BOARD OF SUPERVISORS' MEETING-MINUTES

 Call to Order:  Vice Chair Tom Girman called the meeting to order at 7:00 p.m.

 Pledge of Allegiance:  The Vice Chair asked all to rise and join in the Pledge of Allegiance.

 Roll Call/Quorum:  Answering the call were Vice Chair/Supervisor Tom Girman, Supervisors Chuck Tice, Dan Woelfel and John Staveness.  Chairman Leo Zipperer was excused.  Also in attendance:  clerk/treasurer Linda Wait, Laddie Chapman, Paul Schumacher, Dennis Connolly and Brett Temme.

 Meet ‘n Greet – Public Participation.

• Schumacher expressed his appreciation to the town board and crew for attending to the Clark Lake dam.

• Wait acknowledged the following contributions:  to Carl Scholz for replacing a broken cedar tree along the fence line of the parking lot; to Judi Dexheimer, Holly Kohls and Paul Wickmann for their donated time to help stuff, seal and stamp the 3800 tax bills; and to the PFM Group (town’s debt refinance facilitator) for the coffee gift box.

•  Staveness thanked Paul Schumacher, Bob De Faut, Bill Hebal and Armand Tipler for their work at the boat ramp, including gravel and grading in preparation for the ice fishing season.

 Special Presentation:  7:10 pm Door County Today.  John Nelson provided background on the newly formed Door County Today show and its purpose to better market business in Door County, including Sevastopol.  John is also with Door Guide Publishing, publisher of the Go Guide, Dining Guide and other Door County promotional magazines designed to attract tourists.  The Door County Today show is produced once a month (hoping to eventually be twice per month) and features the unique attributes of the County, including the arts, nature and local talents.  John is hoping to get the promotional “tent cards” into local lodging establishments, and plans to include Sevastopol’s station 986 in the print.   He felt Sevastopol also had some rich stories to tell on such topics as maple syrup, farming and the Whitefish Dunes.  John expressed his thanks for allowing Door County Today to appear on our cable channel.  It is also available online and on YouTube.

 Agenda/proper notice/adopt.  Motion by Tice and second by Woelfel to adopt the agenda.  Motion carried.

 Approval of Minutes:  Motion by Staveness and second by Tice to approve the Board of Supervisors’ minutes of November 21, 2011.  Motion carried.

 Financial Reports:  The financial reports for November 2011, including account balances, budget vs. actual and transaction list, were accepted and placed on file.

 Approval of Vouchers / Bills / Claims.  Motion by Tice and second by Staveness to approve the vouchers, bills and claims for the period November 22, 2011 – December 19, 2011.  Motion carried.

 Oral Committee Reports & Committee Minutes.

• Girman stated that the Fire/Rescue Services Committee will be meeting the second week in January with a consulting firm to review the existing contract for fire protection services and a tour of the town to look at structures, access roads, etc.

• Tice reported that 40 Sevastopol businesses currently continue to report room tax.  October tourism is down 4.5% compared to October of last year but is up about 1% year to date.  Sevastopol has collected $66,465 through October 2011.

• The Plan Commission minutes of  10/19/2011 were accepted and placed on file.

 Pending Business/Status:

1)  Dog & Animal Control Ordinances.  Tice is reviewing and re-writing to more closely follow State statutes and County ordinances, eliminating issues that would need to be enforced by the town.  Exotic animals might be an item to address.  The matter will be brought back next month.

 2)  Schauer Road.  Girman reported that the cutting of dead and other trees within the 18-foot right of way has been accomplished.  The road has been temporarily closed and should reopen on Wednesday.  Gravel and breaker-run will be put down and the road allowed to settle.  Paving will take place in the spring of 2012.  Financial contributions from Door County Parks, the Wis DNR and state grants are anticipated.

 3)  Certificate of Liability Insurance.  Girman recapped the recommendations from our auditor and insurance carrier to obtain certificates of liability insurance from independent contractors and others who perform work on town property.  They recommend a minimum of $1 million.  The matter will be brought back in resolution form in January 2012.

 1)   Independent Inspections, Ltd.  Girman and board members reviewed the renewal contract, which is essentially identical to the current contract, except for the addition of one sentence, page 2, first paragraph, “The rights and obligations under this paragraph shall survive any expiration or earlier termination of this Contract.”   There have been no changes to the fee schedule.  Motion by Woelfel and second by Staveness to renew the one year contract for services with Independent Inspections, Ltd., under the terms as presented.  Motion carried, unanimously.

            Building inspector Brett Temme provided an end of year summary, indicating that permits for five new homes were issued, compared with the previous year’s nine and 22 new home permits issued in 2008.  There was one commercial addition at C&W auto.  The other 163 permits appear to be split between additions and remodels, with lots of service upgrades due to wind and storm damage.

 Old Business, continued.

4)  Cable Channel Program Director.  Laddie Chapman provided a written summary of Sevastopol’s public/education/government (PEG) channel operation.  In his presentation, he explained the proposed equipment purchases for 2011, which includes a new camera, tripod and accessories at a cost of approximately $6,900.  A new video server is proposed for 2012.  Laddie also reviewed the video sources that are broadcast, with approximately 25% coming from Sevastopol community events.  Connolly has assisted and narrated a variety of shows and said it was a pleasure to share the living history that goes on in Sevastopol.  The cable channel also allows viewers and constituents the opportunity to see meetings where issues and responsibilities are addressed.  Girman thanked Dennis for his charitable assistance.

 New Business – Discussion & Action:

2)   Program director/Videographer renewal of contracts.  Girman indicated the contracts are the same as last year, except that compensation to Chapman, as an independent contractor, shall be $531 per month.  Tice raised some question on description of the services to be performed and Woelfel suggested a “back up” plan be put in place in the event the program director was not available. There was discussion on the capacity of the Drobo storage unit and if it was adequate.   Motion by Tice and second by Staveness to renew the Independent Contractor Agreement, with clarification on the monthly fee, and to renew the Videographer Agreement for one year through December 31, 2012.  Motion carried, unanimously.

 3)   Road Management System, January 2012 – Implement a sign maintenance program.  The response from WTA legal counsel indicates that the “Road Management System” is still a requirement, with a sign maintenance program to be established by January 2012.  Girman recapped the maintenance requirements and compliance dates.  By January 2015, all agencies must comply with the new retro-reflectivity requirements, including all “regulatory” (such as stop and speed limit) signs, yellow and black “warning” signs, and ground mounted “guide” signs.  By January 2018, overhead guide signs and all street name signs must also comply with the retro-reflectivity requirements.  Motion by Woelfel and second by Girman to adopt Resolution No. 11-2011 TB “Adoption of Road Management System.”  Motion carried, unanimously.

 4)  Elimination of Local Government Holding Tank Agreement.  Board members reviewed Door County Sanitarian John Teichtler’s correspondence of November 16, 2011 on the proposed elimination of local government holding tank agreements.  The Door County Board of Health will meet on Thursday, January 12, 2012 at 4:00 pm and this item will be discussed and a decision made at that time.  Girman summed up the current agreement and servicing contract that Sevastopol requires for the installation of a holding tank. Wait had a conversation with Teichtler and was informed that under the proposal, the County would be responsible for enforcement, clean up, health hazards and compliance.  The matter shall be brought back in January, based on how the Sanitation Department rules on January 12th.

 5)  Associated Appraisal agreement for assessment services.  Girman said the current agreement is based on a one-year term and automatically renewable; the new contract proposes a 5-year term with price protection.  In the event that the town may be required to join a county or state assessor plan, Attorney Nesbitt suggested a sentence be added to terminate the agreement should the town be required to join such a plan.  Girman believed that should we decide to go with the 5-year contract, Associated would accept it at any time.  Wait will contact the City of Sturgeon Bay, who also employs Associated Appraisal, to compare contract terms. 

 6)  Expansion of Public Transit Services in Door County.  Door County Social Services Director Roger Tepe correspondence of November 28, 2011, outlines the proposal to expand public transit services.  Expansion of the south service area will include the entire towns of Nasewaupee, Sturgeon Bay and Sevastopol.  Creation of a new north service area will include the villages of Ephraim and Sister Bay, all of Gibraltar and portions of Liberty Grove.  Girman indicated the matter is here for your information.  Woelfel and Staveness expressed concern that expanded programs may require local funds.

Resolutions:

Resolution No. 10-2011 TB “Appointment of Election Officials.”  Motion by Tice and second by Staveness to approve Resolution No. 10-2011 for the appointment of election officials for the term beginning January 1, 2012 and ending December 31, 2013.  Attachments to the resolution include nominees submitted by the Door County Republican Party, Democratic Party of Door County and alternate/unaffiliated persons submitted by the town clerk.  Motion carried.

Resolution No. 11-2011 TB “Road Management System” – see Item 3, above.

Correspondence.  The following correspondence was accepted and will be placed on file:

• Charter Communications 3rdquarter 2011 franchise fees - $6,327.76 and breakdown of revenues.

• Notice of special assessment to fund interest payments on Wisconsin’s unemployment insurance.

• Statement of Assessment for 2011 - $711,290,200 total value of land and improvements.

• Notice of valuation on manufacturing personal property - $63,800.

• Final 2011 shared revenue & expenditure payment - $41,218.88.

• WTA Urban Towns Committee – membership application, no action taken.

• Door County Advocate will sponsor an online “community page” which will post local events and happenings.

• Independent Inspections, Ltd. billing recap for November 2011.

• Door County zoning permits issued for November 2011.

• Door County Planning Department – notice of next educational session January 31, 2012 – 5:30 pm on the topics of zoning map amendments and text amendments, along with sample Board of Adjustment decision-making worksheet.

• Thank you from Jane Moeller on behalf of Whitefish Bay Association and Peninsula School of Art for use of town hall in December.

• Wisconsin Citizens Safe Wind Siting Guidelines and status of wind turbine siting rules.

• Tice reported $7,678.30 to be received from room tax dollars for October 2011.  Also, if you are interested in donating mittens or lightly used/new gloves toward the “Great Lakes Mitten Campaign,” they can be dropped off at the Door County Visitor center at 1015 Green Bay Road.  A debate between Wisconsin and Michigan as to which state looks more like a mitten has spurred the campaign.
