MINUTES of SPECIAL MEETING
Monday, April 7, 2008 – 6:00 p.m.

Call to Order:
Dan Woelfel, Chairman of the Planning & Zoning Committee, called the
meeting to order at 6:00 p.m. in the Town meeting room, modular
building at Sevastopol Schools.

Establish Quorum/Roll Call:
Roll call was taken.  Board and Committee Members Tom Girman, John
Staveness, Dan Woelfel, Leo Zipperer and Chuck Tice were in
attendance.  Also present were Clerk/Treasurer Linda Wait, Laddie
Chapman, Marc Isaksen and Margaret Suchy Rose.

Petition for Grant of Variance:

1) Marion Ciepluch – Petition for grant of variance at 5067 South Cave
Point Drive to
exceed height allowance and encroach into side/road setback.

Woelfel summarized the petition and application of Marion Ciepluch, et
al., for a grant of variance.  Also available were drawings, site plan
and elevations as prepared by Marc Isaksen, Architect, and photos
recently taken by Woelfel.  There are actually two separate requests:
(i) the first being to exceed height allowance, side yard setbacks and
town road setbacks in a multiple occupancy development (MOD); and (ii)
the expansion of a MOD requiring a conditional use permit. 

There are two existing structures and the property is considered a
nonconforming MOD.  Isaksen explained the intent to eliminate the
cottage nearest the water, which does not meet setback nor the minimum
750 square foot area requirement.  However, the proposed new structure
does not meet setback requirements and a variance would need to be
secured.  Ms. Rose indicated that it is not the intent to tear down
the other cottage, as it has historical and sentimental value to the
family. 

Woelfel also read into the record the 10/2/07 letter of Kay Miller,
Door County Zoning Administrator II, indicating that since there are
two living quarters located on the property, it is treated as a MOD,
which is a nonconforming use in the SF-20 zoning district.  Ms.
Miller’s review of the survey and proposals indicated that a new
structure would not be allowed and would not satisfy the require
criteria to secure a variance or conditional use permit

There was discussion as to proving hardship, setting precedence and
too many variables to the request.  Isaksen offered to re-draw the
plans to be within the 65-foot MOD setback and height requirements.

Following discussion, motion by Zipperer and seconded by Girman that
the Town recommend denial of the petition for variance, as submitted.
Motion carried (aye-Girman, Tice, Zipperer and Woelfel;
nay-Staveness.)

2) Loudon Webster and Mary Webster – Petition for grant of variance at
4324 Glidden Drive to encroach into setback from ordinary high water
mark.

Woelfel distributed copies of the floor plan, elevations and site plan
as prepared by Marc Isaksen, and also read into the record a letter
from Mark and Jean Elste (neighboring property owners) in objection to
the variance petition.  The request is to build an addition to the
existing structure, which encroaches into the setback from the high
water mark.  Woelfel explained two previous requests, which were
denied, and that separate consideration is given as to granting a
variance dealing with a handicap situation.  Isaksen indicated that
the entire addition would be within the 75-foot high water mark
setback and includes the conversion of a screened porch to living
space. 

Following discussion, motion by Staveness and seconded by Woelfel that
the design would be acceptable, if the porch area is left unchanged.
Motion carried, unanimously.

Adjourn:
Motion by Staveness and seconded by Girman to adjourn.  Motion
carried.  Adjourned at 7:15 p.m.
