BOARD OF SUPERVISORS' MEETING MINUTES
Monday, February 19, 2007 - Meeting Room, Modular Building at
Sevastopol Schools

Call to Order:
Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m.
Pledge of Allegiance: Chairman asked all to rise and join in the
Pledge of Allegiance.
Establish Quorum/Roll Call:
Roll call was taken. Chairman Leo Zipperer, Supervisors Chuck Tice,
Dan Woelfel and John Staveness, along with Clerk/Treasurer Linda Wait
were in attendance. Supervisor Tom Girman was excused.
Also In Attendance:
Betty Kiehnau, Pat Miller, Laddie Chapman, Bob Stracka, Gary Steiner,
Jim Downey and Bob Graef.
Meet the Deputy Program of the Door County Sheriff's Department:
None.
Citizens Concerns:
Pat Miller was happy to see that the "moratorium" is in place and
wondered what happens after one year, if the Comprehensive Plan is not
finished. Zipperer indicated that the matter would be discussed
later.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Tice and seconded by Staveness to adopt the agenda, as proposed, with
the correction that the Comprehensive Plan Committee will meet at 6:
15 on February 27th. Motion carried, unanimously.

New Business:
2) Planning & Zoning:
c) William and Stephanie Annicella Petition for Grant of Variance
(after-the-fact). Attorney James Downey appeared on behalf of the
petitioners and indicated that the Annicellas were pursuing an
after-the-fact variance from the highwater mark to retain a screen
porch which was already in place when the property was purchased by
them in 2005. Following discussion, motion by Tice and seconded by
Woelfel that a letter recommending approval of the petition for grant
of variance be forwarded to the Door County Board of Adjustment.
Motion carried, unanimously.
1) Gary & Sharon Steiner - Wisconsin Department of Revenue
(WDOR)/Property Tax Refund Claim. The WDOR issued an order dated
January 18, 2007 further reducing the value as initially determined by
the Board of Review on November 3, 2006. The WDOR determined that the
land portion be revalued and reassessed from $370,000 to $300,600,
with improvements to remain at $273,400, for a total assessment of
$574,000. Mr. Steiner then filed his claim to recover the overpayment
of real estate taxes, based upon the reduction in assessment.
Following discussion, motion by Woelfel and seconded by Staveness to
allow the claim in the amount of $623.39 (overpayment of $619.59 plus
statutory interest of $3.80). Motion carried, unanimously.
Correspondence:
1) Year-in-review and recap from Justin MacDonald/Sevastopol First
Responders.
2) James Lutzen letter addressed to Door County Treasurer indicating
first installment of real estate taxes paid under protest due to storm
water runoff and flooding problems at 4909 Ripp Road.
3) Glidden Drive Association, Inc., letter re: Wal-Mart Supercenter
Position and its agreement with recommendations of the Door Property
Owners, Inc.
4) Ann Hippensteel's thank you note to Chairman Zipperer for
attending the "Natural Step" presentation and commendation on recent
Town newsletter.
5) U.S. Representative Steve Kagen's letter of introduction and
request for input on urgent projects or problems and what local issues
the federal government should not be involved in.
6) City of Sturgeon Bay Fire Department-January 2007 Fire Report and
2006 Annual Fire Report.
7) Wisconsin DNR-payment in lieu of taxes (PILT) for property
acquired within the Town (Olde Stone Quarry Park, Whitefish Dunes
State Park).
8) Wisconsin Department of Administration-payment for municipal
services provided to state-owned facilities within the Town.
9) Wisconsin Department of Transportation (DOT) - notice of
database/application for Transportation Utility Management System
(TUMS).
10) Wisconsin Department of Revenue (DOR) - position on legality of
classifying vacant parcels as residential, for property assessment
purposes.
11) Northeast Asphalt, Inc. - invitation to seminar and notice of
Wisconsin Asphalt Pavement Association seminar.
12) Door County Humane Society-Winter 2007 quarterly newsletter.
13) Independent Inspections - notice of building permit
expiration/failure to complete final inspections and loss of bond (3
projects).
14) Door County Planning Department - Zoning permits issued January
2007.
15) Independent Inspections, Ltd. - billing recap for January 2007.
By consensus, all correspondence was accepted and will be placed on
file, without any item being referred to a specific committee for
further review or action.
Minutes:
Motion by Staveness and seconded by Tice to approve the Board of
Supervisors' meeting minutes of January 15, 2007. Motion carried,
unanimously.
Clerk/Treasurer Monthly Reports:
Motion by Woelfel and seconded by Staveness to accept the treasurer's
report for the month of January 2007, with the correction as to
year-to-date interest. Motion carried, unanimously.
Vouchers/Bills/Claims:
Motion by Staveness and seconded by Tice to approve the vouchers,
bills and claims submitted for the month of February 2007 and to
authorize the payment of invoices and vouchers for the month of March
2007 in the absence of a regular monthly meeting. Motion carried,
unanimously.
Oral Committee Reports:
Comprehensive Plan: Staveness reported that the next meeting is
scheduled for February 27th at 6:15 with Jeff Sanders from Omnni.
Chapter 4 was submitted and Jeff has requested payment for the
November and December invoices. There was discussion on the status
and remaining chapters of the plan. Motion by Staveness and seconded
by Tice to release the November 2006 payment ($3,005.25) and continue
holding the December 2006 payment ($4,276.20) until June 2007. Motion
carried (Zipperer, Staveness, Tice¨Caye; Woelfel-nay). Following
further discussion, motion by Woelfel and seconded by Zipperer that
all future payments shall be pro rata based on work completed, and as
work is completed and delivered to the Comprehensive Plan Committee,
payment shall be in a corresponding amount. Motion carried,
unanimously.
Committee Minutes:
The following committee minutes were accepted and placed on file:
Comprehensive Plan Committee minutes of December 13, 2006 and January
24, 2007; and
Dam, Park & Rec Board minutes of October 12, 2007 and January 17,
2007.
Pending Business:
1) Comprehensive Plan. (see above Oral Committee Reports)
2) Interim Control Ordinance (Moratorium). Zipperer and Tice gave
testimony before Resource Planning Committee on January 4, 2007 in
support of the request for an interim control ordinance (moratorium)
affecting the Town of Sevastopol. The ordinance was approved by the
Door County Board of Supervisors and became effective on January 23,
2007. A temporary moratorium is hereby imposed on zoning map
amendments for an initial period of one year, subject to a one-year
extension, but no longer than the completion of the comprehensive
plan.
3) Tourism Zone Commissioner Agreement and Tourism Entity Agreement.
Bob Graef, who has a rental cottage on Bay Shore Drive, indicated he
did not support the implementation of a room tax.
The Board indicated they would like additional information from Karen
Raymore/Door County Visitor Bureau as to the proposed budget.
Zipperer and Tice attended the Municipal Taxpayer Commission meeting
on February 2nd wherein the Room Tax Intergovernmental Agreement and
Ordinance were discussed. Attorney Randy Nesbitt will be reviewing
the drafts and providing his comments.
Zipperer stated the matter was here for discussion to see if the
Board wished to sponsor a resolution, as the Board previously
indicated its support of such a resolution at the December 18, 2006
Board meeting. Woelfel questioned whether small business owners were
fully informed and if there remains sufficient attractions for
tourism. In general, he was in favor of the resolution, felt it would
benefit the County and municipalities, and that we should move ahead
with it. Zipperer indicated the majority of his contacts seemed in
favor and many residuals come about as a result of tourism, but would
rather not have the municipalities used as a conduit. These comments
would be taken to the Room Tax meeting to be held on February 28th.
4) Municipal Taxpayers Commission. Zipperer stated that the original
focus began with NWTC, but has now blossomed to the room tax issue.
There was a previous indication that the remaining funds would be
refunded to the participating municipalities, but perhaps there may be
a need by the MTC to continue addressing issues.
5) Invitation to Room Tax Meeting. Charlie Most, Chairman, Door
County Board of Supervisors, issued an invitation to all municipal
officials to a meeting to discuss the Tourism Zone Intergovernmental
Agreement on February 28th at 4:00 pm in the General Meeting Room of
the Door County Government Center.
6) Town Hall Building. Woelfel, as Chair of the Building & Property
Committee, anticipates calling a meeting in the next 30-45 days to go
over the various options and viability--build, purchase or lease.
There may be grants available and plans could possibly coincide with a
Sesquicentennial celebration in 2009. It is hoped that people in the
community will come forward with their ideas.
7) Budget vs. Actual 2006. Woelfel had suggested that since road
construction was approximately $75,000 below budget for 2006, that
additional funds might be designated for the building fund. The
matter will be reviewed after the 2006 audit is complete.
8) Tax Refund Interception Program. The clerk will contact the
Wisconsin Department of Revenue to enroll in the Tax Refund
Interception Program (TRIP). The TRIP program allows interception of
taxpayer refunds for application toward qualified debts, including
personal property taxes and special assessments.
New Business:
1) See above.
2) Planning & Zoning:
a) The Door County Resource Planning Committee (RPC) petitions for a
zoning ordinance text amendment to allow for the establishment of a
second residence (single family, duplex or manufactured home) on lots
of sufficient width and area to accommodate the second residence, but
the property owner would be required to actually create and record the
two parcels. Under the current regulation, the property owner does
not have to actually create the two lots. Following discussion,
motion by Tice and seconded by Staveness that a letter recommending
approval of the zoning ordinance text amendment be forwarded to the
RPC. Motion carried, unanimously.
b) John Holmes, developer of a manufactured home park in Liberty
Grove, petitions for a zoning ordinance text amendment to increase the
allowance of additions up to 20% of the floor area attached to a
manufactured home. Following discussion, motion by Woelfel and
seconded by Staveness to forward a letter to the RPC recommending
denial of Mr. Holmes' petition. Motion carried, unanimously.

Ordinance:
Ordinance No. 2007-01 "Ordinance Regulating Alcohol Beverages and
Licensing."
On January 29, 2007, alcohol beverage license holders had been
invited to discuss the proposed ordinance. Recommendations from
Attorney Nesbitt have been incorporated and the ordinance is now in
final form. Motion by Woelfel and seconded by Staveness to approve
Ordinance No. 2007-01 "Ordinance Regulating Alcohol Beverages and
Licensing." Motion carried, unanimously.
Resolutions:
Resolution No. 01-2007 TB "Establishing a Tourism Zone and Tourism
Entity Agreement - Room Tax"
Motion by Tice and seconded by Woelfel to approve Resolution No.
01-2007 TB, participation in a Tourism Zone Agreement, Commission and
Tourism Entity Agreement. Motion carried unanimously.
Resolution No. 03-2007 TB "Alcohol Beverage License Fees"
Motion by Staveness and seconded by Woelfel to approve Resolution No.
03-2007 TB, to establish alcohol beverage license fees effective July
1, 2007. Motion carried, unanimously.
