BOARD OF SUPERVISORS' MEETING MINUTES
Monday, November 24, 2003
Town Meeting Room behind Sevastopol Schools

Call to Order:
Chairman Zipperer called the meeting to order at 7:02 p.m.
Establish Quorum/Roll Call:
Roll call was taken. Chairman Leo Zipperer, Supervisors Tom Girman,
Tom Olsen, Jo Ann Schley and Clerk/Treasurer Linda Wait were in
attendance.
Public Participation:
Ron Bloomquist addressed the Board and gave a summary of what has
transpired since the Town vacated a portion of Nelson Lane in 1999 and
requested the Town's assistance in gaining access to his landlocked
property. Zipperer read from Town legal counsel Randy Nesbitt's
letter of November 21, 2003 which states that the Town no longer holds
an interest in that property, that it would not be appropriate for the
Town's counsel to provide legal advice to him and further reiterated
that the Town has no power to act upon Mr. Bloomquist's request.
Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed. Motion by
Schley and seconded by Girman to adopt the agenda. Motion carried.
Correspondence:
1) Zoning Text Amendment reference to Off-Premise Parking for public
boat launch facilities.
2) Department of Natural Resources - Notice of revision to the
Managed Forest Law (MFL) Program (Forest Tax & Stewardship Newsletter
was also provided).
3) Notice of meeting of DCEDC Technology Council re: ultra high
broadband (UHB) fiber optic cable presentation by iPool Corporation.
Girman will report on this subject later in tonight's meeting under
Committee Reports.
4) Notice from Ken Pollock, Addressing Specialist, that address/911
signs have been placed for the newly named "Bluff Drive" (previously,
portion of Old OR).
5) William Schuster, Conservationist for Door County, was notified by
letter from the Chairman that the Town authorized a contribution of
$500 in its 2004 budget for support of the grant application for
"source identification" as to cause of beach contamination.
6) Acknowledge receipt of correspondence from Ron Bloomquist and Mary
Ellen Resenhoeft re vacating of Nelson Lane.
7) Notice from Charter Communications re: changes to billing
service.
8) Email from Paul Schumacher, President of Clark Lake Advancement
Association, regarding status on the operation of the Clark Lake Dam.
This matter will be addressed under Pending Business.
9) Resource Planning Committee - notice of public hearing regarding
amendment to Site Plan Review process to allow input from
municipalities..
Motion by Olsen and seconded by Schley to accept correspondence,
excepting those items referred to a specific committee, and place on
file. Motion carried.
Minutes:
Motion by Olsen and seconded by Girman to approve the minutes of the
October 20, 2003 Board of Supervisors' meeting and place on file.
Motion carried.
Clerk/Treasurer Monthly Reports:
Motion by Olsen and seconded by Schley to approve vouchers and to
accept the treasurer's report for October 2003 and place on file.
Motion carried.
Oral Committee Reports:
Ad Hoc Cable Committee: Girman met with the Consumer Services
Protection Committee/City of Sturgeon Bay to discuss the
previously-submitted Letter of Understanding which proposed an annual
fee of $1,500 for access to their PEG channel broadcast material. We
are awaiting their response.
Zippered reported on Town Plan Commissioner Training Workshop held in
Baileys Harbor on November 13, 2003. Its purpose was to help plan
commissioners better understand how to use their comprehensive plans
and the responsibilities connected thereto in their increasing role.
Resident Pat Miller was credited for attending.
Girman reported on his attendance at the November 11, 2003 meeting of
the Door County Economic Development Corporation/Technology Council
and a presentation by iPool Corporation to bring high-speed internet
service to Door County using ultra high broadband (UHB). The next
action will most likely be a feasibility report by DCEDC to determine
if this may attract additional businesses to Door County.
Committee/Board Minutes:
The September 10, 2003 minutes of the Sevastopol Dam, Park & Rec
Committee and the
September 15, 2003 minutes of the Planning and Zoning Committee were
accepted and placed on file.
Continued/Pending Business:
Sturgeon Bay Fire Department. Acknowledged receipt of the October
2003 Fire Reports. The Chairman thanked Fire Chief Tim Herlache for
his comprehensive report and his enclosure, "Facts on Open Burning."
Municipal Taxpayer Commission. Minutes of the October 30, 2003
meeting were available. The next meeting is scheduled for November 20
in Baileys Harbor.
Development - Request for Town Road Name (unnamed road in Holiday
Acres). Olsen is waiting to hear from previous property owners and
the matter will be continued to next month.
Clark Lake Advancement Association re: Dam Operation. (Supervisor
Worrick arrived at 7:44 pm) Zipperer gave a brief review of operation
of the dam and our contract with the DNR on required maximum levels.
This was a joint venture with the Town of Jacksonport and their Board
members are invited to the next Dam, Park & Rec Committee meeting
scheduled for December 3 which will be an information meeting. Paul
Schumacher, President of the Clark Lake Advancement Association, and
on behalf of the riparian owners, asked that more attention be given
to the operation of the dam and monitoring of lake levels,
particularly at this time of year when ice shoves are likely. His
group offers their assistance to work with the Town in the operation
and maintenance of the dam and fish screens.
Intergovernmental Smart Growth Application. Olsen will be in contact
with the Town of Sturgeon Bay some time after January 1, 2004, as they
have postponed the project until next year.
On/At PASER Rating. Wait reported that the rating sheets are due to
the Department of Transportation by December 15. The data from the
previous 2002 format has been incorporated into the new format for
2003, ratings will be updated where appropriate and the spreadsheet
will be in order for submission before the due date.
New Business:
1) Door County Planning Department - Construction Permits. The
construction permits for October 2003 were accepted and placed on
file.
2) Independent Inspections Ltd. - Town Building Permits. The
building permits and recap for October 2003 were accepted and placed
on file.
3) Town Zoning/Planning Committee Recommendations. None.
4) Schedule of Meetings 2004. The schedule of Town Board meetings
for 2004 is available, subject to change if necessary.
5) Snow Removal Agreements. The forms are available from the Clerk
at the Town office and agreements must be in place before plowing or
sanding will be performed by the Door County Highway Department.
6) 2004 Budget. The 2004 Town budget was finalized on November 17,
2003 with 15 electors in attendance. Total budget expenditures of
$861,211 less revenues/funds applied of $376,291 resulted in an
approved general property tax of $484,920 with a mil rate of $1.23.
Resolutions:
06-03 TB Committee Appointments 2003-2004. Zipperer presented the
appointment of membership to committees and other appointees. Motion
by Worrick and seconded by Schley to approve. Motion carried.
Ordinances:
Ordinance No. 2003-05 - Ordinance to Eliminate the Necessity of a
Municipal Treasurer's Bond (pursuant to Wisconsin Statutes, Section
70.67, that a municipal treasurer's bond is not required for the Town
of Sevastopol). Motion by Schley and seconded by Olsen to approved
Ordinance No. 2003-05. Roll call vote: Girman, Olsen, Schley,
Worrick, Zipperer-aye. Motion was unanimously carried (5-aye,
0-nay).
