BOARD OF SUPERVISORS' MEETING MINUTES
Monday, August 23, 2004
Town Meeting Room behind Sevastopol Schools

Call to Order:
Chairman Leo Zipperer called the meeting to order at 7:00 p.m.
Establish Quorum/Roll Call:
Roll call was taken. Chairman Leo Zipperer, Supervisors Tom Girman,
Jo Ann Schley, John Staveness, Dan Woelfel and Clerk/Treasurer Linda
Wait were in attendance.
Citizen Concerns:
Sergeant Jon Koch from the Door County Sheriff's Department reminded
citizens to call with any questions or concerns in our area. He
stated that additional patrol to the Culver's/Gordon Road area
resulted in several stops for speeding violations. Sergeant Koch
advised that a recent traffic stop might have potential for solving
some mailbox vandalism. He also answered some questions regarding
bicyclists, motorcyclists, fireworks and passing.
Bob Stracka asked for an update on the formation of an advisory
council to deal with Clark Lake issues and Zipperer responded that he
and Chairman Al Birnschein of Jacksonport will be moving forward on
this shortly.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Schley and seconded by Girman to adopt the agenda. Motion carried.
Correspondence:
1) From the Wisconsin Department of Revenue, 2004 County Equalization
Report, including Apportionment, Assessment/Sales Ratio and Sales
Summary reports. Sevastopol has a 2004 equalized value of
$553,771,500, representing an increase of 5.68% from the 2003
equalization of $524,022,800.
2) From the Wisconsin Department of Administration, a preliminary
estate of January 1, 2004 population of 2,790 which represents a
change of 123 persons (4.612%) since the 2000 Census figure of 2,667.
3) From the Wisconsin Department of Administration, the 2004 issue of
Wisconsin Great Lakes Chronicle. The 2004 edition features articles
about coastal restoration, water quality, erosion, tourism and
recreation.
4) Complimentary pamphlet from the Niagara Escarpment Resource
Network, established in 1998 to promote appreciation of the Niagara
Escarpment "Ledge," a portion of which extends along the westerly side
of our Town.
5) Notice from Charter Communications adding new channels to Digital
Service and price increases on promotional packages.
6) From the Wisconsin Department of Natural Resource (DNR), notice of
acquisition of John L. Tschernitz property (within Whitefish Bay Dunes
State Park), .41 acres along Lake Michigan.
7) DNR notice of relinquishment from Farmland Preservation, Robert
and Diane Schartner, 80 acres.
8) DNR transfer order of Managed Forest Law designation from Clair
Glines to David and Theresa Leist, 17.84 closed acres.
9) Appraisal transmittal from DNR for Ethelyn Hanson property (within
Whitefish Bay Dunes State Park), .43 acres along Lake Michigan.
10) Door County Zoning Text Amendment limiting accessory structure
size in manufactured home park.
11) Approval from Door County for Sevastopol Zoning Map Amendment,
5.875 acres (Laubenstein property at Hwy 42/57 and Forest Road) from
Countryside (CS) to Commercial Center (CC).
12) Notice of Local Government Finances and Management workshops
sponsored by UW-Extension.
13) Congratulations to Jo Ann Schley who recently received
accreditation as Certified Information & Referral Specialist.
The correspondence was accepted and will be placed on file, without
any item being referred to a specific committee.

7:18 p.m. Special Report:
Karen Raymore, from the Door County Chamber of Commerce, requested a
contribution for the purpose of improving bicycle transportation in
Door County. The County has applied for a grant of $100,000, with
proposed improvements to be made over three years. The County Board
has agreed to match up to $10,000 and the Chamber's Trail Committee is
requesting each municipality impacted by the improvements to make a
contribution of $1,000 over a 3-year period¡ a commitment of $333 in
each fiscal year 2005, 2006 and 2007. Improvements would address sign
and rack needs, purchase and installation of route and distance signs
and publication of a "Back Road Bike Route Map." Following
discussion, motion by Schley and seconded by Girman to include in our
budget process a 3-year commitment, for a total of $1,000, for bicycle
transportation improvements. Motion carried.
7:30 p.m. Special Report:
Chief Tim Herlache, Sturgeon Bay Fire Department, gave an update on
the recent concerns with the issuance of burning permits and the
recent fires in the Glidden Drive area. Chief Herlache answered
questions on what can and cannot be burned, the use of caution when
burning and consequences of carelessness. He also provided an
ordinance handout addressing "Burning and Fireworks." Chief Herlache
recommended that our burning permits be issued on a day-to-day basis.
It was the consensus of the Board members that effective immediately
burning permits will be issued for a one-day period. Zipperer thanked
Chief Herlache and his department for a job well done in controlling
the recent fires on Glidden Drive.
New Business:
Town Planning & Zoning Committee report:
1) Suzanne Wick - Petition for Zoning Amendment
(Bloomquist/Resenhoeft) to rezone a portion of wetland. Schley
reported that earlier this evening the Committee reviewed the
information submitted and recommended approval of the petition which
would allow the owners driveway access in order to construct a single
family residence. Motion by Girman and seconded by Staveness that the
Board recommend approval of Suzanne Wick's petition for rezoning a
portion of wetland on each parcel to allow driveway access. Motion
carried and the Clerk was instructed to notify Door County Planning
and Zoning of the recommendation.
2) Kenn Wiest - Petition for After-the-Fact Grant of Variance.
Schley reported that the Committee had reviewed Mr. Wiest's petition
to retain a patio constructed without a regular zoning permit at 4798
Bark Road and recommended approval. Keith Bridenhagen, the
landscaper/contractor who installed the patio, provided an explanation
and photos. Motion by Staveness and seconded by Schley that the Board
recommend approval of Kenn Wiest¡¦s petition for an after-the-fact
variance. Motion carried and the Clerk was instructed to notify Door
County Planning and Zoning of the recommendation.
3) Schley also reported that Mike and Sharon Johnson after-the-fact
petition for a grant of variance for an above-grade constructed deck
at 5381 West Shore Drive had been granted by the Resource Planning
Committee.
4) Schley reported that she forwarded a letter to the Door County
Planning Department of the Committee's recommendation for denial of
the Klussendorf petition for a zoning amendment-text change (assembly
halls as conditional use in Estate Zoning).
5) Schley also reported that she forwarded a letter to the Door
County Planning Department of the Committee's recommendation for
approval of Vern Cutler's petition for variance regarding an
encroachment into road setback at 4080 Glidden Drive.
Minutes:
Motion by Schley and seconded by Girman to approve the minutes of the
July 19, 2004 Board of Supervisors' meeting. Motion carried.
Clerk/Treasurer Monthly Reports:
The treasurer's report for July 2004 was accepted and will be placed
on file.
Vouchers/Bills/Claims:
Motion by Staveness and seconded by Girman to approve the vouchers,
bills and claims for the month of July 2004. Motion carried.
Oral Committee Reports:. None.
Committee/Board Minutes: The Sevastopol Dam, Park and Rec Committee
minutes of July 21, 2004 and the Planning and Zoning Committee minutes
of July 26, 2004 were accepted and will be placed on file.
Continued/Pending Business:
1) Sturgeon Bay Fire Department. The July 2004 monthly report was
received.
2) Municipal Taxpayer Commission. Zipperer reported that the
Commission remains inactive for the summer months, but we continue to
pay the lobbyist.
3) Property Maintenance. Still looking for volunteers--anyone
interested in serving on a "Property Maintenance Committee" should
contact Chairman Zipperer or the Clerk.
New Business:
1) Door County Planning Department-Construction permits for July
2004.
2) Independent Inspections, Ltd. - Building recaps for July 2004.
3) Town Planning & Zoning Committee: (see above deviation from
order)
4) Door County Planning Department. Smart Growth. Correspondence
indicates that the Door County Resource Planning Committee will
approach the "Smart Growth" as follows: (1) it will be conducted in a
low cost manner with reliance on current County staff and local
resources, using the Door County Economic Development Corporation
project as the basis for development of the County comprehensive plan;
(2) use of consultants is not contemplated at this time; (3) the plan
will be from a county perspective, not incorporating town issues,
except as necessary; (4) the plan will recognize those municipal
comprehensive plans that have been or will be completed in accordance
with the comprehensive planning law; (5) initial plan proposals will
be presented for public review and reaction; and (6) development of
the plan will closely involve the Resource Planning Committee and the
County Board. The plan is scheduled for adoption in April 2007, which
provides ample time for data gathering and analysis, public "open
houses" and hearings, and finalization before the January 1, 2010
deadline. Following a short discussion, this matter will continue as
a pending item.
5) WPS - Leased Lighting and Locations. Greg Dantoin, Account
Executive for Wisconsin Public Service Corporation, provided a
detailed report of the leased lighting in the Town of Sevastopol. The
report includes locations, cost per account (three accounts-Institute,
Sevastopol and Valmy), cost per fixture and fixtures per account.
Following discussion of the report, Zipperer will make contacts to see
if costs can be reduced of if alternative lighting may feasible.
6) Georgenson Preliminary Plat for Apple Orchard Estates. The Board
was provided with a courtesy copy of the Community Development
Director's Report to the City of Sturgeon Bay Plan Commission which
recommends approval of the plat, subject to provisions for
right-of-ways and approval by Door County. This property is located in
the Town of Sevastopol and consists of a 9.56 acre parcel located at
the northwest intersection of Peterson Road and Gordon Road, but lies
within the 1.5-mile extraterritorial jurisdiction of the City of
Sturgeon Bay.
7) Renovation of South Ballfield at Town Park. Meissner Landscape
provided a proposal for the renovation of the south ballfield, which
would include strip and re-use existing/add sod, adding topsoil,
grading, restructure pitcher's mound, bases and home plate, for a
total of $12,159.79. (Updated information provided to the Board from
the Dam, Park & Rec Committee; monies already budgeted).
Special Reports: (see above deviation from order)
Zipperer reported that our Town road projects were currently on hold
pending completion of the new Highway Department parking lot and other
work within the City, but is expected to move forward within the next
two weeks.
Announcements:
Next Board of Supervisors' meeting will be held on Monday, September
20, 2004 at 7:00 p.m.
The Wisconsin Towns Association Annual Convention will be held in
Appleton, October 3-6, 2004. Anyone interested in registering should
contact the Clerk.
