BOARD OF SUPERVISORS'MEETING MINUTES
Monday, May 21, 2007 - Meeting Room, Modular Building at Sevastopol

Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m. 

Pledge of Allegiance:  Chairman asked all to rise and join in the
Pledge of Allegiance.

Establish Quorum/Roll Call:
Roll call was taken.  Chairman Leo Zipperer, Supervisors Chuck Tice,
Dan Woelfel, Tom Girman and John Staveness, along with Clerk/Treasurer
Linda Wait were in attendance.

Also In Attendance:
Laddie Chapman, Charles Jarman, Bob Stracka, Dick Shappell, Richard
Virlee, Pat Miller, Chris Olson, Laddie Chapman, John Hippensteel and
Guy Fortin.

Meet the Deputy Program of the Door County Sheriff's Department:
 None available.

Citizen Concerns:  None.

Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed.   Motion by
Staveness and seconded by Tice to adopt the agenda, as proposed. 
Motion carried, unanimously.

Correspondence:
1)  Door County Planning Department-updated pages of Door County
Zoning Ordinance, Resource Planning Committee report and Zoning Text
Amendment eliminating the hypothetical lot rule.
2)  Community Wind Energy LLC of Door County-February 2007
newsletter.
3)  Door County Planning Department-Notice of Planning/Zoning Issues
public education/discussion meeting on May 30th at 7:00 p.m.,
Government Center
4)  Door County Highway Department-Spreadsheet with explanation as to
snowplowing for private driveways for the 2006-2007 winter season.

2006.

on improving generation and transmission process with
American Transmission Company (ATC).
	Chairman Zipperer also shared with those present a note received from
Dick Shappell, who offered his thanks to "the Chairman, Supervisors
and Clerk for a well-run Board and for doing their homework; it is
unfortunate that more people don't attend our meetings to see the
Board in action.  I've been attending meetings for 26 years and this
is the best ever!" 
	By consensus, all correspondence was accepted and will be placed on
file, without any item being referred to a specific committee for
further review or action. 

Special Report 7:15 p.m. Community Wind Energy of Door County,
LLC¨CWind Turbines.
	John Hippensteel, Guy Fortin and Chris Olson were present to provide
an update on 'Community Wind Energy LLC of Door County" (CWE).  CWE
was created through the efforts of the Door County Environmental
Council to promote the idea of clean and renewable wind energy.    CWE
is working with the County to establish guidelines and local control
for the wind turbines, although there are height restrictions imposed
by the County and the FAA, which take away from the effectiveness of
wind turbines.  There are three meteorological towers (MET) installed
and in operation to collect estimates of wind energy production and
assist with a feasibility study.   The cost of one turbine is
approximately $2.5-$3 million, would serve 200 to 300 households, with
typical payback in 10 years.   The turbines in Kewaunee County are
owned by WPS and Madison Gas & Electric.   CWE's goal is to help
people understand the technology of wind energy.

New Business:
2)  Application for Alcohol Beverage License (Class A Liquor/Malt). 
Roadside Market, LLC, located at 3887 Old Highway Road (former Wiegand
property), has applied for a Class A Liquor/Malt (to be consumed away
from premises) alcohol beverage license for the period May 22, 2007 to
June 30, 2007.  Robert Lautenbach, owner, and Cheryl Pichette, agent,
were present to provide information and answer questions.  The
business would be similar to the Lautenbach farm market in Fish Creek,
including a wine tasting bar.  Charlie Jarman complimented the owners
on making use of an existing building.  Following discussion, motion
by Woelfel and seconded by Girman to approve the application for a
Class A liquor/malt alcohol beverage license for the above-mentioned
period.  Motion carried, unanimously.

Minutes:
Motion by Staveness and seconded by Girman to approve the Special
Board of Supervisors' meeting minutes of April 11, 2007.
Motion carried, unanimously.
Motion by Woelfel and seconded by Staveness to approve the Board of
Supervisors' meeting minutes of April 16, 2007.  Motion
carried, unanimously.
Motion by Girman and seconded by Tice to approve the Road Inspection
minutes of May 4, 2007.  Motion carried, unanimously.

Clerk/Treasurer Monthly Reports:
Motion by Tice and seconded by Woelfel to accept the treasurer's
report for the month of April 2007, which includes
transaction/register detail, budget vs. actual, vouchers, bills and
claims.  Motion carried, unanimously.
 

Oral Committee Reports:  
Tom Girman, Chair of the PEG-Cable Channel Committee, commented on a
few changes to the proposed "Video Competition" Senate and Assembly
bills, which will soften the verbiage as to its affect on
municipalities, but there are still issues that would have a negative
impact.

Committee Minutes:   
Motion by Staveness and seconded by Girman to accept the following
committee minutes and place on file:
Comprehensive Plan Committee minutes of March 22, 2007 and April 19,
2007; 
Dam, Park & Rec Board minutes of February 15, 2007 and April 12, 2007;
and 
Building & Property Committee minutes of April 4, 2007 (with
correction, "Parmentier" to replace "Peletier").  Motion carried,
unanimously.

Pending Business:
1)  Comprehensive Plan.  Staveness urged everyone to attend the "Mid
Course Mapping Public Forum" meeting scheduled for Thursday, June 7th,
beginning at 6:30 p.m. at The Mill Supper Cub.  The Committee will
meet on May 24th at 6:15 to prepare for this important public
informational presentation by Omnni. Residents should receive a
postcard notice this week.
2)  Tourism Zone Commission Agreement and Tourism Entity Agreement. 
Tice reported that the agreement had been signed, sealed and
delivered.  Our Ordinance No. 2007-02 for the Collection of Tax on
Overnight Lodging has been adopted and published.  The Tourism Entity
Agreement has not been discussed at this point.  To date, over 600
letters have been sent out to various lodging establishments and 149
permits have been issued thus far.  Bonding and banking issues need to
be finalized.  The next meeting is scheduled for May 22nd at Baileys
Harbor.  All agenda, minutes, reports, calendars and studies will be
posted on the Village of Sister Bay site,
http://intranet.sisterbay.com.  It is anticipated we will be requested
to advance start-up funds for the Commission; we have not received a
billing as yet and would be reimburse once it is up and running.
3)  Town Line Road.  Zipperer indicated that the site was reviewed on
the recent road inspection tour and no action will be taken.
4)  Amendment to "Town and Private Road Standards" Ordinance. Zipperer
contacted Sturgeon Bay Fire Chief Tim Herlache and W.P.S., and both
indicated they would like to maintain at least a 20-foot wide
horizontal and a 26-foot wide vertical clearance area on private
driveways.  Our current ordinance calls for a minimum width clearance
of 24-foot and Zipperer would not be in favor of changing that.  As to
culvert and drainage for driveways running up hill from the road, Tice
had suggested that upgrade should be at least 33 feet from the center
of the roadway, with a 2% to 3% downgrade or crown, so that water runs
off the driveway and not onto the road.  The matter will be tabled to
next month. 
5)  Phosphate consciousness.   The matter will be discussed under
"Resolutions."
6)  Building fund.  The matter will be discussed under "Resolutions."

New Business:
1)  Road Work 2007.  As a result of the May 4, 2007 road inspection
meeting of the Board, Zipperer presented a memo (attached hereto),
which identifies roads as in need, on hold 2008, other maintenance &
repair authorized, and additional roads inspected w/o recommendation. 
Our 2007 budget includes $250,000 for road construction.  Motion by
Woelfel and seconded by Girman to advertise for bid the roadwork as
determined by the Chairman, via publication and request for proposal
(RFP), to be submitted no later than 5:00 p.m., June 18, 2007.  Motion
carried, unanimously.


3)  Wisconsin Department of Revenue-invoice for services.  The
Wisconsin Department of Revenue has submitted a statement in the
amount of $300 relating to the Steiner appeal from the 2006 Board of
Review's decision.  Wis. Stats., Sec. 70.85(8), states that, "if the
department of revenue changes the property assessment, costs related
to the department's determination that the assessment of that property
should be changed, but not more than $300, shall be paid by the
taxations district."  Motion by Staveness and seconded by Tice to
approve payment of $300 to the Wisconsin Department of Revenue. 
Motion carried, unanimously.  
4)  State/Municipal Agreement for STH 57 project.  This project was
previously explained by Dan Segerstrom, project manager from the
Wisconsin Department of Transportation, for a portion of STH 57
scheduled for remodeling and reconditioning from the Mill north to
approximately 800 feet past the intersection of CTH P during the 2009
season.  They are asking the Town contribute $4,883 for parking lanes
in Institute.  Following discussion, motion by Woelfel and seconded by
Tice to table pending a response from the DOT Green Bay District
Office on our previous request for credit on fence repair at the Town
Park due to storm and tree damage.  Motion carried, unanimously.

Resolution:
Resolution No. 2007-08 Committee Appointments.  The Resolution was
previously approved on April 16, 2007, with clarification now as to
members.
Resolution No. 2007-10 2006 Budget "Allocation/Use" Building Fund. 
Following discussion, motion by Woelfel and seconded by Tice to adopt
Resolution No. 2007-10 that $50,000 of the unused appropriated funds
from the Public Works category, as budgeted for 2006, shall be
designated to the expense category of Capital Outlay, specifically,
the Town Hall Building Fund.  Motion carried, unanimously.
Resolution No. 2007-11 "Phosphate"  The proposed "Resolution
Supporting Ban/Reduction on Sale and Use of Lawn Fertilizers and
Dishwasher Detergents that Contain Phosphorus" was jointly submitted
by Pat Miller, Charles Jarman and Bob Stracka. Following discussion
and input, motion by Girman and seconded by Staveness to table the
matter to next month, with some minor revision to the draft language. 
Motion carried, unanimously.
