BOARD OF SUPERVISORS’ MEETING MINUTES
Monday, May 18, 2009 – 7:00 p.m.
Location: Town Hall Community/Meeting Room

Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m.
Establish Quorum/Roll Call:
Roll call was taken, with Chairman and Supervisors John Staveness,
Chuck Tice, Dan Woelfel and Tom Girman, along with Clerk/Treasurer
Linda Wait in attendance.
Also In Attendance: Laddie Chapman, Mickey Fellows, Boyd Fellows, Bob
Stracka, Jon Hollingshead, Greg Meissner, Mike Grimm, Darrell von
Berg, Tad Harvey, Donna Harvey, Tom Jorns, Sandra Jorns, Bill Thornton
and Pat Miller.

New Business:
1) Trillium Lane Name Change. This matter appears on the agenda in
response to correspondence dated March 5, 2009 from Ken Pollock, Door
County Addressing Specialist, to eliminate addressing problems with
duplicate road names and request that the Town consider changing its
“Trillium Lane” road name (with 10 active addresses) due to potential
for confusion and the larger number of incorporated property owners
that would be affected if the Village of Sister Bay were to change its
“Trillium Lane” road name (with 14 addresses). That correspondence
and a cover letter from the Town clerk were forwarded to the Trillium
Lane property owners inviting their thoughts and ideas. Jon
Hollingshead, Tad Harvey, Donna Harvey and Sandra Jorns expressed
their opposition, in written form and verbally, for several reasons:
(i) Sevastopol had chosen the name first in approximately 1978, with
Sister Bay choosing the duplicate name nine years later; (ii) the
expense involved for seven home-based businesses to change their
stationery, business cards, websites and notify clients; and (iii)
Sevastopol has more year-round residents on its Trillium Lane. The
residents urged the Board members to support their requests and “go to
bat” for them at the County Board level, if necessary. Tad also
indicated that the Village of Sister Bay was not part of the Door
County Uniform Addressing system and that it administers and enforces
its own addressing system. Zipperer thanked everyone for their input
at this first session and although no action will be taken tonight, he
will take this information back to Ken Pollock, also taking into
consideration that Sister Bay, Forestville and Sturgeon Bay have
separate zip codes when it comes to emergency response.
Citizen Concerns:
• Darrell suggested reducing the speed limit through Institute and
perhaps a marked crosswalk on STH 57 for children and pedestrians
coming from Rock Ridge Road over to the Town Park. Woelfel indicated
the DOT had been previously approached on that subject and Zipperer
will check again.
• Mickey felt there was a large amount of trash, plastic debris and
old equipment throughout the Town. Tice responded that the Property
Maintenance Committee has already identified some areas and will be in
contact with the Door County Corporation Counsel for issuance of
citations and prosecution.

Oral Committee Reports:
Property Maintenance: Tice reported that he has been in contact with
Administrator Kay Miller and that some areas have been viewed under
the Door County zoning ordinance. However, it is the owner’s
discretion in many instances and we have limited control, except that
the Sanitarian would be involved if garbage is an issue. Zipperer
indicated we are well aware of the situations and Tice will be calling
a Committee meeting to address these concerns.
Public Participation:
• Pat Miller asked if the Board will be making a decision on the
acceleration and deceleration lanes at STH 57 and Forest Road and its
cost. Zipperer responded that we are waiting for the recommendation
and permit from the DOT and will cost-share the project.
• Greg Meissner expressed his disappointment with the lack of public
participation and the Board’s decision to not support an ordinance to
restrict motorized craft on Dunes Lake and Geisel Creek. Greg felt
the ordinance would have protected natural resources for future
generations. (Greg will provide a copy of his letter dated 5/18/09 to
be placed on file.) Zipperer responded that no further action will be
taken at this time.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Tice and second by Woelfel to adopt the agenda, as proposed. Motion
carried, unanimously.
Minutes:
Motion by Woelfel and second by Tice to approve the Town Board
minutes of April 20, 2009. Motion carried, unanimously.
Clerk/Treasurer Monthly Report:
Motion by Girman and second by Tice to accept the April 2009 monthly
reports which includes account balances, budget vs. actual and
transaction list by date. Motion carried, unanimously.
Vouchers/Bills/Claims:
Motion by Staveness and second by Woelfel to approve the vouchers,
bills and claims for the period April-May 2009. Motion carried,
unanimously.
Oral Committee Reports, continued:
• Girman indicated the PEG-Cable Channel Committee met last week and
is looking at the issues and requirements in order to move the cable
facilities to the Town hall. Charter customers also have an
opportunity to upgrade services for $4 per month.
Committee Minutes:
The following Committee minutes were accepted and will be placed on
file.
• Ad Hoc Sesquicentennial – April 10 and April 24, 2009
• Dam, Park & Rec Board – March 25, 2009
Pending Business/Status:
1) Plan Commission. Staveness indicated that the Commission is
moving forward on the implementation of the Comprehensive Plan and
creation of necessary ordinances. Those proposed ordinances with
highest priority will include conservation subdivision, big box and
signage.
2) Tourism Zone Commission (TZC). Tice reported that the annual
meeting will be held on Tuesday, May 26th, beginning at 6 pm
(refreshments at 5 pm) at Crossroads. The Town collected $1,167.36
in room tax proceeds for March 2009, with total room bookings of
$64,266. There are 52 permitted establishments: 2 hotels, 4 resorts,
1 inn, 4 bed & breakfast and 41 individual units. Any one not
permitted will be penalized, with enforcement by the Commission. The
Door County Visitors Bureau has hired Bruce Hill as
Communications/Public Relations Director for the Community Marketing
Fund.
3) PEG Cable Channel. Girman indicated that if you have any
questions on channel programming, feel free to call him or Laddie
Chapman.
4) Newsletter. Woelfel said the next issue will be ready to go to
print and out early June.
5) Nature Conservancy. An email from Ryan Andersen, project manager
with Associated Appraisals, confirms that the effective date for the
Nature Conservancy’s request for an additional 15 parcels as tax
exempt will be as of January 1, 2009 and that no taxes will be
refunded for previous years. Mike Grimm (Conservation Ecologist)
indicated a summer intern had been hired to map the trails and was
requested to share the results with the Town.
6) Schauer Park. George Pinney, Director of Door County Parks, has
scheduled a meeting with his Committee and the Towns of Jacksonport
and Sevastopol to review the recently completed feasibility study of
Schauer Park. The meeting will be held at the Sevastopol Town Hall on
Wednesday, June 3rd, beginning at 7 p.m. and is basically for the
sharing of information and is not the planned information meeting,
which will be held at a later date.
7) STH 42/57 and Forest Road Intersection. In addition to the
information shared last month, we have been provided with a copy of
correspondence from DOT Engineer David Nielsen addressed to Steve
Parent/Baudhuin Incorporated requesting some changes/additions to the
drawings previously submitted. We have not received a response from
the DOT as yet.
New Business:
2) Sevastopol Beach & Whitefish Dunes – habitat management and
protection. DNR/Bureau of Endangered Resources Contracted Agent Jaime
Forest will complete and submit draft plans for the habitat management
and protection of Dunes Thistle/Pitchers Thistle. Jaimie will request
agenda time and provide a brief presentation regarding the full plan
and recommendations. Woelfel noted that the areas encompassed nearly
all the shore frontage along Lake Michigan.
3) South Cave Point Road Paving. South Cave Point Road was paved in
August/September of 2008 by Northeast Asphalt. At the time, Bill
Thornton and Cynthia Godfrey had contacted Zipperer to request that we
pave to the end of their property line, as reflected on two previous
surveys. The area in question was paved, with the understanding that
should it be privately owned, Thorntons would absorb the cost, which
was $1,619. Thereafter Baudhuin Incorporated was contacted to review
the legal documents and determine the South Cave Point Road right of
way. The certified surveys and documents on record reflect that the
Town Road terminates at the westerly property line. The matter is
here for resolution for either (i) payment of the paving bill by
Thorntons or (ii) deeding of the area to the Town. Bill Thornton
responded that he did not believe they had ownership of the road,
having given some property and a 30-foot easement to the State of
Wisconsin DNR on the north. Bill would like to cooperate, hand the
property over to the Town so that it is all paved and maintain access
for everyone. . Zipperer doubted the DNR would allow paving. Bill
will talk with the DNR and get back to us.
4) Road Work 2009. Zipperer stated that on Friday, May 15th, Board
members toured the Town roads and identified the projects, totaling
approximately three miles of road construction. Motion by Girman and
second by Tice that the 2009 road work projects be completed by Door
County Highway Department as follows. Motion carried, unanimously.
Zipperer will contact the Highway Department and also ask for their
recommendation as to Apple Lane.
1) Old Highway Road – 0.6 miles. Culver’s drive-thru onto roadway and
junction with Gordon Road, width to be determined, no wedge, 1-1/4”
overlay
2)14th Avenue (formerly Peterson Road) – 0.58 miles. Gordon Road to
City limits (cost share with City of Sturgeon Bay as joint owner)
grind and overlay
3)West Town Line Road – 1.5 miles. Reynolds Road to STH 42, 20 feet
wide, full wedge, 1-1/4” overlay and shouldering
4) Mathey Road – 0.3 miles. Forest Road to Moore,
20 feet wide, full wedge, 1-1/4” overlay and shouldering
5) Apple Road – 0.34 miles. Old OR to termini,
add gravel, grade and possibly oil or recondition
Other areas inspected included:
White Pine Lane – the guardrail has been repaired
Ploor Road – has been graveled and graded
Forest at 42/57 – awaiting recommendation from DOT
Dip in road at East Dunn will be reviewed with County
Entrance at 5982 West Dunn will be addressed by County
Resolution No. 01-2009 TB “Prevailing Wage Law” Woelfel stated that
the construction of the new Town hall was subject to prevailing wage
requirements in that it was a project exceeding the current threshold
of $234,000. Governor Doyle’s proposed biennial budget requests
reducing that to any public work project over $2,000 and Wisconsin
Towns Association encouraged municipalities to voice their objections.
Motion by Woelfel and second by Girman to adopt Resolution No.
01-2009 TB opposing proposed changes to the Wisconsin Prevailing Wage
Law. Motion carried.
Correspondence:
The following correspondence was accepted and placed on file:
1) Door County Planning zoning/construction permits issued April and
May 2009.
2) Independent Inspections, Ltd. billing recap April 2009.
3) City of Sturgeon Bay Fire Department April 2009. Girman reminded
residents to please use caution when burning.
4) Permit for Sale of Fireworks issued to Jan and Betty Zahn at 5590
Gordon Road.
5) WPS and WE Energies reminders to work safely around gas and
electric facilities. You can call Diggers Hotline at 800-242-8511.
6) Public Service Commission of Wisconsin notice of “Strategic Energy
Assessment Final Report on Energy 2014 is available at
http://psc.wi.gov.
7) Wisconsin DNR annual payment in lieu of property taxes – $201.53
for 229.01 acres and $3,811.39 for 643.19 acres = $4,012.91.
8) Door County Board of Adjustment decision to grant portion of the
Peter Mazza request concerning kitchen addition, canopy entry and
screen porch and to deny the portion concerning the deck.

Motion by Staveness and second by Zipperer to adjourn. Motion
carried, unanimously. Meeting adjourned at 9:05 pm.
