Call to Order:
Chairman Leo Zipperer called the meeting to order at 7:00 p.m.
Establish Quorum/Roll Call:
Roll call was taken. Chairman Leo Zipperer, Supervisors Jo Ann
Schley, John Staveness, Dan Woelfel and Clerk/Treasurer Linda Wait
were in attendance. Supervisor Tom Girman was excused.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Schley and seconded by Woelfel to adopt the agenda and amendment.
Motion carried.

Pending Business:
5) Clark Lake Advisory Council. Paul Schumacher, President of
Clark Lake Advancement Association (CLAA), thanked the Town for its
support and contribution toward the perch stocking project the past
four years. Paul was also appreciative of the quick response to high
and low lake levels to remove or replace the dam boards. However, he
said the members of the Association felt Sevastopol's Town Board
Resolution No. 08-2004 TB Clark Lake "Advisory Council" was redundant
and that the Association does not support the creation of an Advisory
Council and, as an alternative, would create two ad-hoc non-voting
Association board positions for representatives from both Jacksonport
and Sevastopol Town Boards.
Zipperer stated that the Town resolution came about following a
December 2003 Dam, Park & Rec Committee meeting at which Jacksonport
Board and Association members were present and after the annual
Association meeting in July 2004, the concept of a joint advisory
council evolved, with volunteer membership, to address concerns and
management of the lake. Schley also expressed concern that funds
contributed toward Clark Lake projects not be used for private
concerns.
Special Reports:
7:30 p.m. Bill Schuster, County Conservationist, and Vinni Chomeau,
Conservationist, of the Door County Soil & Water Conservation
Department (SWCD) gave a presentation on the 2004 preliminary beach
pollution source identification results. Bill thanked the Town for
its contribution of $500 in 2004. There is a need to know what is
causing elevated E.coli levels and support those efforts to abate the
sources. There were 28 beaches monitored, designated as high, medium
and low priority. The monitoring that was done at Clark Lake and
Whitefish Dunes State Park was explained in detail. Funds contributed
to the Door County beach pollution source identification work were
used to conduct surveys to determine relationships between physical
characteristics, E.coli levels, rainfall, proximity to stormwater
outlets, avian waste and Cladophora algae. Throughout the County,
overall numbers of advisories and closures has increased from 2003 to
2004. The SWCD has been awarded another grant from the Wisconsin
Coastal Management Program and is requesting additional financial
support from communities and municipalities to continue and complete
identification of the sources of contamination and what can be done to
alleviate or remediate the problems. An interim report is expected
in January 2005. A contribution of $1,000 for the year 2005 was
approved at the Budget/Special meeting on November 15, 2004.
Pending Business (4) and New Business (6):
Door County Soil & Water: Nonmetallic Mining Reclamation/Public
Notice. Bill Schuster also addressed the SWCD correspondence to
Premier Concrete Inc. (Walker Road site) and Northeast Asphalt, Inc.
(Mathey Road site) and the revised Nonmetallic Mining Reclamation
Plans submitted by each company in support of their required
reclamation permits. Notice of the reclamation plan submittals will
be published which provides an opportunity to request a public
information hearing. The permit application, reclamation plan and all
supporting materials may be viewed at the SWCD. Zipperer also
congratulated Bill on his recent appointment by the Governor to the
Wisconsin Coastal Management Program Council.
Citizen Concerns: None.
Correspondence:
1) Letter from Door County Soil & Water Conservation Department re:
Door County Beaches, Water Quality and Request for Contribution.
(This matter was discussed under Special Presentation, above.)
2) Notice of Timber Cutting-Diane Pasek on County P.
3) Notice from Wisconsin Department of Natural Resources of
acquisition of Nancy Hanson Revocable Living Trust parcel located near
Cave Point County Park, .43 acres.
4) Notice from James and Lucile Fox of request to Associated Appraisal
Consultants for adjustment to 2004 tax bill due to error in Certified
Survey Map.
5) Letter of thanks from Clark Lake Advancement Association for 2004
funding of yellow perch stocking in Clark Lake.
6) Letter/notice to Door County Highway Department that Sonya Jorns
will again be the contact person for winter road calls and private
snow removal agreements. Thanks, Sonya!
7) Notice from WTA Education Director Tom Harnisch of educational
seminars scheduled for December 2004. Agenda will include: Shared
Revenue/Municipal Road Aid Formula, State Aids and Revenue, Ordinance
Enactment and Enforcement and Town Law Forms.
8) Notice of Zoning Text Amendment to allow one accessory structure
in manufactured home parks.
9) Final Statement of Assessment for Year 2004 (reports the amounts
and assessed value of taxable general property and parcel counts).
10) Bay-Lake Regional Planning Commission Newsletter, which includes
announcement of Mark Walter as new Executive Director.
11) Door County Planning Department-Construction permits for October
2004.
12) Independent Inspections, Ltd. - Building recaps for October
2004.
13) Decision from Door County Board of Adjustment denying Petition
for Grant of Variance on setback from ordinary high water mark
submitted by Kenn A. Wiest.
All correspondence was accepted and will be placed on file, without
any item being referred to a specific committee for further review or
action.
Minutes:
Motion by Staveness and seconded by Schley to approve the minutes of
the October 25, 2004 Board of Supervisors' meeting. Motion carried.
Clerk/Treasurer Monthly Reports:
Motion by Schley and seconded by Woelfel to accept the treasurer's
report for October 2004 and place on file. Motion carried.
Vouchers/Bills/Claims:
Motion by Staveness and seconded by Woelfel to approve the vouchers,
bills and claims for the month of October 2004. Motion carried.
Oral Committee Reports:.
Fire/Rescue Services Committee: Zipperer reported for Fire & Rescue
Chairman Girman that the Town and Village of Egg Harbor Boards are
interested in continued discussions on providing fire protection
services for the Town of Sevastopol; the next meeting will be held
following the holidays.
Ad hoc Cable Committee: Zipperer reported for Cable Committee
Chairman Girman that a Letter of Understanding was entered into with
Tom Soik for the duplication services he will provide for events to be
used on the Town¡¦s Channel 19 Government Channel.
Committee/Board Minutes:
The Dam, Park and Rec Committee minutes of October 5, 2004, the
Planning & Zoning Committee minutes of October 21, 2004 were accepted
and placed on file.
Continued/Pending Business:
1) Sturgeon Bay Fire Department The October 2004 Fire Report was
received and there was a brief discussion on fire inspections.
2) Smart Growth. Charles Jarman's offer of assistance toward Smart
Growth activity was confirmed with correspondence. In response to a
follow-up inquiry to the Town of Sturgeon Bay and its Smart Growth
planning, Phyllis Utley provided an email update. They are proceeding
on their own and hope to complete a plan over the next 3-year period.
3) Door County Humane Society (DCHS). On October 25, 2004, the Board
moved to donate $1,000 to the DCHS, pending receipt of its Mission
Statement, By-laws, Budget and Policies & Procedures. To date, that
information has not been received. Following discussion, motion by
Woelfel to reconsider the prior action taken by the Board. Seconded
by Zipperer for purposes of discussion. Motion carried. After
further discussion, motion by Woelfel to eliminate the previous
requirement that the Door County Humane Society provide a listing of
its Board of Directors and disburse the funds. Seconded by Zipperer.
Motion defeated by a vote of: aye-1; nay-3.
New Business:
1) Tax Levy Certifications and Reports from State and County, School
Districts of Sturgeon Bay and Sevastopol and Northeast Wisconsin
Technical College for the tax year 2004 were received and compared
with prior year figures. The Wisconsin Department of Revenue also
forwarded its notice of School Levy Credits and State Aids for 2004.
The Clerk has submitted this information, via the mil rate worksheet,
to the Door County Tax Listing office for compilation and printing of
the real estate tax statements.
2) 2004 Town Officer Salary Survey. WTA completed a survey of Town
officer salaries and compiled the responses of over 1,045 towns. The
survey reports the average for each population group, with highs and
lows. No action taken on any adjustments at this time.
3) Assessed Value/Statutory Mandate: Wisconsin Department of Revenue
rules require that the assessed value of each major class of property
must be within 10% of full value of the same major class of property
at least once during the 4-year period consisting of the current year
and the three previous years and review of the percentages for the
years 2001 through 2004 indicate that the statute has not been met and
for the year 2004 that value dropped to 72.99%. Following discussion,
motion by Schley and seconded by Staveness to advertise for a Request
for Proposal (RFP) for a full revaluation for the year 2006. Motion
carried. Criteria for such an RFP will be determined and noticed.
4) Cable Franchise Fee Use. Zipperer read portions of Attorney
Nesbitt¡¦s letter of November 22, 2004 regarding the use of cable
franchise fees. In summary, it the Town is able to support and
develop access channels at a funding level less than the amount
received as franchise fees, it would be entirely appropriate to direct
the remaining balance of franchise fees to the general fund.
5) Newsletter. Woelfel suggested an initial "Town Park" newsletter
and, if the response was favorable, incorporate it into a "Town"
newsletter. He estimates printing and mailing costs to be in the
$1,500-$1,600 range with potentially two issues per year, consisting
of 6-8 pages with photos. Following discussion, motion by Schley and
seconded by Woelfel to create a Town Park newsletter. Motion
carried.
Ordinances: None.
Resolutions:
Resolution No. 09-2004 Adopt Emergency Management Plan. Motion by
Schley and seconded by Staveness to approved Resolution No. 09-2004.
Motion carried.
Resolution No. 10-2004 Appointment of Election Officials 2005-2006.
Motion by Schley and seconded by Woelfel to approve Resolution No.
10-2004. Motion carried.
Resolution No. 11-2004 Establish Tax Rate 2004. Motion by Staveness
and seconded by Zipperer to establish the tax (mil) rate of $1.22 for
the year 2004. Motion carried.
Announcements:
Next Board of Supervisors' meeting will be held on Monday, December
20, 2004 - 7 pm.
