BOARD OF SUPERVISORS' MEETING MINUTES

August 16, 2010 - 7:00 p.m. 

Call to Order:  Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m.

 Pledge of Allegiance:  The Chairman asked all to rise and join in the Pledge of Allegiance.

 Roll Call/Quorum:  Present Chairman Zipperer, Supervisors John Staveness, Dan Woelfel and Chuck Tice, with Supervisor Tom Girman excused.  Also in attendance:  Clerk/Treasurer Linda Wait, Laddie Chapman, Carl Scholz, Bob Stracka, Wayne Eastman, Joan Baudhuin, Dick Baudhuin, Mickey Fellows and Boyd Fellows.

 Meet ‘n Greet- Door County Sheriff’s Deputy Program:  no one present.

 Public Participation

• Carl Scholz displayed the article written by Leon Long on “Early School Busses at the Sevastopol Consolidated School.”   This was the first public school transportation offered in Wisconsin and an old school bus body has been donated to the NEWAPA and will be on display at the Thresheree. 

• Carl expressed his concern for lack of visibility at the intersection of East Ripp and Mathey and a sink hole on Brauer.  Zipperer indicated that these matters will be looked into.

• Dick Baudhuin requested to comment later on the draft dog control ordinance.

 Agenda/proper notice/adopt:  Upon verification by the clerk, motion by Tice and second by Woelfel to adopt the agenda, as noticed.  Motion carried.

 Approval of Minutes:  Motion by Staveness and second by Tice to approve the Board of Supervisors’ minutes of July 19, 2010.  Motion carried.

 Clerk/Treasurer Monthly Report:  Motion by Tice and second by Staveness to accept the account balances reflecting undesignated and designated funds, the transaction list and the budget vs. actual reports for July 2010.  Motion carried.

 Approval of Vouchers / Bills / Claims:  Motion by Woelfel and second by Staveness to approve the payment of vouchers, bills and claims for the period July/August 2010.  Motion carried.

• The following temporary Class B alcohol beverage licenses were issued:  NEWAPA/Thresheree event on August 20-22, 2010; and Sevastopol Alumni Benefit/Labor Day tournaments on September 3-5, 2010.

 Oral Committee Reports & Committee Minutes:  The following minutes were accepted and will be placed on file:   Parks & Recreation Board – June 17, 2010 and Cable Advisory Committee – October 7, 2009.

Pending Business/Status:

1) Tourism Zone Commission.  Tice reported that the next meeting of the DCTZC will be held on August 19th at 9 am at the Sturgeon Bay City Hall.  Total room collections for the month of June were $358,862, with $736,044 collected year to date, a 5.4% increase over the previous year.  Sevastopol collected $26,360 for a 46.99% capacity rate and room tax collections of $7,908.  Sevastopol is doing well as far as lodging, with an increase of 30% for the previous year to date.

2) Road Work 2010.  Zipperer reported that most wedging has been completed and those projects will be seal coated on August 30th.  Sink holes and potholes on Brauer, Moore, Whitefish Bay and South Lake have been repaired and will be checked periodically.  The dip on East Dunn will be repaired.  Additional mowing of ditches is on hold until fall.

3) Schauer Road.  Zipperer reported he had met with Wis DNR Secretary Matt Frank and Whitefish Dunes Natural Resource Educator Carolyn Rock to discuss ownership of the road which runs through the State park and Door County Cave Point Park.   The DNR will be in touch with Door County Corp Counsel Grant Thomas to help research and identify ownership.  The matter will be brought back once we have more information. 

            Zipperer also met with Governor Doyle while he was touring Door County on August 2nd.  Door County Soil & Water Conservation Department hopes to receive a $250,000 grant to continue its beach quality project. 

4) Draft Ordinances/Discussion.  Tice indicated that the Property Management Committee is expected to meet on Wednesday, August 25th, to review the following draft ordinances:

                        No. 02-2010 Public Nuisance

                        No. 03-2010 Regulation of Outside Storage, Unsightly Premises & Hazards

                        No. 04-2010 Keeping of Animals

                        No. 05-2010 Control of Dogs

Sheriff Vogel has been invited to attend and explain the Door County Sheriff’s Department position and how they would assist with enforcement.  Those who expressed an interest will be notified of the meeting date and time, which will be open to the public.  Dick Baudhuin said he was looking forward to a discussion with the committee.  Carl Scholz felt that engine braking should be addressed.  Wayne Eastman complimented the committee on dealing with these issues and urged that “we get the word out” on what’s happening.

5) Door County Coastal Byway.   Tice reported that interim officers were recently elected at the August 11th meeting for terms to 6/1/2011 coinciding with the election of municipal representatives.  The intergovernmental agreement is being fine tuned and hopes to be signed soon.  A letter will be sent to the eight municipalities requesting a $100 donation to defray costs until grant monies become available.  A logo was approved and made available for viewing.  The next meeting will be September 8th at 8:30 am at the Town of Gibraltar.

6) Building Ordinance and Demolition clause.  Zipperer will invite Tom Delacy of Independent Inspections, Ltd. to attend a meeting or gathering to see what is needed.  The purpose of a demolition clause is to protect the public and environment from improper disposal of debris.

7) Animal Waste Issues.  Zipperer recapped Town Attorney Randy Nesbitt’s concerns regarding action on weight and load restrictions and animal waste spreading plans.  Nesbitt said this is an area highly regulated by the Wisconsin DNR, the Door County Soil & Water Dept and Chapter 92 of the Wisconsin Statutes.  No action will be taken unless specifically requested to do so.

New Business – Discussion & Action:

1) County Addressing Program.  Zipperer indicated that due to a retirement, the County Board made a shuffling of personnel and assigned the county addressing program to Audrey Forslund in the Planning Department, with the task of actual installation of signs delegated to the Sanitarian Department.  Proper process should be followed and complaints will be taken up at the County Board level.  No problems are expected in the transition.

2) NIMS (National Incident Management System).  Staveness indicated that all First Responders must be compliant and current with training requirements.  It is recommended that certain elected and appointed officials also complete basic compliance courses.

3) Additional Street Light Request Rock Ridge/STH 57.  After checking with WPS, the clerk reported an estimated monthly cost of $17-18.  The clerk will follow up with WPS on using an existing pole and approximate installation timeframe.

4) Outdoor Sign Use/Policy.   Zipperer said the use of the electronic sign came to a head at a recent meeting of the Cable Advisory Committee with a motion recommending that the Board write a policy for guidelines to benefit the public interests of the Town.  The clerk provided a recap of past events that have been promoted, which include Town, Town Park, Sevastopol School, charitable & nonprofit events, good neighbor, safety & caution, holidays and honorable mention announcements.  There have been questions on how much information is enough, speed and suitable use, with Board members making decisions on appropriateness of requests.  The sign does identify the cable channel and with Laddie’s craw line on the station and the program schedule available on the website, information is readily accessible.

            Woelfel felt the current guidelines and common sense basically cover what the use should be and that we continue in that same vein.  He said the sign should not be used as a personal or advertising tool nor “TV guide” in light of limited viewership.  Staveness thought it ran a little too fast and that the tree made it difficult to see, but agrees to keep it as is.  Tice agreed that it should not be used for personal, business or political gain and to definitely continue working with the School to promote their activities.  He thought there should be a written policy.

            Boyd Fellows commented that he has studied the sign and has some recommendations on techniques to make it more effective.  He offered to make a presentation to the Board and will notify Zipperer of availability.  Mickey Fellows commented on safety concerns so near a school.

            Laddie Chapman thinks our sign is an opportunity to promote what our Town has and the other town do not—a cable channel.  He felt that most of his previous requests have been denied.  Chapman said if we promote our station, we could increase income from franchise fees.  Zipperer responded that we serve the entire town.
