BOARD OF SUPERVISORS’ MEETING MINUTES
Monday, October 20, 2008 - Meeting Room, Modular Building at
Sevastopol Schools

Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m.
Pledge of Allegiance: Chairman asked all to rise and join in the
Pledge of Allegiance.
Establish Quorum/Roll Call:
Roll call was taken, with Chairman and Supervisors John Staveness,
Chuck Tice, Dan Woelfel and Tom Girman, along with Clerk/Treasurer
Linda Wait in attendance.
Also In Attendance: Laddie Chapman, Kurt Rentmeester, Lawrie Kull,
Pat Miller and Greg Stillman.
Meet the Deputy Program – Door County Sheriff’s Department: None
available.
Citizen Concerns:
● Pat Miller asked for an update on the road name change to
“Strahan Road.” She also hoped that the Cable Committee will use
whatever dollars are available for a good quality audio/visual system
in the new Town Hall. Zipperer indicated that the new road signs will
be ordered.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Tice and seconded by Staveness to adopt the agenda, as proposed.
Motion carried, unanimously.
Minutes:
● Motion by Staveness and seconded by Tice to approve the Board
of Supervisors’ minutes of September 15, 2008. Motion carried,
unanimously.
● Motion by Tice and seconded by Woelfel to approve the Special
Board minutes of September 29, 2008, with a correction that
landscaping was not included in the Portside contract (parking lot was
included). Motion carried, unanimously.
Clerk/Treasurer Monthly Report:
Motion by Tice and seconded by Girman to approve the September 2008
account balances, budget vs. actual and transaction report, to be
placed on file. Motion carried, unanimously.
Vouchers/Bills/Claims:
Motion by Staveness and seconded by Girman to approve the vouchers,
bills and claims for the period September/October 2008. Motion
carried, unanimously.
Oral Committee Reports:
Cable Committee: Girman reported that Channel 19 has been transferred
to Channel 97 and that Charter is also in the process of adding a few
more channels.

Pending Business:
Tourism Zone Commission. Tice reported August revenues of $45,445 and
$14,579.75 remitted as the Town’s share. The annual meeting will be
held on Wednesday, October 22nd at Gordon Lodge in Baileys Harbor,
with the meeting beginning at 4 pm and dinner to follow. Geiger &
Association will report on their contract for press tours, journalist
visits and articles printed, radio spots and online promotions, which
resulted in a $356,910 return on investments. eBrain concludes that
80% of travelers do their planning online, with about 146,000 online
visitors.
Wind Energy Update. Girman attended a session in Appleton presented
by Attorney Glen Stoddard and WTA Executive Director Rick Stadelman.
Wind turbine siting and possible legislative changes were discussed on
what towns can do to regulate wind turbines under current law and
participate in changes to retain local control in the future. We
currently have a moratorium in place for the interim control of large
wind turbines, which will sunset in May 2009, and Girman suggests we
have an ordinance in place to address the pros and cons. We should be
sure to include an assignment and accountability clause in our
ordinance.
Roadwork 2008. Zipperer reported that South Cave Point from Whitefish
Bay to the end has been shouldered, and we are clarifying ownership as
to the northern end.
Town Hall Building Project Update. Woelfel indicated that the
official groundbreaking took place on September 29th and since then
the topsoil has been pushed back, initial grading completed, footings
are poured and walls will be going up. The Building & Property
Committee will be viewing samples for flooring, paneling, cabinets,
interior/exterior colors, etc., at the Portside Builders showroom on
October 21st.
Comprehensive Plan. Staveness reminded that the Comprehensive Plan
Committee has been replaced by the Plan Commission and they expect to
meet within the next week or two to review changes and subsequently
make a recommendation to the Town Board.
New Business:
Muskat Property at 4125 STH 42/57. Zipperer reported that the
Wisconsin Department of Commerce has issued an order to remove the
abandoned underground storage tank on the property. Attorney Mike
Green, on behalf of the Muskat estate, indicates their willingness to
comply with the order and requested an extension in order to obtain a
certified tank remover/cleaner and arrange for removal.
Schenck – Engagement for 2008 Audit. The Clerk has entered into a
letter of engagement for Schenck Solutions to provide audit and
financial reporting services for the year ending December 31, 2008.
Schenck has provided our auditing needs since 1999.
Email Disclosure/Public Record. Tice asked if the Town Board has
policy as to sending and receiving emails. The response from WTA
counsel Carol Nawrocki indicates that emails regarding town business
would be a public record and recommended they be used as a one-sided
communication and that no decisions or discussions are taking place
within the email. As with other public records, they should be
retained for 7 years, unless an approved policy is in place to the
contrary.
American Transmission Company (ATC). Zipperer explained that ATC is
planning to make improvements to the electric transmission system in
Door County, specifically to add a new 138-kilovolt line between the
Canal and Dunn Road substations. A public open house was held on
October 15th to learn more about the plan. The plan is geared to
follow existing lines, but they are required to provide an alternate
route, as well.
Speed Limit WD/West Shore Drive. Zipperer responded to a complaint as
to the 55 MPH sign erected at the corner of WD and West Shore Drive
and the danger posed in turning west from West Shore at that stop
sign. Lawrie Kull felts that some tree/brush trimming would help with
visibility.
Sturgeon Bay Visitor Bureau Re-Allocation of Room Tax Collections.
Tice explained that the City has had their own room tax for the past
10 years, using those dollars to form the Sturgeon Bay Visitor and
Convention Bureau (SBVB). The northern municipalities created the
Door County Tourism Zone Commission (DCTZ) in May 2007, charged a
different rate of room tax and uses the Door County Visitor Bureau
(DCVB) for tourism promotion. Although the City has increased their
room tax from 4½ % to 5 %, they have not joined the DCTZ and use the
SBVB as the entity to promote their community. Tice presented the
proposed “2009-2011 Community Marketing Agreement” and “Resolution
Authorizing and Approving Establishment of Community Marketing Fund”
whereby the City would joint the DCTZ and collect a 5.5% room tax.
Under that formula, Sevastopol would allocate to the SBVB as follows:
Year 2009-$19,400; Year 2010-$18,430; and Year 2011-$16,587.
Following discussion, motion by Woelfel and seconded by Staveness that
we accept the recommendation of Supervisor Tice and allocate the
dollars as defined in the 2009-2011 Community Marketing Agreement,
conditioned upon the following: (i) that the City of Sturgeon Bay
shall become a member of the Door County Tourism Zone Commission; (ii)
that a representative of the Town of Sevastopol shall serve on the
Sturgeon Bay Visitor Bureau; and (iii) that those Sevastopol lodging
providers under the current listing to the Door County Tourism Zone
shall be given a 10% reduction in membership dues, should they choose
to become a member of the Sturgeon Bay Visitor Bureau. Motion carried
with a vote of 4-1 (Woelfel, Girman, Staveness, Zipperer-aye;
Tice-nay).
Ordinances:
No. 2008-04 “Allowance for Split Shift and Alternate Election
Officials.” Motion by Girman and seconded by Woelfel to approve
Ordinance No. 2008-04, to allow for two shifts of election
inspectors/pollworkers on an election day, the first shift to commence
at 7 am and end at 1 pm, and the second shift to commence at 1 pm and
end at 8 pm or later if needed to complete tabulation and
documentation. The ordinance also allows for appointment of alternate
election inspectors, as needed, to maintain adequate staffing on an
election day. Motion carried, unanimously.
No. 2008-05 “Alternative Claims Procedure.” Motion by Girman and
seconded by Woelfel to approve Ordinance No. 2008-05, which provides a
procedure for approving financial claims in the nature of bills and
vouchers that are of a routine or time-sensitive nature and require
timely payment prior to the next convening of the Town Board. Motion
carried, unanimously.
