BOARD OF SUPERVISORS’ MEETING MINUTES
Monday, November 17, 2008 - Meeting Room, Modular Building at
Sevastopol Schools
4550 STH 57, Sturgeon Bay, Wisconsin
Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:32 p.m.
Establish Quorum/Roll Call:
Roll call was taken, with Chairman and Supervisors John Staveness,
Chuck Tice, Dan Woelfel and Tom Girman, along with Clerk/Treasurer
Linda Wait in attendance.
Also In Attendance: Laddie Chapman, Kurt Rentmeester, Lawrie Kull,
Pat Miller, Charlie Jarman, Dick Shappell, Victoria Cerinich and
Arlene Woelfel.
Meet the Deputy Program – Door County Sheriff’s Department:
Patrol Deputy Robert Lauder was available to answer questions. He
indicated that Gordon Road was receiving extra patrol, with the
reduced speed limit in that area. The Chairman has noticed missing
traffic signs and made replacement, if available. Deputy Lauder
indicated that if stolen signs are located, an attempt is made to
return them to the rightful owner. With the approaching winter
weather, he urged drivers to use caution and to call with any
concerns. Pat Miller complimented the Sheriff’s Department’s
professionalism on a recent incident.
Citizen Concerns:
● Pat Miller asked for explanation on an agenda item (McClellan
Holdings) and Zipperer indicated it would be addressed under pending
business.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Tice and second by Girman to adopt the agenda, as proposed. Motion
carried, unanimously.
Minutes:
● Motion by Staveness and second by Tice to approve the Board
of Supervisors’ minutes of October 20, 2008 and the Special Board
minutes of October 24, 2008. Motion carried, unanimously.
Clerk/Treasurer Monthly Report:
Motion by Tice and second by Woelfel to approve the October 2008
account balances, budget vs. actual and transaction report, to be
placed on file. Motion carried, unanimously.
Vouchers/Bills/Claims:
Motion by Tice and second by Woelfel to approve the vouchers, bills
and claims for the period October/November 2008. Motion carried,
unanimously.
Oral Committee Reports: None.
Committee Minutes: None at this time.
Pending Business:
Tourism Zone Commission. Tice reported that all municipalities in
Door County, with the exception of Clay Banks, will be members of the
Commission as of January 1, 2009. September revenues and late
receipts total $7,464.88 with an occupancy rate in our Town of over
42% and an average nightly rate of $155. The City of Sturgeon Bay
continues to review the proposed marketing agreement and is expected
to sign it by January 1st, 2009. The Commission has grown
substantially and hopes to utilize the new Town Hall, once complete,
for future meetings. The next meeting will be held on November 20th
in Fish Creek.
Town Hall Building Project Update. Woelfel reported that the
foundation and side walls have been poured, with extra testing to
assure proper support, radiant heat is being installed, with half of
the concrete floor poured and the carpenters are putting up interior
walls. Roof trusses are expected in the next 7-10 days and once
enclosed and heated, the concrete work can be finished. The sewer
line has been excavated and insulated. Choices as to flooring,
cabinetry and colors are being viewed and selected. The Sevastopol
School Horticulture Class is willing to do a landscape plan as a class
project and we would also have our park employees available to do the
work.
PEG Cable Channel. Girman attended the recent Community Protection &
Services Committee meeting and presented a letter of understanding for
the purpose of continuing to co-locate the Town’s broadcast equipment
at the City’s facility at a monthly charge of $75. It will be
presented to the City Council for approval.
General Election. Wait reported 1,763 votes having been cast at
November 4th election, with 293 absentee ballots having been
processed. We now have 2,632 registered voters and this represented a
66% voter turnout. Our total population is estimated at 2,870.
Roadwork 2008. Zipperer reported that all roadwork has been
accomplished, with some shouldering done on Timber Ridge, Peterson
Road and Bluff Drive up from Bay Shore. The 35 mph speed signs are
up on Gordon Road. The Wisconsin DOT mileage certification will be
completed by December 15th. Charlie complimented on the road radius
at Mathey and Whitefish Bay intersection.
McClellan Holdings. An order has been entered by the Door County
Circuit Court in McClellan vs. Town of Sevastopol, dismissing the suit
on November 4, 2008, with legal costs being reimbursed by McClellan
Holdings to the Town, as agreed.
New Business:
1) Application for Conditional Use Permit – Karen Hackett at 3803
Moeller Drive. Ms. Hackett has applied to the County of Door for a
conditional use permit to add a three-season room to a manufactured
home, which is considered a nonconforming use in the SF-20 zoning
district. The Plan Commission, having reviewed this matter on
November 12th, felt that the addition would enhance the appearance of
the premises and recommended approval by the Town Board. Following
discussion, motion by Staveness and second by Tice to forward the
Board’s recommendation of approval to the Resource Planning Committee.
Motion carried, unanimously. The clerk shall notify the Planning
Department of the Board’s recommendation.
2) Snow Removal Policy. Zipperer explained the Door County Highway
Department has made some revisions to its Snow Removal policy and that
plowing of private driveways will be provided on a “regular” basis and
no longer on a “when called” basis. However, property owners can
continue the option of having their driveway sanded on a “regular” or
“when called” basis. The clerk shall notify the existing snow removal
agreement holders of this change in policy.
3) Clark Lake Boating Ordinance Review. Zipperer explained that this
matter is here for informational purposes only and that a hearing will
be held on December 2nd to address the DNR’s concern with language in
the proposed Town of Jacksonport ordinance to regulate boating on
Clark Lake and Logan Creek. The DNR has asked for clarification on
boats powered by electrical motor and combustion engine traversing
Logan Creek or the proposed restricted northern area of Clark Lake
within the Town of Jacksonport. No action was taken; those interested
in further details are invited to attend the December 2nd public
hearing in Jacksonport.
4) Door County Legislative Days 2009. A letter from Mark Nelson, Bill
Chaudoir and Mike Serpe, co-chairs of the Door County Legislative Days
Finance Committee, provided a recap of the 2007 Legislative Days
efforts and a request for financial support of the next biannual event
anticipated for April or May 2009. All are invited to complete the
“Issue Identification Survey” to identify local issues and concerns
you feel the State of Wisconsin can and should help resolve. The
program consists of a delegation traveling to Madison to educate
legislators and lobby for assistance. Return your completed surveys,
and interest in attending, to Rob Burke at the UW-Extension office.
Woelfel felt that since so much of Door County resolves around the
lakeshore, identifying cladaphora and zebra mussels and dredging
permits required to clean up beaches should receive some attention.
The Board recently budgeted a $250 contribution; however a $500
“Bronze Sponsor” would allow two complimentary registrations. The
matter will be brought back next month.
5) City of Sturgeon Bay Landfill Site Expansion. Girman indicated
that the Town continues to negotiate with the City of Sturgeon Bay for
possible use of its compost/brush site.
6) Christmas Tree Trimming. Woelfel indicated that using LED lights
could result in substantial electrical savings. Tree trimming is
scheduled for Saturday, December 6th, at 9 a.m.
Resolutions:
No. 06-2008 TB “Plan Commission Appointment.” Motion by Girman and
second by Tice that Tom Girman be appointed to serve on the Plan
Commission, filling a vacancy when one of the original appointees
chose not to serve. Motion carried, unanimously.
No. 07-2008 TB “Town Road Renaming – N. 14th Avenue (formerly Peterson
Road) Motion by Staveness and second by Woelfel that the portion of
Reynolds Road from its junction with the Sturgeon Bay City limits
north to the junction with Gordon Road be renamed and identified as
“N. 14th Avenue” commencing January 1, 2009. Motion carried,
unanimously.
No. 08-2008 TB “Establish Tax Rate 2008” (to be paid in 2009). Motion
by Tice and second by Girman to approve Resolution No. 08-2008 TB with
a general property tax levy of $535,601 and the tax (mil) rate in
support of such levy established at $.761802 for the year 2008 (to be
paid in 2009). Motion carried, unanimously.
Ordinance:
No. 2008-07 “Ordinance to Adopt Comprehensive Plan” Staveness
indicated that the Plan Commission, on October 30, 2008 by Resolution
No. 2008-01 PC, recommended that the Town Board adopt the
Comprehensive Plan, along with all maps and exhibits. The clerk will
follow up with Jeff Sanders at Omnni Associates as to when we can
expect the final product and the matter will be brought back next
month.
