BOARD OF SUPERVISORS’ MEETING MINUTES
Monday, October 22, 2007 - Meeting Room, Modular Building at
Sevastopol Schools

Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m.
Pledge of Allegiance: Chairman asked all to rise and join in the
Pledge of Allegiance.
Establish Quorum/Roll Call:
Roll call was taken. Chairman Leo Zipperer, Supervisors Chuck Tice,
Dan Woelfel, Tom Girman and John Staveness, along with Clerk/Treasurer
Linda Wait were in attendance.
Also In Attendance:
Laddie Chapman, Whalton Georgenson, Linda Georgenson and Pat Miller.
Meet the Deputy Program of the Door County Sheriff’s Department: No
one was available.
Citizen Concerns:
Pat Miller asked if she would be able to speak as to the annexation
petition under New Business. Chairman Zipperer explained that the
Board will take no formal action, but the item was placed on the
agenda to acknowledge receipt of the notice.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Tice and seconded by Girman to adopt the agenda, as proposed. Motion
carried, unanimously.
Minutes:
Motion by Staveness and seconded by Tice to approve the meeting
minutes of the Board of Supervisors of September 17, 2007, with
comments of Pat Miller to be added as to New Business, Item 2, Brad
Birmingham petition for grant of variance. Motion carried,
unanimously, and the minutes shall be amended to reflect that
addition.
Motion by Girman and seconded by Tice to approve the minutes of the
Special Meeting of the Board of Supervisors (as to the conditional
acceptance of Bluff Court Trail/Terrace/Lane as Town roads) on October
15, 2007. Motion carried, unanimously. Zipperer indicated that the
Letter of Understanding had been entered into and the required deposit
had been received. Motion by Tice and seconded by Staveness to
approve the Letter of Understanding. Motion carried, unanimously.
Clerk/Treasurer Monthly Reports:
Motion by Tice and seconded by Woelfel to accept the treasurer’s
report for the month of September 2007, which includes account
balances, transaction/register detail and budget vs. actual. Motion
carried, unanimously.
Vouchers/Bills/Claims:
Motion by Staveness and seconded by Girman to approve the vouchers,
bills and claims for September 2007. Motion carried, unanimously.
Oral Committee Report: None.
Committee Minutes:
The following Committee minutes were accepted and placed on file:
● Building & Property – August 20, 2007
● Comprehensive Plan – August 23, 2007 and August 30, 2007
● Cable Advisory PEG 19 – September 14, 2007.
Pending Business:
1) Comprehensive Plan. Staveness reported that the Committee met on
October 17th to discuss Chapter 10, “Future Land Use,” with the next
meeting scheduled for November 7th to continue discussion on Chapter
10 and introduction of another chapter.
2) Tourism Zone Commission. Tice reported that Jack Moneypenny did
take over as the new Director of the Door County Visitor Bureau on
October 16th. Washington Island has now jointed the Tourism Zone
Commission. The next meeting is scheduled for November 15th at 10
a.m. on the Island. Tice also reported that Randy Nesbitt has
resigned as legal counsel for the Commission, to avoid any potential
conflict of interest in his representation of various Door County
municipalities. Attorney William VandeCastle from Green Bay has been
chosen as the replacement, pending his acceptance of those duties
which includes the enforcement of the ordinances. The Commission will
be posting notice for a part-time assistant/administrator (20 hours
per week). The municipalities have been reimbursed for the $3,000
start-up funds and have now been billed for an equal share ($240.50)
of the initial legal expenses. Room tax collections for the year, May
through August, total $1,515,591---greater than the original estimate
of $1.2 million. Room tax for the Town of Sevastopol for that period
amounted to $122,272 with 37 businesses reporting tax and net payments
to the Town of $36,868. September and October are expected to be even
greater. As a result of exceeding $300,000 collections, Sister Bay,
Liberty Grove and Gibraltar will have two representatives to the
Commission by the end of the year. Woelfel inquired as to the cost of
office expense and Tice responded that 4% goes for administration.
3) PEG Cable. Girman reported that the City of Sturgeon Bay Cable
Communication and Protection & Services committees approved the
elimination of our $1,500 usage fee. Thanks, Tom! Girman indicated
that additional comments will be made under “New Business,” Items 1
and 2.
4) Demolition. Woelfel reported that the Generations/Antique
building is expected to be demolished by the end of the week.
5) Nuisance Ordinance. Tice continues to collect sample ordinances
from various sources and will bring the matter back next month.
6) Clark Lake “Slow No Wake.” A joint public hearing will be held on
Monday, November 12th, at the Jacksonport Town Hall, 7:00 pm, to
provide information and allow public comment on a proposed ordinance
to regulate boating activities on Clark Lake, including restrictions
on speed (slow-no-wake).
New Business:
1) Purchase of Cable Equipment. Girman reported that Tom Soik will
continue his services under the same terms through 2008. The Cable
Committee approved the purchase of additional cable equipment at a
cost of $1,148. This would include headphones, battery pack, power
strip, extension cord, wireless mike set, flood lights/mini boom and
DVD video cassette. In that $2,000 was budgeted for capital outlay
cable equipment for 2007, no additional approval is required at this
time.
2) Chapman Compensation for Cable Channel 19. Girman submitted a
proposed “Videographer Agreement” between the Town and Laddie Chapman
for video recording up to 24 events per year, subject to the following
provisions: (1) date and subject to be mutually agreed upon; (2)
videographer shall be paid $50 for each event session; (3) no more
than 12 events per years shall use an additional assistant; (4) Town
will receive a DVD master copy; (5) additional copies may be made
available on request; (6) recording equipment shall be supplied by the
Town; (7) all recordings shall be submitted to the Town’s PEG channel
for broadcast; and (8) agreement may be canceled at any time. The
Committee requests approval from the Board to accept and put the
agreement into affect. Motion by Woelfel and seconded by Staveness to
approve the “Videographer Agreement.” Motion carried, unanimously.
3) Annexation Petition – Georgenson 28.84 acres on Peterson Road.
Zipperer indicated that the recent Advocate article was incorrect, in
that the petition for direct annexation was made by Whalton (Butch)
Georgenson and Linda Georgenson. The Georgensons were present and
indicated that the reason for their request is for the proposed
Wal-Mart expansion. Although the property will be removed from the
Town tax roll, Sevastopol Schools will have a substantial benefit in
taxes. Butch indicated the proposal would be for a new building
behind the present Wal-Mart store, which would then become parking
area, and would depend on annexation and other conditions. He felt
that Wal-Mart was committed to the site. Pat Miller was concerned
with the affect of annexation on the Town and the school district,
wondered what “retail commercial and related uses” could be, the loss
of tax revenue, the lengthy process and involved studies. Zipperer
responded that we do not know the factors at this point—it could refer
to parking lot, stormwater retention ponds, sewer and water utilities.
The Town would receive annual payments for 5 years to cover the lost
property taxes, based on the taxes for the year in which the
annexation is filed. As to further annexation, the City has
extraterritorial zoning jurisdiction extending 1-1/2 miles and one
mile for direct annexation. The Board does not have a vote in a
direct annexation matter.
4) WISLR (Wis Information Systems for Local Roads) Rating of Town
Roads. The Wisconsin Department of Transportation requests pavement
ratings on a bi-annual basis and 2006/2007 rating are due December 15,
2007. Based on the “Surface Type and Paser Rating Table” provided,
the Board reviewed the road segments to update pavement ratings based
on recent road construction and maintenance work. The clerk will make
the appropriate changes and submit the ratings via the WISLR
electronic pavement rating spreadsheet.
Correspondence:
The following correspondence was accepted and placed on file.
1) Door County Soil & Water Conservation – approval of Nonmetallic
Mining Reclamation Plan for Fred Pesch/County T.
2) Door County Board of Adjustment – notice of public hearing on Brad
Birmingham petition for variance at 4710 Bay Shore Drive.
3) City of Sturgeon Bay Fire Department – September 2007 fire
report.
4) Door County Planning Department – zoning permits September 2007.
5) Independent Inspections, Ltd. – building permit billing recap
September 2007.
6) Wisconsin Division of Transportation – current estimate of 2008
General Transportation Aids of $159,288.12 and notice of 2007
quarterly payment of $39,822.03.
7) Wisconsin Towns Association – group benefits survey for interest
in group health insurance program.
8) Wisconsin Historical Society – notice of catalogued burial site
(i) “Whitefish Dunes Burial” at 4930 South Cave Point Drive and (ii)
“Elste Burial” at 4339 Glidden Drive. The Burial Sites Preservation
law prohibits catalogued burial sites from being disturbed without the
proper permit.
9) Door County Humane Society – Thank you for past donations and
request for 2008 donation, including 2007 intake breakdown by
municipality and donations.
10) Door County Highway Department – applications for Local Roads
Improvement Program (LRIP) will be received until October 31st.
11) Wisconsin Department of Revenue – Net new construction 2006-2007
by municipality. Town of Sevastopol net new construction was
$11,079,400.
12) Wisconsin Department of Revenue – $46,637 balance of shared
revenue to be paid on November 19, 2007.
13) Charter Communications – $8,143.37 franchise fee remittance for
period January 1 through June 30, 2007.
14) Door County Board – notice that County of Door will participate
in LUCA (Local Update of Census Addresses) and report on behalf of all
municipalities.
15) WE Energies – safety reminder “Call Before You Dig” – simply call
811 at least 3 days before you dig, blast, bore, trench or excavate.
16) Wisconsin Department of Administration – final estimate of
January 1, 2007 population – 2,862, with approximately 2,258 of voting
age (over age 18).
17) Notification of Relinquishments – Joseph and Amy Stitch/County
P.
18) WTA – November educational seminars/workshop reminder.
