BOARD OF SUPERVISORS' MEETING MINUTES
Monday, July 18, 2005 - Meeting Room, Modular Building at Sevastopol
Schools

Call to Order:
Chairman Leo Zipperer called the meeting to order at 7:00 p.m. and
welcomed those present. He also thanked the Clerk and helper Paul for
the more professional looking re-arrangement of the meeting room. The
Chairman also pointed out the new flag, stand and staff with plaque
which is posted and recites, "Flag, Staff and Holder donated in memory
of Supervisor Don Haen, 1998-2003, Town of Sevastopol.¨ Don was
respected as a trusted Town employee and Supervisor.
Chairman Zipperer also mentioned that if any of our local artists or
residents wished to donate or loan artworks for display, they should
contact the Clerk. Also, donations would be welcome to be used for
the purchase of a Wisconsin State Flag for display in the meeting
room.
Pledge of Allegiance: Chairman asked that all please rise to recite
the Pledge of Allegiance.
Establish Quorum/Roll Call:
Roll call was taken. Chairman Leo Zipperer, Supervisors Jo Ann
Schley, John Staveness, Dan Woelfel and Clerk/Treasurer Linda Wait
were in attendance. Supervisor Tom Girman was excused.
Door County Sheriff's Department - Deputy Report: None.
Citizen Concerns:
Charlie Jarman expressed his gratitude for the Sturgeon Bay Fire Truck
made available at the FFA breakfast held at Jarman Farms on Sunday,
July 3rd. It really added to the event and gave the kids an up-close
look at the fire truck. Charlie also mentioned that the newly
blacktopped Mathey Road was a welcome improvement, although it has
attracted some speeders.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the amended agenda was properly noticed.
Motion by Woelfel and seconded by Schley to adopt the agenda. Motion
carried.
Correspondence:
1) Notice from the Ridges News, that The Ridges Sanctuary, partnering
with the Clark Lake Advancement Association, had received a Lake
Management Grant from the Wisconsin DNR to conduct a 2-year study of
Clark Lake water quality. The results will be used to develop a
strategic plan for the Clark Lake watershed.
2) Notice of Door County Zoning Text Amendment regarding exception
from setback requirements for pad-mounted public utility
installations.
3) Door County Board of Adjustment Decision granting the petition for
grant of variance submitted by Thomas and Ruth Hansen, 5433 Bay Shore
Drive, for construction of 2-story addition onto a residence.
4) Apology letter from juvenile involved in the theft of a traffic
sign. The juvenile was also ordered to make restitute of $75 to the
Town for replacement of the sign, along with 10 hours of community
service.
5) Notice of approval of Fiscal Year 2006 Budget for Northeast
Wisconsin Technical College. The entire document (65 pages) can be
viewed at www.nwtc.edu or a hard copy requested by calling
800-422-6982.
6) A "thank you" and letter of appreciation from Independent
Inspections, Ltd. for our continued business.
7) From Wisconsin Towns Association, notice of summer workshops
covering topics such as ordinance development/enforcement, legislative
updates, livestock siting facilities and use of town law forms.
8) Email received from Town of Sturgeon Bay regarding Brilliant
Cities and potential cable franchise agreement. This matter will be
discussed at the August meeting.
9) Letter from Melissa Daron of Kewaunee offering assessment
services.
10) Notice of 23rd Annual Thresheree sponsored by the Northeastern
Wisconsin Antique Power Association. The event will be held on Friday
thru Sunday, August 19-21st on the Club Grounds at 5005 Country View
Road.
11) From the Town archives, circa 1930, regarding services to the
"poor or Town dependents."
12) Building permits issued by Door County for the period
6/3/05-6/21/05.
13) Independent Inspections, Ltd. Permits and Billing Recap for June
2005.
14) City of Sturgeon Bay Fire Department- Fire Report for June 2005.
There were 9 calls resulting in total staff of 72 and total staff
hours of 140.69; total inspections 41 and total violations 22.
Motion by Schley and seconded by Staveness that the correspondence be
accepted and placed on file, without referral to a specific committee
for further review or action. Motion carried.
Minutes:
Motion by Staveness and seconded by Woelfel to approve the minutes of
the June 20, 2005 Board of Supervisors' meeting, with attachment
(alcohol beverage licenses approvals). Motion carried.
Clerk/Treasurer Monthly Reports:
Motion by Staveness and seconded by Schley to accept the treasurer's
report for June 2005 and place on file. Motion carried.
Vouchers/Bills/Claims:
Motion by Woelfel and seconded by Schley to approve the vouchers,
bills and claims for the month of June 2005. Motion carried.
Oral Committee Reports: None.
Committee/Board Minutes:
The Dam, Park and Rec Committee minutes of June 8, 2005 were accepted
and placed on file. Chairman Zipperer also thanked Bob Stracka for
the educational pontoon boat tour of Clark Lake on the evening of July
13th.
Pending Business:
1) Municipal Taxpayer Commission. The minutes of the April 28, 2005
meeting were provided. Woelfel attended that meeting which included a
presentation by Lane Kendig, planning consultant. Topics included
affordable housing, aging population, labor force, zoning, tourism and
problems facing Door County. Woelfel also attended the June 23rd
meeting which resulted in a letter to Governor Doyle on the
ever-increasing levy of the Wisconsin Technical College System. This
matter will be discussed further under New Business, Item 3.
2) Road Work Authorization 2005. Zipperer reported that an
appreciable amount of road work had already been completed. The
crackfilling along West Shore and South Lake had recently been
completed. Areas already paved are: Country View from Whitefish Bay
to Clark Lake and from Clark Lake to Townline; Mathey from Whitefish
Bay to Clark Lake; Ploor between Dunn and Haberli; Whitefish Bay from
Glidden to Bark; Moeller Drive inside curve; Bark drainage and curves.
South Brauer is in the process of a complete pulverize and pave.
Culverts have been replaced on Erdmann, South Country View and South
Brauer. Projects on hold are Haberli and Whitefish Bay, pending
receipt of up-to-date billing. The Highway Department will attempt to
honor requests for top soil where needed.
3) Clark Lake Grant Study. Tom Cassidy, Board member of Clark Lake
Advancement Association, provided an update on the 2-year lake water
quality and watershed study. Samples are being collected and
monitored for quality and clarity. Bob Stracka indicated a complete
report will be made available at the end of the study.
4) Newsletter. Woelfel continues to receive suggestions for future
articles. While the initial newsletter focused on the Town Park,
subsequent issues could be more comprehensive and include such topics
as the burning ordinance, town officers and committees, comprehensive
planning, fire protection, cable channel and completion of the
concession stand. Frequency will depend on funds and your input is
welcome.
5) Long Range Capital Expenditures. Our auditor has suggested the
Town consider completing a formal long-range capital expenditure plan.
A draft outline of "Five Year Plan to Identify and Finance Future
Capital Outlay Proposals" includes such items as office equipment,
Town office/purchase of property, newsletter, park improvements (new,
Clark Lake and Whitefish Bay dock), comprehensive plan and fire
protection services. This item will be carried forward in future
meetings for input and discussion.
6) Door County Humane Society. In response to our June 22, 2005
request, we have now been provided with a listing of Board members and
By-laws. A copy of their Policies and Procedures had also been
requested, but was not received. Woelfel reported that although the
dog population is decreasing, the cat population is on the rise, with
many new kittens.
7) Roadway Use by Snowmobiles. Zipperer is waiting for a response
from Doug Jorns.
New Business:
1) Memo of Understanding (MOU) - Statewide Voter Registration System.
The County of Door authorized the County Clerk to enter into a
Memorandum of Understanding (MOU) with local municipalities to comply
with HAVA (Help America Vote Act) and SVRS (Statewide Voter
Registration System) standards. The County Clerk's office will accept
responsibility and costs associated with those guidelines and requests
that the MOU be approved, accepted and signed by each participating
Town or Village. Motion by Schley and seconded by Woelfel that the
Clerk be authorized to enter into a MOU between the Town of Sevastopol
and County of Door for this purpose. Motion carried. The Resolution
will be brought back in August for formal adoption.
2) Bay Shore Property Owners Association. Mike Standish, President,
sent a thank you letter for the Board's interest and attention in his
June presentation regarding water quality testing along Bay Shore
Drive and their concern in preserving water quality. Mike also
enclosed a humorous article entitled, "Mailbox Mayhem."
3) NWTC. On Thursday, July 14, 2005, Governor Doyle was provided
with a letter signed by members of the Municipal Taxpayer Commission,
requesting him to follow through on his pledge and rein in the
property tax levied by the Wisconsin Technical College System. The
Towns of Baileys Harbor, Gibraltar, Liberty Grove and Sevastopol and
the Villages of Egg Harbor, Ephraim and Sister Bay said, "we will
continue to work with you and the legislature to reduce WTCS's impact
on property taxpayers, but are left with just one option if you veto
the levy controls. The option we have discussed is to withhold our
municipality's first 2006 property tax settlement for NWTC." The NWTC
levy to the Town of Sevastopol for 2004 was $846,865. Woelfel
reported that this letter was the result of an enthusiastic meeting on
June 23rd; however, the 2.6% spending cap could be circumvented by
borrowing. The matter will be brought back at the August meeting with
updated information on withholding the first quarter 2006 payment,
which is up to the Board.
Announcements:
Zipperer passed along to Jo Ann Schley, as Chairman of the
Comprehensive Plan Committee, a letter of support received from the
Door County Property Owners for continuation of the Smart Growth
plan.
Charter Communications will be placed on the agenda for next month.
Comprehensive Plan Committee meeting - Wednesday, July 20th at 6:00
p.m.
Fire/Rescue Services Committee meeting - Friday, July 29th at 5:30
p.m.
Open Book - Friday, August 5th - 10:00 a.m. to 12:00 noon. An
appointment is not required, but would be helpful.
23rd Annual Thresheree at 5005 Country View Road, August 19th-21st
United Way Fund-Raiser Event at Town Park, Saturday, August 20th
Board of Review - Monday, August 22nd - 3:00 p.m. to 5:00 p.m.
Board of Supervisors' meeting - Monday, August 22nd - 7:00 p.m.
The Door County Planning Department will be scheduling a public
hearing on the application of Thomas and Ruth Hansen for a conditional
use permit to construct a non-conforming use multiple occupancy for a
second story. The matter will be placed on the August agenda.
We now have an official gavel, and Chairman Zipperer proceeded with
this narrative provided by Carl Scholz:
Talking Gavel--A versatile and indispensable aid to conducting
meetings and orderly discussions;
a gavel made of the Lady of the Woods (white birch)
and red osier dogwood (identified by its bark).
This is an adaptation of a Native American tradition
in which only the person holding the talking feather may speak.
A gavel, however, is more effective as a "silencer"

Pending approval by the PEG-Cable Channel Committee, Emilie Sawyer,
student at Sevastopol High School, will be the "go to/agenda
announcer/previewer" contact person.
Issuance of all burning permits are on hold until further notice.
The Whitefish Bay launch has been dredged but, unfortunately, has
already drifted back in.
Reminder--there is a STOP sign at the junction of South Cave Point
Drive with Whitefish Bay--please pay attention.
There was a complaint that Clark Lake Beach is being overrun with
dogs. Our Town ordinance does not provide for dogs in the parks.
Since dogs cannot read, dog owners, please be aware that dogs are not
welcome at the beach.
Schley asked for a follow-up on the placement of road signs.
