BOARD OF SUPERVISORS' MEETING MINUTES
Monday, February 21, 2005

Call to Order:
Chairman Leo Zipperer called the meeting to order at 7:00 p.m. 

Establish Quorum/Roll Call:
Roll call was taken.  Chairman Leo Zipperer, Supervisors Tom Girman,
Jo Ann Schley, John Staveness, Dan Woelfel and Clerk/Treasurer Linda
Wait were in attendance.

Door County Sheriff's Department-Deputy Report:  None.

Citizen Concerns:   
Bob Stracka thanked the Board for implementing the Clark Lake Advisory
Council.  The Clark Lake Advancement Association, in conjunction with
other organizations, is applying for a grant to do a two-year study.
Bob also urged the Board to go forward with a Smart Growth plan. 
Chairman Zipperer responded that these matters would be discussed
later, as indicated on the agenda.

Carl Scholz also expressed his thanks regarding the Clark Lake study
and the Board's support of the project.  

Charles Jarman felt that the concerns expressed by Board members and
others at the recent public hearings on Mining Reclamation Plans did
some good to require additional safety provisions in those plans. 
Charlie also urged caution in proceeding on a Town hall/office
building at this point.  Woelfel said the focus now was to avoid
additional investment and to make best use of the land we currently
own.

Pat Miller expressed concern for groundwater in light of the recent
reclamation plans which were submitted.

Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed.   Motion by
Schley and seconded by Girman to adopt the agenda.  Motion carried.

Correspondence:
1)  From the Door County Planning Department, updated pages of the
Door County Zoning Ordinance related to multiple occupancy
developments (MODs).
2)  Notice of public hearing before the Door County Resource Planning
Committee regarding petition to amend the Door County Land Division
Ordinance as to lot depth, width and lines.
3)  Sturgeon Bay Utilities-notice regarding access to property in
order to respond to emergencies.  It is recommended that driveways be
maintained to 20' wide and vertical clearance of 13'6".
4)  Bay-Lake Regional Planning Commission newsletter for
February/March 2005.
5)  Notice from Charter Communications of increase to broadcast basic
service and decrease to expanded basic service.
6)  From the Wisconsin Department of Natural Resources, notice of
assisted lands grant to The Nature Conservancy.
7)  Door County Planning Department - Construction permits for January
2005.
8)  Independent Inspections, Ltd.-Building recaps for January 2005.
By consensus, all correspondence was accepted and will be placed on
file, without any item being referred to a specific committee for
further review or action.  

Minutes:
Motion by Staveness and seconded by Woelfel to approve the minutes of
the January 18, 2005  Board of Supervisors' meeting.  Motion carried.


Clerk/Treasurer Monthly Reports:
Motion by Schley and seconded by Woelfel to accept the treasurer's
report for January 2005 and place on file.  Motion carried.  There was
also a brief discussion on 2004 actual versus budget figures and
carrying forward to the following year those unused amounts.  We also
received a "thank you" letter from the Door County Soil & Water
Conservation Department for our recent donation of $1,000 to assist in
the beach contamination source identification project.

Vouchers/Bills/Claims:
Motion by Woelfel and seconded by Staveness to approve the vouchers,
bills and claims for the month of January 2005.  Motion carried.

Oral Committee Reports:  
On behalf of the Dam, Park and Rec Committee, Woelfel provided the
finalized Park Pavilion guidelines and reservation form.  

Committee/Board Minutes:  
The Dam, Park and Rec Committee minutes of January 10, 2005; the
Planning and Zoning Committee minutes of January 19, 2005; and the
Cable Advisory Committee minutes of October 13, 2004 were accepted and
placed on file.

Pending Business:
1)  Sturgeon Bay Fire Department. The January Fire Report was received
and reviewed.  There were 7 calls in January 2005.  Also included was
a copy of the 2004 Annual Fire Report for the Town of Sevastopol.
2)  Smart Growth.  Schley reported that after discussions with Rob
Burke, UW-Extension Coordinator, it was the consensus of the Planning
and Zoning Committee to seek guidance from the Board.  It was the
Committee's opinion that we should move forward with a Smart Growth ad
hoc committee.  There was some discussion on the previous Ad Hoc Land
Use Committee Report in 2000 and what our new guidelines and
expectations should be.  Motion by Woelfel and seconded by Schley to
establish an ad hoc group to address and create a comprehensive plan,
referring to the previous report and updating as appropriate.  Motion
carried.  Jim Bunning will check with the Bay Shore group and the
matter will be brought up at the Annual Meeting to be held on Arpil
12th, with appointments to be made at the next regular Board meeting
on April 18th.  Anyone interested should call any of the Board
members.
3)  Door County Soil & Water Conservation Department (SWCD):
Nonmetallic Mining Reclamation-NEA/PCI.  In response to SWCD review
and concerns expressed at the public hearing held on January 17, 2005,
the SWCD will require additional provisions to the submitted
Reclamation Plan of Northeast Asphalt, Inc. (quarry on Mathey Road). 
The additional provisions relate to discharge permit compliance,
groundwater monitoring, surface runoff, location and extent of area
affected, setbacks, post-mining development, rock outcrops,
revegetation plan and the plan narrative.  Zipperer, Schley and
several residents also attended the February 14th public informational
hearing regarding Premier Concrete, Inc. nonmetallic mining
reclamation plan for the existing quarry located on Walker Road.
4)  Municipal Taxpayer Commission.  Minutes of December 16, 2004 were
received and Zipperer and Woelfel attended the recent meeting held on
February 17th.  Zipperer advised that the Stenger contract was renewed
for another 60/90 day term.  The most recent "Municipal Taxpayer
Commission Report" was distributed to Board members.  Woelfel is
supportive of the group's efforts to convey our concerns.  The matter
will be carried forward as a future item.
5)  PEG Channel.  Girman reported that the Agreement for Services with
Soik Communications and the Letter of Understanding with the City of
Sturgeon Bay are now in place.  The Town's broadcast equipment has
been moved to the City's broadcast facility and Channel 19 is up and
running. Girman provided a sample schedule and advised that they are
looking at some new programming.  Thanks to Arlene Woelfel and Tom
Soik for your help in making this a smooth move!
6)  Town Hall/Office.  Woelfel said the triangular portion of the Town
Park, at the corner of Hwy 57 and Ripp Road, is currently zoned "SF20"
(single family) and suggested we pursue a petition for change in
zoning to make the entire park property "mixed commercial." The matter
will be carried forward as a continuing item. 
7)  Building Permits-Enforcement and Fee Schedule.  Zipperer will
follow up on those people who are out of compliance and plans to meet
with Brett Guillette, our inspector from II Ltd., to review the
problems.
8)  Newsletter Update.  Woelfel reported he is half-way to finalizing
articles and expects to stay within the timeframe of the first issue
going out in early April.  He also presented several samples of
letterhead and the consensus was to go with the two-color
barn/shoreline motif.  

New Business:
1) Revaluation (RFP) for Year 2006.  Following discussion, motion by
Schley and seconded by Girman to designate 5:00 p.m., Friday, May 6,
2005 as the deadline for receiving sealed proposals for a full
(complete) revaluation for Real and Personal Property for the Tax Year
2006, and to publish notice twice in the Door County Advocate.  Motion
carried. 
2)  Clark Lake Advancement Association- Study Plan.  The Clark Lake
Advancement Association, in partnership with The Ridges Sanctuary and
UW-Stevens Point, has prepared a study plan entitled "Water Quality
and Biotic Evaluation and Strategic Planning in the Clark Lake
Watershed."  In the Association's letter of February 7, 2005 addressed
to the Towns of Jacksonport and Sevastopol, they are asking the Towns
to consider submitting a letter of support for this study plan.   They
seek no financial assistance from either Town to perform the study. 
Bob Stracka, on behalf of the Association, also added that the lake
level would be a part of this study and funding would come through a
State grant and in-kind donations.  There will also be a separate fish
inventory performed by the Department of Natural Resources this
spring.  Following discussion, motion by Staveness and seconded by
Girman that we provide a letter addressed to the DNR in support of a
grant for the Clark Lake study plan, as proposed.  Motion carried.
3)  Road Agreement-Town of Jacksonport re: Town Line Road.  This
matter will be brought back in April.
4)  A draft of the "Statement of Capital Assets 2004" prepared in
compliance with GASB 34, was provided for informational purposes.
5)  Outdoor and Refuse Burning Ordinance.  A draft of the "Outdoor and
Refuse Burning Ordinance for the County of Door" was provided for
informational purposes.  Zipperer stated the matter would be presented
to the Door County Board of Supervisors this week.
6)  Charter Towns Bill.  WTA provided a redraft of the "Charter Towns
Bill" which relates to the creation and powers of charter towns. 
Zipperer explained that because we do not meet some of the criteria
required of a charter town, Sevastopol would not be eligible for
charter town status. 
7)  Legislative Day 2005.  Door County Legislative Day 2005 is
scheduled to take place May 4-5 in Madison.  Anyone with concerns,
issues or problems specific to Door County you feel the State would
help resolve should make their submission to Rob Burke, Community
Development Education at the Door County UW-Extension office. 
8)  Zoning Text Amendment-Hypothetical Lot Rule.  All zoned towns were
provided with a copy of an amendatory zoning ordinance recently passed
by the Door County Board of Supervisors which amends the Door County
Zoning Ordinance relating to one additional single-family residence or
duplex permitted provided minimum lot size, width and yard
requirements can be met for each structure.  Said ordinance will take
effect within 41 days after adoption unless a majority of zoned towns
have filed an objection.

Announcements: 
Spring Election-Tuesday, April 5th.   Polls open 8:00 a.m. to 8:00
p.m.
Annual Town Meeting-Tuesday, April 12th at 7:30 p.m.
Door County Unit WTA Meeting - Thursday, April 14th at 7:00 p.m.,
hosted by Forestville.
Board of Supervisors' Meeting -March-- at the call of the Chair.
Board of Supervisors' Meeting - Monday, April 18th at 7:00 p.m.
