TOWN BOARD MEETING MINUTES
Sevastopol Schools Modular Building Meeting Room
4550 STH 42, Sturgeon Bay, Wisconsin
January 21, 2002

Call to Order:
Chairman Zipperer called the meeting to order at 7:01 p.m.

Establish Quorum/Roll Call:
Roll call was taken:  Supervisors Don Haen, Tom Olsen, Jo Ann Schley
and Gerald Worrick (arrived at 7:07 p.m.), Chairman Leo W. Zipperer
and Clerk/Treasurer Linda Wait were in attendance.

Public Participation:  None.

Presentation of Agenda/Properly Noticed:
The agenda has been properly noticed.  Motion by Olsen and seconded by
Haen to adopt the agenda as presented.  Motion carried.

(deviation from order)
Walker/Peterson Road Status:  Dan DeGroot and Mark DeGroot from
DeGroot Construction Inc. presented to the Board three pages of
estimated and actual calculations regarding their work on
Walker/Peterson roads and requested payment of the balance due their
firm.  Discussion followed.  Motion by Worrick and seconded by Schley
to settle the matter with a final payment of $28,880.88.  Motion
carried. 

Correspondence:
 Superior Services.   Request from Ben Short of Superior
Services to submit proposal for curbside collection and hauling of
trash/recycling.   Matter will be placed on the February 18, 2002
agenda. 

 Town of Sturgeon Bay – Opposition to Aquatic Industrial Park
& Turning Basin.  The Town of Sturgeon Bay adopted a resolution
opposing the development of an “aquatic industrial park/turning basin”
on the Sturgeon Bay Utilities canal property.

 City of Sturgeon Fire Department.  December 2001 fire report
with calls and incidents.

 Ameritech.   Notice that work on Bark Road has been
completed.

  Charter Communications.  Notice of name change to Charter
Cable Partners, LLC.

  Conditional Use Permit – Steven Laubenstein.    Door County
Planning Department notification that a conditional use permit will be
issued to establish a trade and contractor shop at 4001 Highway 42/57,
subject to conditions.


  Shappell.   An email message received from Dick Shappell
with a “Thank You for Holding the Town Taxes in-line this year.”

  City of Sturgeon Bay Fire Department/Ladder Truck Concerns. 
Zipperer’s response to Fire Chief Terry MacDonald regarding the use of
the ladder truck.

  Zoning Text Amendment to Door County Zoning Ordinance. 
Notification that the zoning ordinance was amended to establish a
“trade or contractor establishment” and to designate “home business”
as permitted uses in Mixed Use Commercial.

  Asplundh Tree/WPS.  Notice of tree trimming and removal
maintenance along existing overhead lines with an explanation of how
trees are trimmed and safety measures.

 Minutes:
Motion by Olsen and seconded by Haen to approve the minutes of the
December 17, 2001 regular meeting of the Board of Supervisors and
place on file.  Motion carried.

Clerk/Treasurer Financial Reports:
Motion by Olsen and seconded by Worrick to accept the December 2001
treasurer’s report.  Motion carried.

Oral Committee Reports:   Schley reported that she had recently
attended a meeting regarding Wellhead and Watershed protection. 
Discussion followed on the replacement of holding tanks and the
purpose of holding tank agreements with our Town.  

Committee/Board Minutes:
 The minutes of the Fire & Rescue Committee meeting of
November 20, 2001 were accepted and will be placed on file.
 The minutes of the Sevastopol Dam, Park & Rec Committee
meeting of December 15, 2001 were accepted and will be placed on
file.

CONTINUED/PENDING BUSINESS:

Whitefish Bay Dock Feasibility Study Funding:    Zipperer acknowledged
receipt of Jeff Pagels/DNR recommendation not to approve the Whitefish
Bay Feasibility grant request and withdrew the application filed on
October 15, 2001, reserving the right to apply for any future grants,
if available.  Zipperer has requested that Terry Peterson/STS
Consultants provide an updated proposal for a dock/ramp study.

Assessor Plat – Whitefish Bay Plat:   A 12/17/01 letter from Door
County Planning Department addressing the benefits of an assessor’s
plat for the Whitefish Bay Plat and vicinity.  Also letter from Amy
Sorenson/Jamie McGuire confirming their request for an assessor’s
plat.  Charles Jarman, Chairman of the Door County Resource Planning
Committee, said that the Committee recommended direction from the Town
on this point.    He stated the ongoing problems in attempting to
straighten out boundary disputes and accurately place setbacks.  


Discussion followed as to cost/possible negotiation for survey work
and the residents’ opposition to proceeding with an assessor’s plat. 
Motion by Schley and seconded by Olsen to reaffirm our previous
position that we not order an assessor’s plat.  Motion carried.

Fire Protection Service:   Zipperer reported that the Fire & Rescue
Committee has been invited to a meeting with the City of Sturgeon Bay
Fire Department on January 29, 2002.

NEW BUSINESS:

Zoning & Planning Committee Recommendations:   Discussion on whether
our Committee is fully aware of all the circumstances surrounding a
request.  Jarman suggested that perhaps our Committee respond as
having no objection to a variance request as opposed to supporting or
not supporting the request. 

NWTC:   We have not received  a formal request to contribute to the
coalition but have been invited to meetings sponsored by  the Northern
Door Towns.  Motion by Olsen and seconded by Schley to table the
matter.  Motion carried.

Door County Planning Department – Construction Permits:
The building permits for November/December 2001 were accepted and
placed on file.

Independent Inspections Ltd. – Town Building Permits:
The building permits and recap for December 2001 were accepted and
placed on file.

Cherry Peninsula Associates, Inc.:  Notification from Door County
Planning Department to Cherry Peninsula Associates, Inc. to submit
application for regular zoning permits with regard to three of the
four duplex units at Cherry Ridge, (first special exception permit
having been issued in 1998).  

Intergovernmental Agreement (Repair of Highways):  Agreement between
County of Door and Town of Sevastopol for highway repair for period
1/1/02 – 12/31/02.

Managed Forest Law-Transfer Order – Wolske:  Notification of transfer
of enrolled lands from Dean Wolske to Wolske Limited Partnership.

Managed Forest Law-Amended Order:  Notification of amendment to prior
order as “MFL Closed/MFL Open” lands for Tim Smith, et al.

Wisconsin Department of Transportation:  Final estimated payments for
year 2002 General Transportation Aids totaling $147,735.90.

Charter Communications:  Notice of rate changes effective February 1,
2002.  Brief discussion on discontinuance of public access channels to
Glidden Drive and northern Bay Shore area.

Resolutions:   None.


Ordinances:  

 Ordinance No. 01-2002:  Intersection of Peterson Road and
Walker Road.  Motion by Schley and seconded by Olsen to approve
Ordinance No. 01-2002, establishment of stop sign on Peterson Road and
repeal all-way stop at the intersection of Walker and Peterson Roads. 
Roll call vote:  Aye-Haen, Olsen, Schley, Zipperer; Nay-Worrick. 
Motion carried.

 Ordinance No. 02-2002: Bond for Holding Tank.  No action
taken.

 Ordinance No. 03-2002:  Establishing a Snowmobile Route on
County Highway WD.   Motion by Olsen and seconded by Schley to approve
Ordinance No. 03-2002, to provide connection between sections of
snowmobile trail on County Highway WD.  Roll call vote:  Aye-5; nay-0.
 Motion carried.

Special Report:   None.

Announcements:
  The Town meeting schedule for 2002 was revised.  (The Board
of Review will be held on August 19, 2002 from 4-6 p.m., preceding the
regular Board of Supervisors’ meeting that evening.)
   Holding Tank Servicing Agreement and Holding Tank
Replacement for Richard/Dottie Shappell was approved.
  Town of Sevastopol will be hosting the Door County Unit of
Wisconsin Town Association meeting on February 6, 2002 at “The Mill.”

Agenda Items for Next Meeting:
 Superior Services request to submit proposal for curbside
collection and hauling of trash/recycling. 

Special Announcements:
  Per recommendation from Attorney Nesbitt, the Addendum to
Agreement between Town of Sevastopol and Waste Management of
Wisconsin, Inc., (the entity retained by Door County to operate the
recycling facility), shall be signed and forwarded to Waste
Management.
  Attorney Nesbitt recommends that we take no action on the
Bosman’s offer to donate a parcel on Clark Lake.

Motion by Olsen and seconded by Haen to adjourn.  Motion carried.
