BOARD OF SUPERVISORS’ MEETING MINUTES
September 23, 2002
Sevastopol Schools Modular Building Meeting Room
4550 STH 42, Sturgeon Bay, Wisconsin
Call to Order:
Chairman Zipperer called the meeting to order at 7:00 p.m.
Establish Quorum/Roll Call:
Roll call was taken. Chairman Leo Zipperer, Supervisors Don Haen, Tom
Olsen, Jo Ann Schley and Clerk/Treasurer Linda Wait were in
attendance. Supervisor Gerald Worrick was excused.
Public Participation:
Laddie Chapman read an email he had received from John
Miller of Charter Communications regarding the PEG channel and
Chapman’s request to form a separate cable access channel and its
purpose, content, administration and setup.
Presentation of Agenda/Properly Noticed:
On information provided by the Clerk that the agenda was properly
noticed, motion by Olsen and seconded by Schley to approve the agenda.
Motion carried unanimously.
Announcement: Chairman Zipperer reported that the Board met at 6:00
p.m. this evening at the junction of Apple/Old OR for the purpose of
inspecting Apple Road prior to its approval for reconstruction. The
Board also viewed Timber Ridge Road, which is a Resolution item on
tonight’s agenda. Notice of such meeting was by separate agenda.
CORRESPONDENCE:
Wis DOT – Proposed Highway Improvement Program Update
indicating 2002-2004 proposed projects for Door County.
Bay-Lake Regional Planning Commission – Niagara Escarpment
Conference – September 26-27, 2002, University of Wisconsin-Green
Bay.
Associated Appraisal – current list of personal property
assessments for 2002.
Thank you received from Jane Moeller and Leola Moeller for
services provided by our First Responders.
UW Extension – Analysis of Changes in Shared Revenue
provided by new Community Development Educator Rob Burke.
Letter of introduction from Doug
Paulin/lightingforensicsinc, consultant on lighting issues and offer
of free hour of consultation.
Request to DC Humane Society/Karen Christenson for budget,
activity and agency information for continued support. Zipperer will
be meeting with her on 10/1/02.
Charter Communications – Notification of corporate office
address change.
Watch out, GASB 34 – Crossroads (UW-Madison) article
explaining new national accounting standard for municipalities, its
requirements and benefits.
Motion by Schley and seconded by Haen that correspondence be accepted
and placed on file. Motion carried unanimously.
Minutes:
Motion by Haen and seconded by Schley to approve the minutes of the
August 19, 2002 Board of Review. Motion carried unanimously.
Motion by Olsen and seconded by Haen to approve the minutes of the
August 19, 2002 Board of Supervisors’ meeting (with correction to date
at page 4, par. 1, 7/14/02). Motion carried unanimously.
Clerk/Treasurer Financial Reports:
Motion by Haen and seconded by Schley to accept the August 2002
treasurer’s report. Motion carried. Wait also reported on estimated
shared revenue payments for 2003 and issuance of temporary Class B
beverage licenses to Sevastopol Pioneer Wresting Club and United Way.
Motion by Olsen and seconded by Schley to approve the vouchers, claims
and bills. Motion carried unanimously.
Oral Committee Reports: None.
Committee/Board Minutes:
Sevastopol Dam, Park & Rec Committee minutes of August 14,
2002 will be accepted and placed on file.
CONTINUED/PENDING BUSINESS:
1) Sturgeon Bay Fire Department. Acknowledged receipt of the August
2002 fire report.
2) STS – Whitefish Bay Feasibility Study. Haen reported that on
9/11/02 the Dam, Park & Rec Committee, along with other interested
citizens, met with Terry Peterson, Engineer, STS Consultants, to
review and discuss the survey and options regarding the launch/ramp at
Whitefish Bay. The DNR could cost-share the replacement of the ramp
with a new and wider cement slab, at an estimated cost of $70,000.
The matter will be brought up at our budget sessions.
3) P.E.G. Channels – City of Sturgeon Bay. Zipperer and Schley
attended the 9/12/02 meeting of the Community Services & Protection
Committee. A “letter of understanding” had previously been submitted
to the City. Following discussion, Olsen moved to approve the
previous agreement and Haen seconded. Olsen withdrew his motion and
Haen agreed. After further discussion, Olsen moved to approve the
letter of understanding and Haen seconded. Motion carried
unanimously.
4) Municipal Taxpayer Commission. Minutes of the July and August
meetings were provided. Zipperer attended meetings on 9/12/02 and
9/16/02. Senator Lasee and Representative Bies were also present on
9/16; however, Worrick and Dr. Rafn were unavailable. The next
meeting is scheduled for 10/10/02 at 9:00 a.m. at Baileys Harbor town
hall.
5) L.R.I.P. Zipperer reported that additional information has been
supplied as requested by Commissioner Kolodziej and he in turn has now
submitted a letter request to the DOT for payment.
6) Road Work 2002. Zipperer’s letter of 8/27/02 to the Highway
Department was amended to specify work to be done on Elaine Drive and
to proceed with same.
7) Pat Miller – Clean water. Discussion on inspection of septic
systems and beach contamination. Zipperer had received a draft
Wellhead Protection Plan” which will be placed on file. Schley is our
representative to that committee.
8) Driveway Permit Application. Following discussion on revisions to
draft driveway permit application, the matter will be brought back at
next month’s meeting for revisions.
NEW BUSINESS:
Door County Planning Department – Construction Permits. The building
permits for July-August 2002 were accepted and placed on file.
Independent Inspections Ltd. – Town Building Permits. The building
permits and recap for August 2002 were accepted and placed on file.
Town Zoning/Planning Committee Recommendations. None. Olsen
reported that the Gignilleat request for a setback variance had been
denied by the BOA. The Banks’ request for a setback variance on
Glidden Drive was granted by the BOA.
Zoning Text Amendments regarding carwash as conditional use, accessory
structures in mobile home parks, and campgrounds/trailer camps subject
to conditional use permit were recently ordained by the Door County
Board of Supervisors.
Conditional Approval for C&W Garage – The DOC granted conditional
approval for the garage addition.
2002 County Equalization Report received from Wis DOR providing
equalized value for taxation districts in Door County, and indicates
changes from 2001.
Construction Site Storm Water Permits are now also required for road
projects in excess of .6 mile in length.
Whitefish Bay Dunes Park – Attorney Nesbitt wrote to Corporation
Counsel Grant Thomas and is awaiting a response regarding the speed
limits in the Whitefish Dunes are and enforcement of same.
Cherry Road - speed limit – Motion by Olsen and seconded by Schley
that we recommend to the Door County Highway Department that they
lower the speed limit from 55 to 45 mph on Cherry Road. Motion
carried (Olsen, Schley, Zipperer-aye; Haen-nay; Worrick-excused).
Madonna Starr has requested a refund of portion of 2000 real estate
taxes paid. Motion by Olsen and seconded by Haen to deny this
request. Olsen withdraws motion and Haen concurs. Motion by Olsen
and seconded by Haen to table the matter for one month pending receipt
of information from Associated Appraisal. Motion carried
unanimously.
DC Planning Department - Private Roads. After reviewing the list
provided, the Clerk will notify the DC Planning Department of
changes.
Vision control – Aaron Daubner of the DCHD will be viewing some areas
of concern.
RESOLUTIONS:
04-02TB Timber Ridge. Following discussion, motion by Schley to
approve Resolution 04-02TB to recognize Timber Ridge as town road,
with the following conditions: 1) ditches be established per
ordinance requirements, 2) that culvert(s) and 3) guardrail(s) be
installed as recommended by the Door County Highway Commissioner, and
4) prepayment for paving/reconstruction if the work is to be done
through the Town. Seconded by Olsen. Motion carried unanimously.
ORDINANCES:
06-2002 Speed limits on North Cave Point Drive and Schauer Road.
Motion by Haen to adopt Ordinance 06-2002 to establish 25 mph speed
limit on Schauer Road and to establish 35 mph speed limit on North
Cave Point Drive. Seconded by Schley. Motion carried. (Olsen, Haen,
Schley, Zipperer-aye; Worrick excused)
07-2002 Required Stop. Motion by Haen to adopt Ordinance 07-2002 to
establish a required stop on Sylvan View Circle East at its junction
with Sylvan View Circle West. Seconded by Olsen. Motion carried.

08-2002 Race Track Prohibition. No action at this time.
SPECIAL REPORT: Motion by Olsen to approve holding tank permits for
Karl/Karen Schmidt and Robert Janda. Seconded by Schley. Motion
carried unanimously.
