BOARD OF SUPERVISORS

Call to Order: Chairman Leo W. Zipperer called the meeting to order
at 7:00 p.m.
Pledge of Allegiance: The Chairman asked all to rise and join in the
Pledge of Allegiance.
Roll Call/Quorum: Roll call was taken, with the Chairman and
Supervisors Chuck Tice, Tom Girman, Dan Woelfel and John Staveness,
along with Clerk/Treasurer Linda Wait, in attendance.
Meet the Deputy Program – Door County Sheriff’s Department: No
attendee.
Citizen Concerns:
• Pat Miller asked about use of room tax dollars and the Chairman
responded that by resolution those funds are designated toward the
building fund and will be discussed under New Business.
Agenda/proper notice/adopt: Following verification by the Clerk that
the agenda had been properly noticed, motion by Tice and second by
Girman to adopt the agenda, as posted. Motion carried, unanimously.
Approval of Minutes: Motion by Woelfel and second by Staveness to
approve the Board of Supervisors’ meeting minutes of December 21,
2009. Motion carried, unanimously.
Financial Reports December 2009: The treasurer’s report with account
balances, budget vs. actual and transactions list for the period
ending December 31, 2009 were accepted and placed on file. The Clerk
also received information that Margaret Evenson should be added to the
list of Republican election officials; motion by Staveness and second
by Tice to approve such addition. Motion carried, unanimously.
Approval of Vouchers / Bills / Claims: Motion by Tice and second by
Girman to approve the payment of vouchers, bills and claims for the
period December 2009-January 2010. Motion carried, unanimously.
Oral Committee Reports & Committee Minutes:
PEG Cable. Girman reported that the new server has been received
which will allow a larger number of files to be loaded for broadcast.
Laddie will be doing the official installation on Friday. Girman also
mentioned that tonight’s meeting is being broadcast live on our PEG
channel.
Pending Business/Status:
Tourism Zone Commission. Tice reported that the new Door County
Official Visitor Guide is on the market and can be picked up at
various locations. Total room revenues for November in Sevastopol
were $118,444, with the Town’s share, including late pays, amounting
to $2,539.30. The Wis Department of Revenue advises that a
municipality cannot add delinquent/unpaid room taxes to the owner’s
property tax bill as a special charge; however, the tax
intercept/refund setoff program could be an avenue for collection.
Clark Lake Dam – Zipperer reported that the Town of Jacksonport did
approve the letter of understanding as to cost share on maintenance
and repair of the dam and we can expect a payment of $6,565.15, plus
$389.53 for ramp installation and removal, based on prorated equalized
valuations. Girman suggested we consider and petition the DNR to make
the dam a permanent structure. Zipperer will place the call and
agenda the item for the next meeting.
Sevastopol School – Contribution for demolition / tax apportionment
per district. Zipperer has been in contact with Superintendent
Cromell in hopes to resolve the matter by allowing the School use of
our Town Hall facility in lieu of any monetary contribution. Dick
Weidman, who initially brought the request forward as chairman of the
School’s Building & Grounds Committee and with the School Board’s
knowledge, requested a monetary payment in that the actual cost for
demolition and remediation of the site amounted to $15,000. Woelfel
and Girman felt the verbal rental agreement included our use of the
modular building in exchange for use of our ball fields; we were given
a 3-year notice to find a new location and complied; and any monetary
contribution would need to come back at budget time. Motion by Tice
and second by Staveness to deny the request of the Sevastopol School
Building & Grounds Committee any financial assistance for demolition
costs. Motion carried, unanimously.
Wis Department of Revenue County Assessment Proposal – Status report.
Zipperer reported on the Department of Revenue’s proposal to move
property tax valuation and administration to the county level. The
draft bill that would have the county take over the entire assessment
of towns and villages is now available. The WTA monthly report has an
informative article and a draft resolution in opposition to this
proposal. The matter will be brought back by resolution next month.
2009 Meeting Schedule- FYI. The budget hearing, special town meeting
and regular board meeting will be held the evening of November 15th.
Open Book is scheduled for Friday, June 4th. The Board of Review was
proposed for June 25th, but due to conflict, will be rescheduled to
possibly June 21st and confirmed at next month’s meeting.
New Business:
Friends of Whitefish Dunes – request for room tax dollars to maintain
trails. Dick Weidman requests funds to support grooming of trails in
Whitefish Dunes State Park. Zipperer stated that pursuant to Town
Board Resolution 15-2007, overnight lodging tax collections are
designated for the building fund account. Tice said that although the
Town does not have its own tourism promotion organization, the
Community Marketing Fund (CMF) through the Sturgeon Bay Visitors
Bureau does promote our businesses to our benefit. Tice explained
that 70% of all room tax collected goes to the Door County Tourism
Zone Commission, who passes it on to the Door County Visitors Bureau;
the 30% comes back to the municipality and can be allocated in any
manner. In our case, it was used to purchase the property and pay the
mortgage for the Town Hall. Tice would be leery to support non-profit
organizations with tax dollars. Zipperer suggested that once the
3-year CMF agreement has lapsed, perhaps we can re-look at the
request.
Animal Control Agreement 2010. Mark Richard, as animal control
officer for the Town, was present to answer any questions or respond
to concerns. The agreement provides for pickup services on stray
domestic cats and dogs with a salary of $100 per month, plus per call
allowance, room and board, mileage and general liability insurance
coverage through the Town. Motion by Staveness and second by Tice to
extend the agreement with Mark Richard, as animal control officer, for
the period ending December 31, 2010. Motion carried, unanimously.
Appointed Clerk/Treasurer conditions of employment. Zipperer
reflected on Town Board Resolution 09-2009 TB passed on December 21,
2009 which established the clerk/treasurer position as full-time and
the appointment of Linda Wait for a 3-year period ending December 31,
2012. Girman summarized the memo of understanding and the attachment,
which spells out employment hours, paid time off, compensation,
duties/assignments and office hours. Motion by Woelfel and second by
Staveness to approve the memo of understanding and its conditions.
Motion carried, unanimously.
Open Book and Board of Review 2010 sessions. Open Book currently
scheduled for the morning of Friday, June 4th, and Board of Review
tentatively scheduled for the afternoon of June 21st.
Board of Review training compliance. Wisconsin Statutes requires that
at least one member of each town board of review must have attended
training within the past two years. The WTA district meetings
scheduled February thru March and WisLine Teleconference series both
offer training for Board of Review certification.
Building Permits and Inspections – Change of Primary Inspector.
Correspondence from Independent Inspections, Ltd. advises that Brett
Guilette is no longer with the company and they are proposing Brett
Temme as our new primary inspector.
Application for conditional use permit. Jackie Meister at 4188 Bay
Shore Drive, has made application for a conditional use permit to add
a sunroom to existing manufactured home (which is a nonconforming
use). Staveness indicated that the Plan Commission recommends
approval. Motion by Staveness and second by Girman to recommend
approval of the conditional use permit. Motion carried, unanimously.
The Clerk will notify the Door County Planning Department.
First Responders 2009 Recap. Justin MacDonald, Crew Chief for
Sevastopol First Responders, submitted a recap of calls and events for
2009. Staveness congratulated the Responders on their wonderful job.
Zipperer also complimented them on their help with the Century Bike
and other events at school. The responders displayed new dress shirts
for our Sesquicentennial celebration last year.
Intergovernmental Agreement and Tasks Check [Repair of Highways]. The
Door County Highway Department requests renewal of the
intergovernmental agreement for maintenance of roads, along with
regular tasks performed by their department such as sign maintenance,
removal of fallen trees on roadways, paint striping and snowplowing.
Motion by Girman and second by Woelfel to accept the intergovernmental
agreement as proposed. Motion carried, unanimously.

Announcements:
• Board of Supervisors – Monday, February 15th - 7 pm.
• Zipperer recognized Charlie Jarman for his devotion to School,
Church, County and Town. Laddie prepared a memorial video and it was
viewed following the meeting.
• Zipperer participated in the video created by the Door County
Complete Count Committee and League of Women Voters to promote
awareness of the 2010 U.S. Census—also available for viewing tonight.
• Pat Miller invited everyone to the City of Sturgeon Bay Mayoral
Candidate Forum on to be held on Monday, January 25th at 7 pm in City
Council chambers.
