BOARD OF SUPERVISORS

Date:	Monday, December 21, 2009 – 7:00 p.m.

Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00
pm.						
Pledge of Allegiance:  The Chairman asked all to raise and join in
reciting the Pledge of Allegiance.

Establish Quorum/Roll Call:
Roll call was taken, with Chairman and Supervisors John Staveness, Tom
Girman, Dan Woelfel and Chuck Tice, along with Clerk/Treasurer Linda
Wait, in attendance.

Meet the Deputy Program – Door County Sheriff’s Department.  None
available.

Citizen Concerns:
Dick Weidman asked the Board to explore use of room tax dollars for
non-profits; Chairman indicated this will be addressed as a separate
item. 

Agenda/proper notice/adopt:
Clerk indicated that the agenda had been properly noticed.  Motion by
Tice second by Girman to adopt the agenda, as posted.  Motion carried,
unanimously.

Approval of Minutes:
Motion by Staveness and second by Woelfel to approve the Board of
Supervisors’ meeting minutes of November 16, 2009.  Motion carried,
unanimously.

Financial Reports and Approval of Vouchers/Bills/Claims:
Motion by Tice and second by Girman to approve the treasurer’s report
with account balances, budget vs. actual and transactions list for the
period ending November 30, 2009; and also to approve for payment the
vouchers, bills and claims for the period November-December 2009. 
Motion carried, unanimously.  

Oral Committee Reports & Committee Minutes:
The Dam, Park & Rec Board minutes of 10/13/09 accepted and placed on
file.
Girman also reported that a server has been ordered for delivery
before year-end.  Laddie will program the server and then install in
our cable room.

New Business: 
Annexation – Criteria & School Tax.  Sevastopol Schools Superintendent
Steve Cromell and School Board members Susan Todey and Dick Weidman
were present.  Steve summarized the City of Sturgeon Bay Plan
Commission request that the anticipated Wal-Mart property be
transferred from the Sevastopol School District to the Sturgeon Bay
School District (the recently annexed Georgenson parcel north of
current store).  He was concerned that the Plan Commission would
attempt to keep the City boundaries synonymous with school boundaries;
however they are exclusive of one another and should not be mixed with
annexation issues.    Any request for a change in school district is
handled by the Department of Public Instruction in Madison and the
criteria are spelled out as educational issues and not finance issues.
 The owner would need to petition both school districts for consent
and Sevastopol has made it clear that it will not consent.  At
present, Sturgeon Bay is 40% state supported, whereas Sevastopol only
receives approximately $70,000 in state aid. 
	Steve and the School Board appreciate the Town’s involvement, working
together on future development and sharing ideas to keep abreast of
neighboring and intergovernmental activities for the good health of
both School and Town.  The Board feels we must maintain our School as
a vital part of the community, with land annexations and school
boundaries as separate processes. 

Pending Business/Status:
Tourism Zone Commission. Tice reported October room tax receipts of
$6,686, with 43 businesses submitting for 42.24% occupancy of the
total 68,681 units available.  It appears tourism is down throughout
the country, some as much as 40%, with Door County doing fantastic
compared to others.  The Door County Visitor Bureau is making some
major changes in its business structure and rebuilding of the website,
with new members elected in December.  Online payments are available. 
There are still some compliance issues, and the Commission voted to
hold late fees and penalties for 2010 into an enforcement fund—this
will amount to approximately $8,000 annually.  Clerk will check on the
ability to place special assessments for those not in compliance.
	Dick Weidman asked if non-profit organizations can apply for access
to the room tax dollars, specifically, the Friends of Whitefish Dunes
are seeking funds for maintenance of ski trails, which he considers
valuable part of tourism.  Tice responded that per our Town Board
resolution, the room tax funds are now designated toward the Town hall
building fund.  Tice suggested Dick contact the DCVB on a County
level, since it is under Door County Parks jurisdiction.  The matter
will be placed on next month’s agenda.

Clark Lake Dam – update on repair.  Zipperer reported total expense
to-date of $23,341.75, which includes permit fee, engineer and repairs
services by Engineers/Constructors, Inc, and tree and stump removal. 
He has forwarded a request for contribution to Jacksonport and, based
on equalized value (71.8% of total), their share amounts to $6,565.15.
  Zipperer reported that the dam level needs to be reduced  to 8.3 for
December.

Sevastopol School – contribution for demolition / tax apportionment
per district.  In response to a prior request for a one-time
contribution toward demolition costs of the modular building,
Sevastopol School provided an itemization of tax apportionment per
taxation district.  Dick Weidman reminded that only the Town of
Sevastopol had used the modular building.  The matter will be brought
back in January, with an invitation to School Board members to address
their concerns.

Animal Control Agreement.  Clerk will contact Mark Richard for
comments and the matter will be brought back in January.
 
DOT Speed Study Hwy 57/Institute – status.  Zipperer reported that the
Wis DOT has completed its comprehensive review, including a traffic
and field study.  They have concluded that the current 45 mph is
appropriate and no further action will be taken.

Thornton Special Assessment – status.   Despite Mr. Thornton’s visit
to the office on December 8th and promise of payment, a review of the
Treasurer’s records indicates the first installment of 2009 has not
yet been paid (due January 31st).  Our special assessment of $1875
will come off the top. 

New Business:
Clark Lake Dam – Letter of Understanding with Town of Jacksonport. 
Zipperer reported that Jacksonport has agreed to the Letter of
Understanding for a continuing joint venture as to repair and
maintenance of the Clark Lake Dam and we are awaiting a signed copy.

Door County GIS/LIO Mapped Building Outlines.  In response to Tom
Haight’s email and request for payment of $538.35, a review of Board
minutes confirms that in August and September of 2008, action was
taken to not subscribe to the upgraded “neighborhood” level of the GIS
mapping system.   The software and server upgrade appears to be more
advantageous to the Door County Planning Department for monitoring
construction.  Haight also indicated no one else had paid, as yet. 
The Board will take no additional action; the previous decision
stands.

Wis Department of Revenue County Assessment Proposal.  Next “Town Hall
Meeting” on proposal for county assessment has been rescheduled to
January 7th at NWTC in Green Bay, beginning at 2 pm.  Local officials
are encouraged to attend.

Town Road Improvement Program (TRIP).  The 2010-2011 Town Road
Improvement Program Application has been submitted for reconstruction
at Forest Road/STH 42-57 and we have been allocated $20,000.  In
accordance with the Local Road Improvement Program (LRIP), Zipperer
submitted road work budget considerations for 2010 and identified
future road work for 2011-2012-2013.

Snow Removal at Town Hall.  Total Lawn Care has been contracted for
the winter season to clear the Town hall parking lot and sidewalk
areas and has been doing a good job.

Town Hall Rental Agreement.  There was discussion on the rental fee,
with perhaps an adjustment if kitchen facility was used or a nominal
fee for all users; the small conference remains available to all
community-based organizations at no charge.  There seems to be no
contention or conflict at this point.  Motion by Woelfel and second by
Staveness to track reservations over the next six months, with the
clerk to make determinations when needed, and the Board will
re-evaluate after that period.  Motion carried, unanimously.

Resolutions:
Resolution No. 08-2009 TB “Appointment of Election Officials.”  Motion
by Staveness and second by Woelfel to approve Resolution No. 08-2009
TB nominating election officials for the term beginning January 1,
2010 and ending December 31, 2011.  Motion carried, unanimously.

Resolution No. 09-2009 TB “Appointment of Clerk/Treasurer 2010-2012.” 
Motion by Woelfel and second by Staveness to approve Resolution No.
09-2009 TB to re-appoint Linda D. Wait to the position of
clerk/treasurer effective January 1, 2010 and expiring on December 31,
2012, as full-time, and with commendation to the electors for their
foresight and Linda for past performance.  Motion carried,
unanimously.
