BOARD OF SUPERVISORS’ MEETING MINUTES
August 19, 2002
Sevastopol Schools Modular Building Meeting Room

Call to Order:
Chairman Zipperer called the meeting to order at 7:02 p.m.

Establish Quorum/Roll Call:
Roll call was taken.  Chairman Leo Zipperer, Supervisors Don Haen, Tom
Olsen, Jo Ann Schley, Gerald Worrick and Clerk/Treasurer Linda Wait
were in attendance. Attorney Randall J. Nesbitt was also present.

Public Participation:
  Muzz Mullard expressed his concerns about the current 55 mph
speed limit on Cherry Road, while neighboring roads have been reduced
to 45 mph.  For safety reasons, he would like to see the speed reduced
to 45 mph.  Zipperer responded that he will place the matter on next
month’s agenda and suggested that Muzz make this request of the
highway department, as well, because Cherry Road would fall under
County jurisdiction.
  Jim Bunning asked if he would have an opportunity to comment
on the PEG channel.

(Chairman asked for deviation from the order shown to accommodate
Attorney Nesbitt.)

X.  PENDING BUSINESS:
3)  P.E.G. Channels – City of Sturgeon Bay.  A letter was sent to the
City of Sturgeon Bay with the recommendation of a $3,000 annual
payment for an initial 5-year period, with the first year to be
pro-rated.  Zipperer attended the August 8, 2002 meeting and Channel
19 was selected for live and taped broadcasting rights.  Attorney
Nesbitt said that payment of fees to make available access channels
would be acceptable under our ordinance governing the use of franchise
fees.  


XI.  NEW BUSINESS:
8)  Franchise fee allocation/contract – City of Sturgeon Bay. 
Zipperer read the August 15, 2002 letter from Jay Krauss, City
Administrator, wherein the City would require the Town to pay 25% of
its annual franchise revenue, first year pro-rated, release rights to
receive live and tape feed broacasting rights of Channel 19, would
make available programming produced for broadcast on the City’s
remaining PEG channels with Town to pay the cost of tape reproduction
or duplication, and the Town should provide a priority list of tapes
they would like to air.  Zipperer explained that since franchise fees
are budgeted as a revenue item and not an expenditure, a 2/3 vote of
the Board is required for approval.  Motion by Olsen and seconded by
Schley to approve the contract as offered by the City of Sturgeon Bay.
 Motion by Olsen and seconded by Schley to offer a letter of agreement
to the City with the stipulations they have offered.  Motion by
Worrick and seconded by Olsen to add ceiling of $3,500 per year for
the first three years.  Worrick withdraws motion and Olsen agrees. 
Motion to amend by Worrick and seconded by Zipperer for a one-year
agreement ending December 31, 2003, at which time it can be modified. 
Motion carried (Olsen-nay).  Vote on original motion—carried
unanimously.



5)  Whitefish Bay Dunes Park – speed limits.  Haen has been contacted
by residents on the east side of Clark Lake regarding the enforcement
of speed limits by the DNR along Park Road, West Shore Drive and Clark
Lake Drive.  It has been suggested that the speed limit should be
raised to 35 mph.  
Attorney Nesbitt commented that the DNR has authority to set limits in
State parks.  Motion by Worrick and seconded by Haen to prepare an
ordinance to increase the speed limit to 35 mph  from Park Road to
West Shore Drive on WD.  Motion carried.
9)  Stonewood Lane Division – Town Line Road.  Zipperer stated that in
reviewing the gas tax credit maps as prepared by the State of
Wisconsin DOT, that portion of Town Line Road fronting this proposed
development is delegated to the Town of Egg Harbor and therefore no
action need be taken on this matter.

XIII. ORDINANCES:
05-2002  Town Road Standards.  Following discussion, motion by Worrick
and seconded by Haen to approve Ordinance 05-2002.  Zipperer pointed
out that permits will now be required for all driveways, although
there will be no fee charged.  Roll call vote:  Haen-aye, Olsen-aye,
Schley-aye, Worrick-aye, Zipperer-aye.  Motion carried.

Presentation of Agenda/Properly Noticed:
On information provided by the Clerk that the agenda was properly
noticed, motion by Olsen and seconded by Schley to approve the agenda.
 Motion carried.

CORRESPONDENCE:
1)  County of Door – Water monitoring of beaches.  Worrick wondered if
beach problems were due in part to failing septic systems and perhaps
older systems should be re-visited.  Zipperer reported that recent
samples from Clark Lake tested well below allowable standards.
2)  Wis DOC – Fire Dues Payment.  $11,548.47 represents our portion of
the fire department dues distribution for year 2001.
3)  Wis DOA – Population estimate.  Preliminary estimate of January 1,
2002 population for Town is 2,733.  This represents an increase of 66
persons since the 2000 census.  Worrick suggested a reminder that
residents be sure to register their vehicles in Sevastopol and not
Sturgeon Bay.
4)  Wis Towns Association.  Notification of dates, locations and
agenda for workshops on “Land Use Issues.”  
5)  City of Sturgeon Bay.  Invitation to attend “Parliamentary
Procedure” and “Open Meetings and Public Records” workshops.
6)  Charter Communications.  Notice that Charter will no longer carry
ESPNews on digital channel 132.
7)  Procurement Website.  Email from Paul Schumacher regarding
possible procurement website for municipalities to post items and
solicit bids.
8)  Nasewaupee Land Use News.  July 2002 newsletter regarding
alternatives to conventional zoning.
9)  Invasive Species Meeting.   Notice of rescheduled meeting to
August 27 at Whitefish Dunes State Park.

Minutes:
Motion by Schley and seconded by Haen to approve the minutes of the
July 22, 2002 regular meeting of the Board of Supervisors and place on
file.  Motion carried.


 
Clerk/Treasurer Financial Reports:
Motion by Olsen and seconded by Haen to accept the July 2002
treasurer’s report.  Motion carried.  Wait also reported receipt of
July shared revenue and July school levy property tax credit payments.


Oral Committee Reports:  Don Haen reported that Dan Woelfel will fill
the vacancy on the Sevastopol Dam, Park & Rec Committee.  

Committee/Board Minutes:  None.

CONTINUED/PENDING BUSINESS:
1)  Sturgeon Bay Fire Department.  Acknowledged receipt of the July
2002 fire report.
2)  STS – Whitefish Bay Feasibility Study. An informational meeting
was held on August 14 and STS presented the latest drawings.  Another
meeting is planned for September 11 to meet at the Hitching Post, view
the breakwall area and then proceed to the Town meeting room.  Dan
Woelfel reported that a portion of the ramp had snapped off and was
now filled with sand.  Haen will follow up.
4)  Municipal Taxpayer Commission.   Received minutes of July 11
meeting and treasurer’s report.  Meeting was held on August 8 and next
meeting will be held on September 12 at Sevastopol Town meeting room.
5)  L.R.I.P.   Zipperer stated we are waiting for highway engineer to
complete the necessary paperwork.
6)  Road Work 2002.  Reviewed previous construction estimates provided
by Door County Highway Department and printout of work completed to
date.  After discussion, motion by Olsen and seconded by Schley to do
Elaine Drive, the base prep for Apple Lane and crackfill on Clark Lake
and Dunn Roads.  Motion carried.  Zipperer said that the Highway
Department will be doing Whitefish Bay Creek bridge after Labor Day. 


NEW BUSINESS:
Door County Planning Department – Construction Permits.  The building
permits for June-July 2002 were accepted and placed on file.
Independent Inspections Ltd. – Town Building Permits.  The building
permits and recap for July 2002 were accepted and placed on file.
Town Zoning/Planning Committee Recommendations.     Committee had no
objection to the petition of Marian and Charles Banks for a variance
from the ordinary high water mark in order to construct an addition to
their residence.  Motion by Olsen and seconded by Schley to recommend
the approval of Banks’ petition for a grant of variance.  Motion
carried.  Olsen to notify RPC.
Wis Department of Commerce.     (i) Notice that review and approval on
hold for C&W Garage addition pending receipt of additional
information.  (ii) Notice of registration for Riley Mini Warehouse
storage construction project.
Clark Lake Buoy Placement.  The Clark Lake Advancement Association
came to the Town of Sevastopol and Jacksonport with the request for
placement of two “200 feet to shore, slow-no wake” buoys on Clark Lake
at two separate launch areas.  The DNR has approved the placement of
these waterway markers as informational buoys with “Slow - Public
Launch 200 ft.”  The costs will be shared among Clark Lake Advancement
Association and the Towns of Jacksonport/Sevastopol.
Wisconsin Taxpayers Alliance.    Subscription to The Wisconsin
Taxpayer magazine will be considered in next year’s budget.
 
RESOLUTIONS:   None.

SPECIAL REPORT:
1)  Clark Lake – Water Levels.     Zipperer reported that as of
7/14/02 the DNR advised all boards are in the damned dam.
2)  Animal Control.  Zipperer reported that several stray animals have
been delivered to the Door County Humane Society over the last several
weeks.  Based on the interaction of Supervisor Haen,  Zipperer,
residents and the DC Humane Society, he encouraged the release of the
$2,000 Sevastopol had budgeted last year for animal control. 
Following discussion, motion by Schley and seconded by Haen to remit
the $2,000 to Door County Humane Society.  Motion carried (Olsen
voting nay).

STS – September 11, 2002 – 6:00 p.m. 
Municipal Taxpayer Commission meeting Thursday, September 12,
2002 - 10:00 a.m. at Sevastopol Town meeting room
