BOARD OF SUPERVISORS' MEETING MINUTES
Monday, June 21, 2004
Town Meeting Room behind Sevastopol Schools

Call to Order:
Chairman Leo Zipperer called the meeting to order at 7:00 p.m. 

Establish Quorum/Roll Call:
Roll call was taken.  Chairman Leo Zipperer, Supervisors Tom Girman,
Jo Ann Schley, John Staveness, Dan Woelfel and Clerk/Treasurer Linda
Wait were in attendance. 

Citizen Concerns:   
Bob Stracka expressed his thanks for the work done at the Clark Lake
boat ramp/launch.

Pat Miller asked about an ordinance for voter registration and if the
matter could be placed on an upcoming agenda for discussion.  Zipperer
responded that an ordinance requiring voter registration had already
been adopted in 1976, but Pat could submit her request in writing for
any additional considerations.

Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed.  Motion by
Woelfel and seconded by Girman to adopt the agenda.  Motion carried.

Correspondence:
1)  Door County Town Chairpersons received a copy of the 2003 Annual
Report for the Door County Department of Community Programs.  The
complete report will be on file if anyone wishes to review it.
2)  A letter of thanks (addressed to both Jacksonport and Sevastopol)
was received from the Clark Lake Advancement Association for the work
done at the Clark Lake boat ramp.  Also included was an invitation to
Board members to attend their annual meeting on July 3 to be held at
the Jacksonport town hall and picnic on July 24 at Jacksonport
Lakeshore Park.
3)  Notice from Northeast Wisconsin Technical College that the Fiscal
Year 2005 budget has been approved.  The budget document can be viewed
online or copy requested by mail.
4)  Emergency Management of Door County forwarded information and
application regarding the First Responder Equipment Grant
availability.  Staveness commented that this grant is more suited
toward fire departments and would not be applicable to our First
Responder group.
5)  Wisconsin Department of Natural Resources forwarded $502.88 for
yield tax payments under the Managed Forest Law from Baudhuin and Flok
parcels.
6)  Notice from DNR of appraisal on Geudtner property in Shivering
Sands Natural Area.  This property (190 acres of vacant land with a
2003 assessment of $33,600) is being purchased by the DNR under the
Knowles Nelson Stewardship Program. The appraisal has been forwarded
to our local assessor, Associated Appraisal.
7)  From the Wisconsin Department of Revenue, notice of personal
property assessments for 2004.  
8) Charter Communications is attempting to raise awareness about cable
signal theft and its impact on business and community. They estimated
that about 15% of customers are receiving some or all of their cable
services without paying.
9)  Charter Communications will be introducing the CableCARD as an
option to customers beginning July 1.  This arrangement will allow
customers to have new choices in receiving cable services.  Charter
will also add FUEL on Channel 410--programming for the action sports
culture.
10)  Notice from Wisconsin Department of Revenue that Premier Concrete
Inc. has relocated its personal property to another municipality.
11)  Wisconsin Towns Association article highlighting change in
standards to be applied in area variance requests.  The new standard
puts greater discretion and flexibility in the hands of Boards of
Adjustment.
12)  Forest Tax & Stewardship News for spring/summer 2004.
Motion by Staveness and seconded by Woelfel to accept the
correspondence and place on file, without any item being referred to a
specific committee.  Motion carried.

Minutes:
Motion by Woelfel and seconded by Staveness to approve the minutes of
the May 17, 2004 regular meeting of the Board of Supervisors' meeting.
 Motion carried.
Motion by Girman and seconded by Staveness to approved the minutes of
the May 21, 2004 Road Inspection Tour.  Motion carried.

Clerk/Treasurer Monthly Reports:
The treasurer's report for May 2004 was accepted and will be placed on
file.  

Vouchers/Bills/Claims:
Motion by Schley and seconded by Woelfel to approve the vouchers,
bills and claims for the month of May, 2004.  Motion carried.

Oral Committee Reports:.
Girman has scheduled the next meeting of the Fire/Rescue Services
Committee for Thursday, July 15, 2004 beginning at 6:30 p.m. to be
held in the Town meeting room.

Deputy Lauder of the Door County Sheriff's Department arrived at 7:19
pm.   If we are interested in establishing a Neighborhood Watch
program, contact Sargeant Jim Grondon at 746-2254.  Zipperer mentioned
some concerns on the 45 mph speed limit from Culvers west to County HH
and requested additional patrol to that area.  Deputy Lauder also
reminded that 911 is the number to call for emergencies and that 311
was more for law enforcement use.  

Committee/Board Minutes:  
Motion by Schley and seconded by Woelfel to accept and place on file
the May 5, 2004 minutes of the Sevastopol Dam, Park and Rec Committee
and the May 17, 2004 minutes of the Sevastopol Planning and Zoning
Committee.  Motion carried.

 Continued/Pending Business:
1)  Sturgeon Bay Fire Department. The May 2004 monthly report was
received.
2)  Municipal Taxpayer Commission. Acknowledged receipt of April 21,
2004 minutes and notice that Rep. Dean Kaufert will attend the next
meeting.  Zipperer did attend that meeting held on June 3rd in Egg
Harbor; however, nothing new to report.
3)  Property Maintenance.  Volunteers welcome.  The June report from
Wisconsin Towns Association included an article on "clean up" concerns
for towns and villages.  Among the items to be considered would be the
Town's authority to adopt and enforce "public nuisance" ordinances to
address local concerns.
4)  Boat launch/ramp-Townline at Clark Lake.  The concrete fingers
have been removed and a metal ramp has been installed, along with the
pier.  The launch at Whitefish Bay was also repaired, along with some
maintenance dredging.
5)  Open Meetings/Open Records Workshop.  Woelfel summarized the
recent open meeting/open meetings workshop held on June 3.  Attorney
General Peggy Lautenschlager was in attendance and Bruce Olsen,
Assistant Attorney General, conducted the session and covered a
variety of topics including walking quorum, email and  closed
sessions.
 
New Business:
1)   Door County Planning Department-Construction permits for May
2004.
2)   Independent Inspections, Ltd. - Building recaps for May 2004.
3)  Town Planning & Zoning Committee.   Schley reported that
amendments to the Door County Zoning Ordinance regulating
communications towers in zoned towns and a proposed Telecommunications
Tower Ordinance will be presented to the Door County Board of
Supervisors.  The Corey Zeddies petition to encroach into road setback
at 5446 West Shore Drive was denied by the Door County Board of
Adjustment.  Also, the Steve Laubenstein petition for rezoning of a
parcel at Hwy 42/57 and the Resource Planning Committee tabled Forest
Road until July 8, 2004 for further action.
4)  Applications for Alcohol Beverage License Renewals 2004-2005.  On
assurance of the Clerk that all applications were in order and fees
paid and following discussion, motion by Schley and seconded by
Staveness to approve renewal of the following liquor licenses, as
attached, for the period July 1, 2004-June 30, 2005.  Motion carried.
5)  Road Work 2004.  After discussion, the following road work
projects were authorized for 2004 (see attached list).  Motion by
Girman and seconded by Staveness to approve, with work to be performed
by the Door County Highway Department.  Motion carried.  
6)  Unexpected Supervisor Vacancy.  After discussion and review of
Woelfel's proposal, motion by Woelfel and seconded by Staveness to
amend Policies and Procedures to incorporate the following language: 
If an unexpected supervisor vacancy were to occur within 4 months of
an election, the next highest candidate on the ballot who obtained a
minimum of 30% of the vote for the position will be appointed to the
Board.  If the position were to occur after the 4-month period, the
position would be advertised to solicit individuals to be considered
and interviewed by the Board and selected by majority vote of those
eligible to participate.  Motion carried.

Resolutions:
A corrected version of the Committee Appointments attachment to
Resolution No. 04-2004TB was submitted, no action required.

Special Reports/Announcements: 
Mike Grimm was scheduled to give a presentation on the Habitat and
Natural Areas of Door County at 7:30 p.m.; however Mr. Grimm was not
in attendance.
The next Board of Supervisors' meeting will be held on Monday, July
19th, beginning at 7 pm.
Open Book will be held on Friday, August 6th, from 10 am to 12 noon.

Review of liquor license/ordinance
League of Women Voters regarding voter registration

Motion by Schley and seconded by Girman to adjourn.  Motion carried.
