BOARD OF SUPERVISORS' MEETING MINUTES
Monday, July 19, 2004
Town Meeting Room behind Sevastopol Schools

Call to Order:
Chairman Leo Zipperer called the meeting to order at 7:00 p.m.
Establish Quorum/Roll Call:
Roll call was taken. Chairman Leo Zipperer, Supervisors Tom Girman,
Jo Ann Schley, John Staveness, Dan Woelfel and Clerk/Treasurer Linda
Wait were in attendance.
Citizen Concerns:
Deputy Bob Lauder from the Door County Sheriff¡¦s Department stated
there would be some additional patrol to the Culver's/Gordon Road area
on the lookout for speeders. The Sheriff's Department is aware of the
recent damage to approximately 50 mailboxes in our neighborhood.
Deputy Lauder reminded citizens to feel free to call with any concerns
or questions.
Betty Parsons asked for clarification on the status of the Laubenstein
zoning request as reported in the June 21, 2004 minutes and Chairman
Zipperer responded that the matter is now before the Resource Planning
Committee.
Pat Miller received some additional information on voter registration
and Zipperer said the matter will be discussed under new business.
Bob Stracka would like to see the formation of a committee to deal
with Clark Lake issues and hopes that the Town of Jacksonport would
also be involved. Zipperer said an advisory committee was a
possibility; he and Chairman Al Birnschein of Jacksonport previously
agreed to do so.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Staveness and seconded by Schley to adopt the agenda. Motion
carried.
Correspondence:
1) Copy of correspondence from Door County Soil & Water Conservation
Department to Premier Concrete Inc. (Walker Road site) regarding its
revised Nonmetallic Mining Reclamation Plan submission and SWCD's
request for further description, clarification and additions.
2) Notice of appraisal obtained by the Wisconsin Department of
Natural Resources (DNR) for purchase of Estate of John Tschernitz
property for Whitefish Dunes State Park.
3) Notice of Timber Cutting (intent to harvest raw forest products)
Anthony Ripp.
4) Updates on changes to the Managed Forest Law administration from
DNR, including yield and withdrawal tax payments, MFL tax rates,
non-compliance penalty and withdrawal from designation for delinquent
personal property taxes.
5) Notice of payments made by DNR on lands entered under the Managed
Forest Law and Forest Crop Law.
6) Notice from Charter Communications of new channels coming in July
and programming line-up changes.
7) Notice of Investigation to consider approval of Wisconsin Public
Service's application for Affiliated Interest Agreement - American
Transmission Company LLC.
8) Bay-Lake Regional Planning Commission notice of Martin Holden's
retirement as Execution Director and new staff assignments.
9) From the Door County Planning Department, a
complimentary/informational copy of preliminary land division plat
(Gordon/Peterson Roads).
The correspondence was accepted and will be placed on file, without
any item being referred to a specific committee.
Minutes:
Motion by Schley and seconded by Woelfel to approve the minutes of the
June 21, 2004 Board of Supervisors' meeting. Motion carried.
Clerk/Treasurer Monthly Reports:
The treasurer's report for June 2004 was accepted and will be placed
on file.
Vouchers/Bills/Claims:
Motion by Girman and seconded by Staveness to approve the vouchers,
bills and claims for the month of June 2004. Motion carried.
Oral Committee Reports:.
Cable Committee: Girman reported that although we have recorders in
the City Council and County Board rooms, the remote operators do not
always turn on. We may have to incur additional costs to find an
alternative and may need to create our own DVDs.
The Fire/Rescue Services Committee met on July 15, 2004 to discuss
alternatives of providing fire protection. It is anticipated that
letters will be sent to the Egg Harbor Fire Department and Jacksonport
Fire Department for input on their departments.
Committee/Board Minutes: None.
Continued/Pending Business:
1) Sturgeon Bay Fire Department. The June 2004 monthly report was
received.
2) Municipal Taxpayer Commission. Zipperer reported that, with most
legislators not in session over the summer, there are no new
developments at this time.
3) Property Maintenance. Anyone interested in serving on a
"Property Maintenance Committee" should contact Chairman Zipperer or
the Clerk. "Junk" or "nuisance" ordinances from other townships and
the City of Sturgeon Bay could serve as references to address our
local concerns.
4) Boat launch/ramp - Townline at Clark Lake. It appears that over
the July 4th weekend, a heavy vehicle (motor home or truck with dual
wheels) broke through the mesh decking on the launch ramp, resulting
in a very large hole below water level. In order to repair the
damage, it was necessary to have the ramp lifted, welded and then set
back in place.
5) City of Sturgeon Bay -Compost and Yard Waste Facility. The City
was contacted some time ago about the possibility of our residents
depositing yard waste and leaves at the City compost site. In a
letter dated June 23, 2004, the City of Sturgeon Bay proposes allowing
unrestricted use of the site for town residents for a $5,000 annual
fee, to be revisited after one year. There will be no action taken at
this time.
New Business:
1) Door County Planning Department-Construction permits for June
2004.
2) Independent Inspections, Ltd. - Building recaps (including
inspections performed and expired permits) for June 2004.
3) Town Planning & Zoning Committee:
(a) Mike and Sharon Johnson petitioned for an after-the-fact
petition for grant of variance for an above-grade-constructed deck at
5381 West Shore Drive. Mr. Johnson completed the deck after a cease
and desist order had been issued by the Door County Planning
Department. An at-grade patio would have been an acceptable
structure. The Committee recommended denial of the request. There
was a brief statement from Mike Johnson, who was present, and some
discussion. Motion by Schley and seconded by Staveness to recommend
denial of the after-the fact petition for grant of variance. Motion
carried.
(b) Donald and Louise Klussendorf petitioned for a zoning
amendment-text change to add a new use known as "Assembly Halls" as a
conditional use in Estate Zoning District. There was no
recommendation made at this time.
4) Village Powers - Discussion. Special Meeting minutes of July 19,
1988 indicate the Town did authorize the Town Board to exercise
village powers and this could be clarified in resolution form. No
further action is required at this time.
5) Voter Registration Inquiry. The present voter registration
procedure was discussed. Deputies can be appointed to accept
registrations for the upcoming presidential election. With input from
instructors and the Clerk, Sevastopol High School students are made
aware of the registration procedure. The Statewide Voter Registration
System will be in place by 2006 and if we need to expand on
registration efforts, it will be certainly addressed.
6) DNR Proposed Launch - Discussion. The Board was provided with a
copy of the July 8, 2004 letter from Rich Kinka, President of the
Glidden Drive Association, Inc., addressed to George Pinney, Director
of the Door County Parks Department, in response to a proposed boat
launch at 4242 Glidden Drive. The Association passed a resolution
which "unanimously opposes construction of a public boat launch
facility anywhere on Glidden Drive." No Board action taken at this
time.
Resolutions:
06-2004TB - Committee Appointments 2004-2005. Upon advice of legal
counsel, the Ad-Hoc Cable Committee was expanded to 5 members, with
the addition of Arlene Woelfel and Paula Virlee. The Dam, Park &
Recreation Committee was expanded to include Cari Schartner. Terms to
expire April 2005. Motion by Schley and seconded by Girman to approve
Resolution
06-2004TB. Motion carried.
07-2004TB - Policy & Procedure Amendment. It was determined that an
amendment to the current Policy & Procedures was necessary to create
guidelines for an "Unexpected Supervisor Vacancy." Following
discussion, motion by Woelfel and seconded by Staveness to approve
Resolution 07-2004TB. Motion carried.
Special Reports/Announcements:
Zipperer reported on the status of the authorized road projects, which
were somewhat delay due to the Highway hot mix plant having been hit
by lightening.
There will be a meeting of the Door County Unit of Wisconsin Towns
Association on Thursday, August 5th beginning at 7 pm at Wave Pointe
Marina & Resort, with Town of Gardner as host.
The Open Book session will be held on Friday morning, August 6th,
from 10 am to 12 noon. A representative of Associated Appraisal
Consultants will be available to review recent notices of assessment
change.
The Board of Review will be held on Monday, August 23rd from 3-5 pm.
The next Board of Supervisors' meeting will be held on Monday evening,
August 23rd beginning at 7 pm.
