Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m.
Establish Quorum/Roll Call:
Roll call was taken, with Chairman and Supervisors John Staveness,
Chuck Tice, Dan Woelfel and Tom Girman, along with Clerk/Treasurer
Linda Wait, in attendance.
Also in Attendance:
Laddie Chapman, Pat Miller, Bob Stracka, Betty Kiehnau, Jim Hlavacek,
Lawrie Kull, Mary Kirkpatrick, Mary Kull, Fred Kirch and Darlene
Kirch.
Meet ‘n Greet – Door County Sheriff’s Deputy Program: See New
Business, Speed Limit on HH/Cherry Road, below, for comments from
Patrol Deputy Bob Lauder.
Public Participation:
• Pat Miller indicated that “Strahan” road sign was not up and that
its correct name should also be reflected on maps.
Agenda/Proper Notice/Adopt:
Clerk stated that the agenda has been properly noticed. Motion by
Tice and second by Girman to adopt the agenda, as posted. Motion
carried, unanimously.
Minutes:
• Motion by Staveness and second by Woelfel to approve the Board of
Supervisors’ meeting minutes of August 17, 2009. Motion carried,
unanimously.
• Motion by Staveness and second by Tice to approve the Board of
Review minutes of August 21, 2009, with corrections as to action taken
on Richardson review. Motion carried, unanimously.
Clerk/Treasurer Monthly Report:
The treasurer’s report with account balances, budget vs. actual and
transactions list for period ending August 31, 2009, was accepted and
shall be placed on file. The clerk also reported receipt of franchise
fees in the amount of $5,223.43 for second quarter 2009 and $13,976
room tax revenue for July 2009.
Vouchers/Bills/Claims:
The vouchers, bills and claims for the period August-September 2009
were presented for review and payment, with motion by Tice and second
by Girman to approve. Motion carried, unanimously.
Oral Committee Reports & Committee Minutes: The following were
accepted and placed on file:
• Dam, Park & Rec minutes of July 15, 2009
• Plan Commission minutes of July 16, 2009.
Pending Business/Status:
Road Work 2009. Majority of road work has been completed, with recent
billings received for construction work done on 14th Avenue, Old
Highway, Town Line and Mathey; Apple Road has received double
chip/seal. There appears to be a sinking pothole problem on East Dunn
that needs another layer. Due to visual obstruction and safety
concerns, several trees at the entrance to the Town Hall were removed
from the STH 57 right-of-way, with approval and cost to be covered by
the Wisconsin DOT.
South Cave Point Drive Paving. The Clerk spoke with Mr. Thornton, who
promised payment by October 1st for paving of the roadway per
agreement with Town Chairman.
Bluff Estates at Little Harbor. The recorded quit claim deeds for the
dedication of Bluff Court Trail/Lane/Terrace have been received and
placed on file. Matter is now complete.
Speed Reduction in Institute. Request for speed
study has been forwarded to Rod Hamilton, Traffic Engineer at the
Wisconsin DOT; this would be the area from County P south to Ripp
Road. It was suggested that the entire zone be established at no more
than 35 mph. In addition, information was requested relative to
seasonally adjust the speed limit to 30 mph, such as other Door County
communities.
Door County Tourism Zone Commission. Tice indicated that the
“Permitted Properties and Removed Properties” listing as provided by
the DCTZC appears to be in order. Room tax collections were $8,087
for June and $13,976 for July. Tice also said our Town fared better
than some of the other Door County municipalities and that Wisconsin
as a whole did well with room reservations compared to other states.
PEG Cable Advisory Committee. Girman indicated that the Independent
Contractor agreement with program director Laddie Chapman was nearly
complete and expects it will be finalized prior to the next Board
meeting. The target date is November 1st for move of the cable
station to the Town hall and expected downtime not more than two days,
with cable customers to receive advance notice.
New Business:
Clark Lake Dam Inspection Report & Repairs. Zipperer said that
information received from the Door County Corporation Counsel
indicated the Town is the owner of the dam, with easement owned by the
County. Dam construction began in 1937 and copies of the data,
including revisions and remodels, have been requested from the DNR.
The dam inspection report identifies the required work: tree removal
complete by November 1, 2009 and concrete spillway repairs complete by
July 1, 2010. We are looking for estimated engineering and repair
costs at this time.
Clark Lake Assessor’s Plat. No action will be taken at this time.
Petition for Grant of Variance. Fred and Darlene Kirch petition for a
grant of variance as to minimum lot width (at least 50 feet) in that a
recent survey indicates shore frontage of 48.29 feet. An accepted
offer to purchase the property is conditioned upon it being a
buildable lot. Mr. and Mrs. Kirch were present along with some of
their neighbors; letters of support were also accepted from other
neighboring property owners. Motion by Girman and second by Staveness
to recommend approval of the Kirch petition. Motion carried,
unanimously, with the Clerk to notify the Board of Adjustment.
Sevastopol School – Contribution toward demolition costs. Dick
Weidman was present on behalf of the Sevastopol School District Board
and submitted costs incurred and expected to be incurred in the
demolition of the modular building (a portion of which was utilized
for Town meeting and office area). The School is requesting a $5,000
contribution by the Town. There was discussion on funds contributed
and expended by both the Town and the School toward the modular
building and improvements made to the ballfields at the Town park.
Motion by Tice and second by Woelfel to table the matter to next
month, with the understanding to gather additional information and
further negotiation by Chairman. Motion carried, unanimously.
Speed Limit on HH/Cherry Road. Zipperer reported that the Door County
Highway Committee had received a request and petition to reduce the
speed limit (55 mph) on HH/Cherry Road from BB/Gordon Road north. In
order to deliberate this request, they asked for Town Board comments.
Tice did not support a reduction in speed and would like more
information on speeding citations, number of accidents and how many
persons had signed the petition. Deputy Lauder said that the area is
patrolled and offered to add more coverage. He also suggested that we
request a speed study from the Sheriff’s Department. Motion by Tice
and second by Woelfel to request a copy of the petition, information
as to the number of speeding tickets and accidents, and any recent
speed study completed or, in the alternative, that such a study be
completed prior to speed reduction consideration. Motion carried,
unanimously. A letter request shall be forwarded to Highway
Commissioner John Kolodziej.
LRIP(Local Road Improvement Program).
Commissioner Kolodziej notified municipalities that the DOT has
revised program guidelines and initiated changes in the LRIP and
recommends that projects be selected and applications prepared for
expedited submission. He also indicates that as soon as documentation
is provided by the DOT, the guidelines will be forwarded to each
municipality.
Ordinances:
The Clerk requested that any potential revisions to Ordinance No.
2007-01 regulating alcohol beverages and licensing be held in abeyance
at this time, pending further research. The matter will be brought
back at a future meeting.

Resolutions:
Resolution No. 05-2009 TB “Approval and Recommendation for Adoption of
Door County Comprehensive Plan 2030.” Motion by Staveness and second
by Girman to approve Resolution No. 05-2009 TB, with “supporting
documents” which outlines that certain actions taken by the County
must be consistent with that local governmental unit’s comprehensive
plan. Motion carried, unanimously.
Resolution No. 06-2009 TB “Resolution in Support of Complete Count
Committee.” Motion by Staveness and second by Woelfel to approve
Resolution No. 06-2009 TB to recognize the importance of the 2010 U.S.
Census. Motion carried, unanimously.

18) Door County Zoning Ordinance – updates
Zipperer also reported on the recent truck traffic along Bay Shore
Drive which is bringing stone from southern Door County to the
property just south of Olde Stone Quarry Park, then loaded on barges
headed to Egg Harbor for their marina project. The Bay Shore Property
Owners and other residents were concerned with this operation being
conducted in a residential neighborhood. Contact has been made with
the Door County Planning Department and the DNR for compliance.
