BOARD OF SUPERVISORS

Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m.

Establish Quorum/Roll Call:
Roll call was taken, with Chairman and Supervisors John Staveness,
Chuck Tice, Dan Woelfel and Tom Girman, along with Clerk/Treasurer
Linda Wait in attendance.

Also In Attendance:  Laddie Chapman, Bob Stracka, Victoria Cerinich,
Carol Scholz, Mike Grimm, Lawrie Kull, Roger Bochek, Josie Bochek, Biz
Virlee, Pat Miller and Greg Meissner.

Meet ‘n Greet -  Door County Sheriff’s Deputy Program:  None
available.

Citizen Concerns:
● Carl Scholz asked if Sturgeon Bay Utilities had contacted the
Town prior to its tree trimming.
●  Pat Miller expressed concern for safety, costs and setting
precedent at the STH 42/57 and Forest Road intersection and that those
modification costs were not included in the budget.  Chairman Zipperer
said the matter will be discussed under New Business.

Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed.   Motion by
Tice and second by Staveness to adopt the agenda, as proposed.  Motion
carried, unanimously.

Minutes:
Motion by Woelfel and second by Tice to approve the February 16, 2009
Board of Supervisors’ meeting minutes, with clarification as to Geisel
Creek/Dunes Lake “condition report.”  Motion carried, unanimously. 

Clerk/Treasurer Monthly Report:
Motion by Tice and second by Zipperer to accept the February and March
2009 monthly reports which includes account balances, budget vs.
actual and transaction list by date.  Motion carried, unanimously.

Oral Committee Reports:
Woelfel reported that the ramp and pier is in at Clark Lake, with
axles to be stowed.

Committee Minutes:  
The following Committee minutes were accepted and will be placed on
file.
•  Ad Hoc Sesquicentennial  – February 6, February 20 and March 27,
2009
•  Plan Commission – November 12, 2008 and March 12, 2009
• Dam, Park & Rec Board – December 10, 2008
Vouchers/Bills/Claims:
Motion by Tice and second by  Staveness to approve the vouchers, bills
and claims for the period March and April 2009.  Motion carried,
unanimously.

Pending Business/Status:
1)  Plan Commission.  Staveness indicated that the Geisel Creek/Dunes
Lake matter will be discussed under “Ordinance.”
2)  Tourism Zone Commission (TZC).  Tice commented on the “room tax
revenue” informational sheet as a guideline for proper and improper
use of room tax.  Our Town does not have its own tourism entity,
utilizing the Community Marketing Fund with the City of Sturgeon Bay
for promotion.  Our net receipts for the month of March were $1,248.
There had been some compliance issues, but those seem to have been
rectified by our legal counsel.  Advance reservations for 2009
indicate matching or exceeding 2008, in light of the economy.
3)  PEG Cable Channel.  Girman reported that Brad Birmingham has
donated a flag for our Town hall dedication ceremony.  Fiber optic
cable will be run into the building, once a modulator has been
acquired.  In light of legislative changes, we are fortunate to have
had our cable channel in place.  Tom thanked Tom Soik for the work he
has done in keeping our channel operational. 
4)  Burn Permits.  Girman indicated that the burn ban has been lifted.
Remember that burn permits are required on a case by case basis; burn
barrel permits are issued on an annual basis.  Girman urged caution
when issuing permits.
5)  Wind Turbine Ordinance.  Staveness reported that the Plan
Commission recommended to discontinue the moratorium and adopt the
Door County wind turbine ordinance.   Girman agreed that the County
ordinance would suffice for the present.   No action is required and
the moratorium will be allowed to expire May 19, 2009.
6)  Newsletter.  Woelfel expects the next issue will be available on
or about Memorial Day and will be dedicated to Sesquicentennial
celebration.  Articles are to be submitted by May 1st.
7)  Nature Conservancy.  An email from Ryan Andersen, project manager
with Associated Appraisals, indicated that exemption status had not
been granted back in 2006 due to missing information from the Nature
Conservancy.  Motion by Staveness and second by Tice that the matter
be brought back next month for clarification on their request.  Motion
carried, unanimously.

New Business:
1)  Renewal Alcohol Beverage Licenses.  Motion by Tice and second by
Girman to approve the following seasonal Class B fermented malt
beverage licenses, with correction to No. C.3., for the period May 1,
2009 – October 31, 2009:  Sevastopol Dam, Park & Rec Board  and the
Institute & Valmy Athletic Club.  Motion carried, unanimously. 
2) Programming Highway Safety Improvement Program (HSIP).  Zipperer
expressed concern with constant changes to the stimulus packages.
Wait spoke with a DOT engineer, who indicated this program was a
preliminary review of a project, in lieu of formal application should
it not meet parameters.  This program is for town and local roads only
for years 2010-2013, with a cost greater than $25,000 and not to fund
sites with only “crash potential.” 
3)  Bay-Lake Regional Planning Commission (BLRPC).  Correspondence
from the Door County Planning Department indicates the County is
considering withdrawing from BLRPC effective January 1, 2010 (based on
an annual membership cost of $35,000 with limited usage not a wise use
of tax dollars).  The Towns of Brussels, Egg Harbor, Forestville,
Gibraltar, Liberty Grove, Union and Washington, the Village of Sister
Bay, and the City of Sturgeon Bay are official members, regardless of
the County’s status.  Zipperer indicated we will know more later this
year.
4) Schauer Park.  George Pinney, Door County Parks Director, provided
the Towns of Jacksonport and Sevastopol with a copy of the Schauer
Park Feasibility Study, which is on file in the Town office and
available for check out.  Zipperer said there will be a joint hearing
scheduled between the Town Boards and all residents will be invited.
5)  Burning Ban.  The ban has been lifted, as indicated above.
6)  STH 42/57 and Forest Road Intersection.  Staveness said the Plan
Commission’s recommendation was to attempt to garner funds and proceed
with an RFP (request for proposal) in order to accomplish the work per
State DOT requirements.  Baudhuin Incorporated submitted the
application for improvements to the DOT and they required several
additions to the drawing, specifically that “all work shall be done in
conformance with Wisconsin standard specifications for highway and
structure construction.”  Following discussion, motion by Staveness
and second by Zipperer to modify Forest Road according to the
Wisconsin DOT requirements, apply for funding through a stimulus
package and move forward with an RFP.  Staveness said the DOT will
require acceleration and deceleration lanes; Woelfel and Girman were
concerned with costs; following Zipperer’s withdrawing his second,
Staveness withdrew his motion.  Motion by Woelfel and second by Girman
that we obtain a determination from the State as to corrections needed
at the Forest Road and STH 42/57 intersection prior to going forward
with an RFP.  Motion carried, unanimously.

ORDINANCE No. 2009-01 to Regulate Boating upon the waters of Geisel
Creek and Dunes Lake.  The request was initiated by Greg Meissner and
addressed to the Town Board at the February 2009 meeting.  The matter
was referred to the Plan Commission and Staveness said the Commission
recommended to restrict activity on Geisel Creek from Haberli Road
into Dunes Lake to only non-motorized vehicles and boats.  In order to
meet DNR requirements, a hearing would be required and June 15th was
suggested as a date.  Motion by Staveness and second by Zipperer to
approved Ordinance No. 2009-01 and take the matter to public hearing
on June 15, 2009 at 6 pm.  Motion defeated (2 to 3), recorded as
follows: Staveness-aye, Zipperer-aye; Girman-nay, Tice-nay,
Woelfel-nay.

and March 2009.

2009.
