TOWN BOARD MEETING MINUTES
Sevastopol Schools Modular Building Meeting Room
4550 STH 42, Sturgeon Bay, Wisconsin
November 26, 2001
Call to Order:
Chairman Zipperer called the meeting to order at 7:01 p.m.
Establish Quorum/Roll Call:
Roll call was taken: Supervisors Don Haen, Tom Olsen, Jo Ann Schley
and Gerald Worrick (arrived at 7:04), Chairman Leo Zipperer and
Clerk/Treasurer Linda Wait were in attendance.
Public Participation:
Dan Woelfel and Rich Shappell asked if the Board anticipated
making any decision as to the Bark Road assessor’s plat.
Laddie Chapman asked if everyone would be notified if such
an assessor’s plat was ordered.
Presentation of Agenda/Properly Noticed:
The agenda has been properly noticed. Motion by Schley and seconded
by Haen to adopt the agenda as presented. Motion carried.
Correspondence:
Dreutzer-Quarry Bluff Estates – will be reviewed by Planning
& Zoning Committee.
Wisconsin Wellhead Protection News – newsletter on wellhead
protection topics.
Charter Communications – required 30-day notice of
programming channel line-up changes; anticipated activation date
12/3/01.
UW Extension/ETN Announcement/Planning Information –
programs and available materials.
Correspondence accepted and placed on file.
Minutes:
Motion by Worrick and seconded by Haen to approve the minutes of the
October 22, 2001 regular meeting of the Board of Supervisors and place
on file. Motion carried.
Clerk/Treasurer Financial Reports:
1) The bills and financial reports for the month of October 2001 were
reviewed and Wait reported the following balances: Baylake
Moneymarket-$326,629.00; Associated Moneymarket-$59,766.44; Baylake
CD-$114,923.97; Baylake Breakwall CD-$10,000.00; and Baylake
Checking-$15,657.51.
2) Received Wis Department of Revenue final 2001 Statement of
Assessments and equated manufacturing assessment roll.
3) Notice of Spring Election – The required notice of 4/2/02 election
for Town Board Supervisor, incumbents Jo Ann Schley and Gerald Worrick
whose terms expire 4/9/02, has been properly noticed.
4) Wis Department of Revenue - $62,282.41 representing 11/19/01
distribution of shared revenues.
Motion by Schley and seconded by Haen to approve the financial
reports, bills and vouchers for the month of October 2001. Motion
carried.
Oral Committee Reports: None.
Committee/Board Minutes:
The minutes of the Fire & Rescue Committee meeting of July
10, 2001 were accepted and will be placed on file.
Haen presented the Dam, Park and Rec Committee meeting
minutes of October 10, 2001. Discussion followed on tarps to cover
portions of the infields. Schley will check on the possible donation
of 10 tarps from Shore to Shore which may be suitable for covering.
The minutes were accepted and will be placed on file.
CONTINUED/PENDING BUSINESS:
Walker ‘n Peterson Road Status:
Zipperer reported that we are awaiting one more application from the
County and have not received final billing as yet. A payment of
$25,000 was made to DeGroot. Once we have the grand totals, we will
be negotiating with them on the final amount due.
Website Update:
Discussion as to what information will be included on the website.
Wait has received and installed the necessary software for uploading
and downloading documents to the site.
Whitefish Bay Dock Feasibility Funding:
Zipperer reported that the DNR has received our application and it has
been assigned to the Sturgeon Bay office. The hearing will probably
be held in December or January on the cost share of approximately
$11,650 through the Coastal Management Program.
Bosman Parcel Donation:
Zipperer reported that we had received a letter from Attorney Nesbitt
indicating that it is unlikely that the Town would be able to obtain
title insurance on this strip of property because of conflicting
claims of ownership, and that acceptance of this property may present
a future problem. Wait will do a title search on the properties
involved and it will be brought back at the December meeting.
NEW BUSINESS:
Recycling Center Renovation:
It appears that there will be some new roads for the recycling center.
The site is under the control of Waste Management.
Placement of County Board Meeting Video – Sevastopol School Library:
The request has been withdrawn at this time by resident Supervisor
Charles Jarman.
Zoning & Planning Committee Recommendations:
Alan Meikle has requested a grant of variance to rebuild a
portion of a structure, which falls within the road setback
requirements. It was the Committee’s recommendation to approve the
variance request.
The Committee recommended to approve an application for a
conditional use permit filed by Antonia Tomjanovich to conduct
contractor/building trade from property she is selling to Steven
Laubenstein.
Thelma Markham requests a grant of variance to confirm her
ownership of two separate tracts on Pine Tree Road. The Committee
recommended approval.
Margaret Dreutzer petitioned for a grant of variance to
reconfigure four existing lots on Whitefish Bay Road.
Olsen will notify the Door County Planning Department of the
Committee’s recommendations.
Certification of State & County Property Taxes and Charges:
Detailed statement of all state and county taxes and charges to be
raised in the County of Door for calendar year 2001.
Tax Levy Certification – Sturgeon Bay School District:
Statement of amount to be assessed to the Town of Sevastopol for
2001-2002 school year - $635,238.
NWTC - Tax Levy Information:
Statement of amount to be assessed to the Town of Sevastopol -
$751,537.11.
Tax Levy Certification – Sevastopol School District:
State of amount to be assessed to the Town of Sevastopol for 2001-2002
school year - $2,409,568.87.
Tax Levy as Approved at Special Town Meeting:
Resolution No. 01-01T “Adopt Tax Levy” was approved November 19, 2001
to adopt the 2001 Town Tax Levy to be paid in 2002 at $456,104 and
projects a total expenditure of $812,246.
Wis DOR – PMS Aid Estimate:
We received a building inventory listing detailing all state owned and
occupied facilities in our municipality and calculations on Payment
for Municipal Services (PMS) aid, which includes the categories of
police/fire protection and waste/recycling services.
Door County Planning – Request for Assessor’s Plat – Whitefish Bay
Subdivision:
Zipperer read in its entirety the 11/20/01 correspondence from Door
County Planning Department requesting the Town’s review and response
to the assessor’s plat proposal. Discussion followed. Motion by
Olsen and seconded by Schley that the Town not pursue an assessor’s
plat on the Whitefish Bay/Bark Road area and leave it up to the County
Planning Department. Further discussion. Motion carried.
Door County Planning Department – Construction Permits:
The building permits for September/October 2001 were accepted and
placed on file.
Independent Inspections Ltd. – Town Building Permits:
The building permits and recap for October 2001 were accepted and
placed on file.
Resolutions:
Resolution No. 05-01TB – Establish Tax Rate 2002. Motion by
Olsen and seconded by Haen to adopt the “Town Budget” and establish
the tax (mil) rate at $1.20 for the year 2002. Motion carried.
Resolution No. 06-01TB – Door County Zoning Amendment
Ordinance 11-01 “Residential Neighborhood Signs.” Zipperer explained
that the Door County Board of Supervisors passed an amendatory zoning
ordinance which would allow the placement of a residential
neighborhood sign not more than 100 feet from the entrance, with
permission of the neighboring property owner. Discussion followed.
Schley moved and Olsen seconded to disapprove of such an amendment.
Vote: aye-2; nay-3. Motion defeated. Motion by Haen and seconded
by Worrick to approve the amendment to Ordinance 11-01. Vote: aye-4,
nay-1. Motion carried.

Special Report: None.
Announcements:
Holding tank permits were issued to Jeff Feurstein (Bay
Shore Drive) and Steven Gerndt (Bay Shore Drive).
