BOARD OF SUPERVISORS' MEETING MINUTES
Monday, February 17, 2003 
Town Meeting Room behind Sevastopol Schools

Call to Order:
Chairman Zipperer called the meeting to order at 7:00 p.m.

Establish Quorum/Roll Call:
Roll call was taken.  Chairman Leo Zipperer, Supervisors Don Haen, Tom
Olsen, Jo Ann Schley, Gerald Worrick and Clerk/Treasurer Linda Wait
were in attendance.

New Business:
Town Planning & Zoning Committee Recommendations:    Olsen reported on
a recommendation from the Planning & Zoning Committee regarding a
request for change in zoning by Dean Gigstead for 15 acres located on
West Jorns Lane and currently zoned estate (5 acre).  Adjacent
property owners would also like a change in zoning to small estate
(1.5 acre) affecting a total of 140 acres and request that the Town
make application for the change.  Motion by Olsen and seconded by
Schley that the Town of Sevastopol petition the Resource Planning
Committee for a change in zoning from estate to small estate for the
140 acres.  Motion carried.  
Olsen reported on a request by Norman Paul to rebuild his home at 5350
County T.  The home burned in November 2002 and Paul wishes to place a
modular home for the most part on the same footprint, which would not
meet current setback requirements.  Motion by Worrick and seconded by
Olsen to recommend approval of Paul's request for a variance.  Motion
carried.

Set Next Meeting Date:  Due to prior commitments for Supervisors Olsen
and Haen, the next Board of Supervisors' meeting is scheduled for
Tuesday, April 22, 2003 at 7:00 p.m.  There will be no regular Board
meeting in March 2003.

ORDINANCES:  
No. 2003-1 Speed Restrictions - N. Cave Point Drive.
Motion by Worrick and seconded by Olsen to approve Ordinance No.
2003-1 to establish the speed limit at 25 mph on North Cave Point
Drive from the junction of WD and North Cave Point Drive a distance of
.41 miles northerly toward the Jacksonport town line.  Kent Harrison,
Park Manager at Whitefish Dunes State Park, addressed the Board with
safety concerns he had on the increased speed limit on North Cave
Point Drive through the park, especially during the summer months with
increased vehicle and pedestrian traffic. Discussion followed.  (Olsen
excused at 7:26 p.m.)   Roll call vote:  Worrick, Schley, Haen and
Zipperer-aye; Olsen-excused.   Motion carried.

Public Participation:
Pat Miller distributed to the Board copies of the Door County Citizens
Guide to Small Wastewater Systems published by Door County
Environmental Council, Inc.  Thank you, Pat, and a note of
appreciation will be forwarded to the DCEC.

Presentation of Agenda/Properly Noticed:
On information provided by the Clerk that the agenda was properly
noticed, motion by Schley and seconded by Haen to adopt the agenda. 
Motion carried.

Correspondence:
1)  UW-Extension Legislative Day - Invitation to upcoming Workshop,
Agenda, Minutes of Steering Committee and Event Sponsor Status Report
from Rob Burke for Door County Legislative Day.
2)  Door County Planning - Notice of public hearing by the Resource
Planning Committee to evaluate the Site Plan Review Procedures in
processing permits under the Door County Zoning Ordinance and notice
Amendatory Zoning Ordinance regarding definition of Personal Service
Establishment and Spa.
3)  Wisconsin Department of Transportation - Notice of Hazard
Elimination Safety Programs (HES) which accepts applications to
develop and implement safety projects for less than $25,000. 
Applications due August 1, 2003.
Correspondence was accepted and placed on file.

Minutes:
Motion by Worrick and seconded by Haen to approve the minutes of the
January 20, 2003  Board of Supervisors' meeting.   Motion carried.

Clerk/Treasurer Monthly Reports:
Motion by Haen and seconded by Schley to accept the January
treasurer's report.  Motion carried. 

Oral Committee Reports:   None.

Committee/Board Minutes:  None.

Continued/Pending Business:
1)  Sturgeon Bay Fire Department.  Acknowledged receipt of the January
2003 Fire Report and the 2002 Fire Report Summary for the Town of
Sevastopol.
2)  Municipal Taxpayer Commission.   Received minutes of the January
16, 2003 meeting and 2001 comparison chart with local levies for our
NWTC district.  Also received copies of resolutions from Towns of
Washington, Baileys Harbor and Union, Village of Egg Harbor and City
of Sturgeon Bay requesting revision to funding, decision-making and
tax authority of the Technical College System and its Board.   There
are now 11 municipalities which have passed similar resolutions. 
Zipperer has been regularly attending the MTC meetings and also made a
presentation to the City of Sturgeon Bay on January 30.  He reported
that the Technical College Board met in Milwaukee on January 24 and
there was a good reception for representatives from the Wisconsin
Taxpayers Alliance, MTC and Stenger's office.  
3)  Roadwork 2002.  Roadwork is completed and year-end billing for
work performed in 2002 was  paid in January 2003.

New Business:
Door County Planning Department Construction Permits.  The
construction permits for December 2002/January 2003 were accepted and
placed on file.
Independent Inspections Ltd. Town Building Permits.  The building
permits and recap for January 2003 were accepted and placed on file.
Town Zoning/Planning Committee Recommendations.   (See above under
deviation from order.)
Old OR/Cty OR/Old Cty Trk OR - Status.  Zipperer sent out 18 letters
and received 15 responses from property owners of that portion of Old
OR from HH west to its intersection with Bluff Court and then
southerly down to Bay Shore Drive inviting input as to a possible road
name change.  Ken Pollock, Addressing Specialist for Door County, also
provided suggestions.  There will be a further informational
"gathering" on Sunday afternoon, February 23, 2003 at Birmingham's.
Membership MTC (non-budgeted).  By majority vote at the Annual Meeting
on April 9, 2002, it was decided to join the Municipal Taxpayer
Commission and to make a $5,000 initial contribution.  Zipperer has
attended 10 meetings since May 2002.  A motion to contribute
additional funds made at the Town's Special Meeting held on November
18, 2002 was defeated 10-5.  Following discussion, the matter will be
brought back to the table at the April meeting.

RESOLUTIONS:  
No. 01-03 TB Ad Hoc Cable Committee appointments.   Motion by Worrick
and seconded by Schley to adopt Resolution No. 01-03 TB that the Ad
Hoc Cable Committee be set at three members comprised of Town Board,
Sevastopol School and Citizen Members, and that the following persons
be appointed for a term expiring April 2004:  Tom Girman, Joe McMahon
and Jerry Worrick.  Motion carried.

ORDINANCES:   
No. 2003-1 Speed Restrictions - N. Cave Point Drive.   (See above
under deviation from order.)

Special Reports by Chairman:
  Cherry Road Hiking and Jogging Trail.  Zipperer read a letter dated
February 6, 2003 from Attorney Nesbitt addressed to Associated
Appraisal Consultants regarding the 1998 WPS installation of high
voltage power lines along Cherry Road and several property owners
conveying by quit claim deed the east 43 feet of their properties for
a hiking/walking/jogging trail.   Attorney Nesbitt asked for
clarification from our assessor as to ownership and assessed values of
these parcels.  
  Sturgeon Bay Utilities.  The City of Sturgeon Bay has adopted an
ordinance whereby delinquent sewerage, water and electric services
shall become liens upon the property and recoverable by civil action
against the property owner.   This action is similar to delinquent
Sevastopol sanitary district charges which are placed upon the tax
roll and may affect property along Bay Shore Drive and Glidden Drive
which is serviced by Sturgeon Bay Utilities.
  Beverage License Ordinance.  Zipperer submitted several questions to
Attorney Nesbitt and we are waiting for his answers prior to
proceeding on ordinance revisions.

Adjourn:
In view of the fact that there will be no March meeting of the Board
of Supervisors, motion by Worrick and seconded by Haen that
Clerk/Treasurer Wait be allowed to pay the March invoices.  Motion
carried.  Motion by Schley and seconded by Haen to adjourn.  Motion
carried.  Adjourned at 8:45 p.m.
