforcement, especially as to those
egregious sites that receive ongoing complaints.  Tice is working with
WTA, looking at various ordinances that cover the issues and have good
abatement/enforcement policies; however most owners do not have the
funds available to do repairs or demolish.  Girman suggested we have
the Fire Department inspect dilapidated buildings for fire hazards and
ask the County to enforce its ordinances.  Other nuisances mentioned
were ATVs, racing, abandoned wells, junk cars, agricultural equipment,
and the Muskat property.
	Animal control officer Mark Richard was present and reminded pet
owners to include phone numbers on collars for easy identification and
return.  He also recommended that ag animals be exempt from ordinance
controls.  Tice responded that the draft dog ordinance was written for
highly populated residential areas. 
	Girman felt the ordinance on regulation of outside storage was
concise and to the point and suggested adopting with appropriate
abatement and enforcement policies
	Motion by Staveness and second by Girman to table the matter and the
four ordinances will be placed on the agenda for next month.   Motion
carried, unanimously.
4)   Door County Coastal Byway Council appointment.  After reviewing
minutes, mile-by-mile assessments and comments, the proposed
intergovernmental agreement, constitution and bylaws, Zipperer asked
that Tice attend future meetings to become familiar with the status of
the project and costs involved.  Tice expressed his concern about the
agreement.  Zipperer invited all Board members to attend the next
meeting of DCCB to be held on July 14th at 8:30 am, Sevastopol town
hall.  Tice will appear as our official appointment for now.
5)   Siting of Wind Energy Systems.   The Public Service Commission of
Wisconsin (PSC) will be holding public hearings on siting of wind
energy systems, developers, owners or operators, and its effect on
small business entities.  For more information or to submit comments,

Ordinances.	Attorney Randy Nesbitt will be reviewing our current
Building Ordinance and the proposed demolition provisions.  Zipperer
will make contact with previous board members as to why demolition was
omitted.

on file:
