BOARD OF SUPERVISORS

Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m.
Pledge of Allegiance: The Chairman asked all to rise and join in
reciting the Pledge of Allegiance.
Establish Quorum/Roll Call:
Roll call was taken, with Chairman and Supervisors John Staveness,
Chuck Tice, Dan Woelfel and Tom Girman, along with Clerk/Treasurer
Linda Wait, in attendance.
Also in Attendance:
Laddie Chapman, Pat Miller, Bob Stracka, John Croissant, Renee Gomila
and John H. Paul.
Meet ‘n Greet – Door County Sheriff’s Deputy Program: None
available.
Public Participation:
• Pat Miller mentioned that the League of Women Voters is sponsoring
a healthcare reform session at the Bertschinger Center in Egg Harbor
on Saturday, October 24th, beginning at 9:30 a.m.
• Linda Wait reminded everyone about the “Turkey Trot/Run/Walk” at
our Institute Town Park on Saturday, November 7th – single registrants
and relay teams can sign up, plus bottomless bowls of chili to be
judged by our local celebrity, Tony Haen.
Agenda/Proper Notice/Adopt:
Clerk stated that the agenda has been properly noticed. Motion by
Tice and second by Girman to adopt the agenda, as posted. Motion
carried, unanimously.
Minutes:
• Motion by Staveness and second by Woelfel to approve the Board of
Supervisors’ meeting minutes of September 21, 2009. Motion carried,
unanimously.
Clerk/Treasurer Monthly Report:
The treasurer’s report with account balances, budget vs. actual and
transactions list for period ending September 30, 2009, was accepted
and shall be placed on file. The clerk also reported receipt of final
installment of General Transportation Aids for 2009 - $42,848.99
Vouchers/Bills/Claims:
The vouchers, bills and claims for the period September/October 2009
were presented for review and payment, with motion by Girman and
second by Tice to approve. Motion carried, unanimously.
Oral Committee Reports & Committee Minutes: The following minutes
were accepted and placed on file:
• Dam, Park & Rec Board minutes of September 16, 2009; and
• Plan Commission minutes of June 11 and July 16, 2009.
Pending Business/Status:
South Cave Point Drive Paving. Despite several telephone messages
and the promise of payment by October 1st, we have not received any
response from Mr. Thornton. The small claims paperwork is ready to go
with an anticipated return date of mid-November and process server
lined up in Chandler, Arizona. Tice suggested the simplest resolution
might be to place the $1,875 on the tax roll for this coming year.
The Clerk will review this with the Tax Listing office, although
Woelfel recommended we proceed with legal action.
Speed Reduction in Institute. Zipperer spoke with Rod Hamilton,
Traffic Engineer at the Wisconsin DOT, who is assembling the
information and will provide his comments in a few weeks.
Door County Tourism Zone Commission. Tice invited everyone to the
DCTZC annual meeting on October 21st, beginning at 6 pm at the
Horseshoe Bay Clubhouse, $25 includes dinner; you may RSVP to Phil at
dctourismzonecommission@gmail.com. Earlier this month, we also
received some free publicity on the NBC Today travel segment. The
Door County Visitors Guide is in full production mode, with a new
promotion of “Holly Days and Holly Nights”along with a brand new
season logo.
Tice also reported that State tourism was down by an average of
14.2%; however, Door County overall was down by only 2.6%.
Sevastopol’s receipts for August were $14,513 with 7,205 rooms
available, 67.5% occupied and an average room rate of $184.
Clark Lake Dam Inspection Report & Repairs. Zipperer met with Richard
Nebel of Nebel Engineers Constructors Inc. and tendered a letter of
instruction and agreement for an evaluation of the dam and what
activities needed to be accomplished per the DNR. A report is
expected within the next two weeks.
Speed Limit on HH/Cherry Road. On September 28, 2009, Tice forwarded
a letter to Highway Commissioner Kolodziej requesting additional
information regarding the request for reduction in speed limit. The
draft Highway Safety Commission minutes of October 1st contain a
recommendation to the Highway Committee to reduce the speed limit from
55 to 45 mph. Although other action by the Commission indicates that
the procedure is normally to seek input from the municipality as a
first step, this matter was not brought to the Town Board for prior
discussion and action.
Door County Comprehensive Plan 2030. Zipperer reported that the Plan
is up for review and will be voted upon by the County Board of
Supervisors on October 27th.
Sevastopol School – Contribution toward demolition costs. Zipperer
has met with Dick Weidman for an exchange of information. The matter
will be brought back next month.
New Business:
Petition for Grant of Variance. John Croissant and Renee Gomila
petition for a grant of variance as to minimum setback from the road
to reconstruct an existing sunroom and add a garage. The applicants
were present and provided information on the proposed reconstruction
of an existing sunroom and addition of a garage. The Board expressed
their support of the request, in that the porch would not encroach any
further into the zoning setback than the existing structure and
believed the improvements would enhance the appearance and value of
the premises. Motion by Girman and second by Tice to forward a letter
recommending approval of the petition for grant of variance to the
Door County Board of Adjustment. Motion carried, unanimously.
Application for Combination Class B Alcohol Beverage License – Eric
Johnson Family S Corporation at 4680 Bay Shore Drive (formerly
Schartner’s). The clerk reported that a provisional liquor license
was issued on October 2, 2009 to the Eric Johnson Family S
Corporation. Eric and Marea Johnson were present. The application,
auxiliary questionnaire and appointment of agent were complete, fees
paid and all requirements were met, along with publication and
completion of the mandatory responsible beverage server training. The
provisional license expires 60 days from issuance, allowing time to
obtain the required Wisconsin seller’s permit. Motion by Staveness
and second by Tice to approve the issuance of a combination (beer and
liquor) Class B license, with fees to be pro-rated to June 30, 2010.
Motion carried, unanimously.
PEG Channel Operation. Girman reported that the Cable Advisory
Committee did approve the station move from Sturgeon Bay to the Town
Hall, the allocation of $6,000 for equipment expenditures and the
hiring of Laddie Chapman as program director, and these matter are now
before the Board for approval. A copy of the executed Independent
Contractor Agreement between the Town and Laddie was provided to Board
members, which encompasses compensation, services to be performed,
programming, equipment use, term and termination. Motion by Girman
and second by Staveness to approve the cable/PEG station move to the
Town Hall, to incur the $6,000 relocation expense and to appoint
Laddie Chapman as Independent Contractor to operate the PEG channel
per the agreement. Motion carried, unanimously. Once the station is
up and running, the possibility of advertising can be addressed.

Harbor Road and requested abatement by October 29, 2009.

5300 West Shore Drive (minimum lot width)

available
