BOARD OF SUPERVISORS' MEETING – MINUTES
Date: Monday, February 15th2016 - 7:00 p.m.
Location: Sevastopol Town Hall Meeting/Community Room
4528 State Highway 57 (Institute), Sturgeon Bay, Wisconsin
Call to Order. The meeting was called to order by Vice Chairman Dan Woelfel at 7:00 p.m.
Roll Call/Quorum. In addition to Woelfel, the following Board members were present and constitute a quorum: Supervisor Tony Haen, Supervisor Chuck Tice and Supervisor John Staveness. Chairman Leo Zipperer was excused.
Woelfel asked all to rise and join in the Pledge of Allegiance.
Meet ‘n Greet – Public Participation. Following introduction of Board members, also present: Clerk/Treasurer Linda Wait, Jim Kerscher, Randy Leist, Richard Weidman, Jim Lutzen and Videographer Pat Judy.
Tice mentioned that the Tall Ships will be coming back to Door County in August, with the Door County Visitor Bureau sponsoring the Norwegian “Dragon Harald Fairhair Viking” longship.
Agenda/proper notice/adopt. Motion by Haen and second by Tice to adopt the agenda, with deviation to Kerscher matter. Motion carried.
Approval of Minutes. Motion by Staveness and second by Tice to approve the Board minutes of January 18, 2016. Motion carried.
Financial Reports – January 2016. Motion by Tice and second by Staveness to accept the financial reports for January 2016, including fund balances, budget versus actual YTD and transaction list. Motion carried. Wait reported that the Schenck personnel will be in the office on Friday to audit 2015 financial records.
Oral Committee Reports & Committee Minutes. The following minutes were accepted to be placed on file: Plan Commission of 12/17/2015 and 2/11/2016; Door County Tourism Zone Commission/Committee of 12/17/2015.
Tice reported on final numbers for 2015 room tax collections:
Total Door County lodging revenues $75,876,813
Total room tax collected Door County $ 4,130,827
Disbursed to DCVB for promotion/expenses $ 2,726,346
Disbursed for administrative expenses $ 165,233
Sevastopol lodging revenues $ 289,239
Sevastopol 30% room tax received $ 86,772 (7.9% increase over 2014)
A. Kerscher Revocable Trust – petition for variance on side lot setback / structure
addition - 5434 West Shore Drive / Parcel No. 0220304282711F.
Staveness reported that the Plan Commission reviewed the matter on February 11 and were in support of the petition. Jim Kerscher (owner) and Randy Leist (contractor) explained the proposal to add a second story addition to the western half of the existing cottage. That corner of the existing footprint falls within the 10-foot side yard setback. In that there are already rooms on the second floor, this addition and dormers would heighten the ceiling and allow for more usable space. There was one item missing from the zoning materials; that has been received now and does not have any negative impact on the Plan Commission’s recommendation for support. Kerscher also said that the septic system is properly sized.
Motion by Staveness and second by Haen to forward a recommendation of support to the Door County RPC based on the following: footprint is not expanding or changing, increased livable space without adding to footprint, addition of dormers would improve the appearance similar to neighboring property, parties not aware of any objections from neighbors and addition does not block views. Motion carried, unanimously.
Licenses & Permits. Door County zoning permits and SAFEbuilt building permits for January 2016 were accepted to be placed on file.
A. 2016 meeting schedule. Final dates submitted; pending date for May road inspection and possible change in October dates.
B. Clark Lake shoreline damage claims. Rural Insurance correspondence reports that the timeframe for claimants to pursue claims through litigation has expired, thus eliminating the Town’s exposure.
C. Friends of Whitefish Dunes State Park – request for donation. Continued discussion on the Friends’ request for donation towards purchase of an ATV/gator for use on park trails. Consensus that if the Friends purchased the equipment, it would remain under their ownership and not turned over to the park. Visitors to the park are of benefit to our community and perhaps a modest donation might be available if unused funds from the 2015 budget were available to carry forward. The Board had previously requested an estimate on the cost of the machine. The matter was tabled pending receipt of the estimate and 2015 bottom line financials which would be presented at the annual meeting on April 19.
D. Lutzen / Ripp Road water runoff. Lutzen repeated his concerns on his water drainage problem. Woelfel responded that the Door County Highway Superintendent will look at the area again this spring and convene a meeting, at which time the neighbors, Board members and anyone else would be welcome to attend and settle the matter.
E. Gerhart at 4371 STH 57. The parcel has been granted a change in zoning from Countryside (SC) to Single Family Residential 20,000 (SF20).
F. Muskat property at STH 42/57 split. Woelfel reported that he did have an open and pleasant telephone conversation with Nikki Henkin, one of the property owners. Henkin gave verbal permission to enter upon the property and asked if the barns might be a candidate for a “training burn” by the fire department. Woelfel asked for written confirmation before proceeding. Since Henkin lives in New York and is unfamiliar with the area, she will be mailed some complimentary information about the Sevastopol community and the Door County Coastal Byway.
New Business, continued.
B. Door County Planning Department – petition for zoning amendment to switch existing wetland zoning district to an “overlay” district. Staveness reported that the Plan Commission tabled this matter pending more information. In summary, the wetland zoning map amendments basically would not change anything out in the field and the overlay would fill in any pockets or gaps left from DNR determinations. Woelfel said the Town has usually gone along with Planning Department and Plan Commission recommendations and he would support that. Haen will plan to attend the Open House on February 16thand bring back a report for the Plan Commission. The matter will be brought back in April or May. In the meantime, the Plan Commission can send a recommendation if it chooses to do so. Perhaps one of the zoning administrators would be willing to make a presentation at an upcoming meeting to provide status reports on wetlands, shoreland and other zoning topics.
C. Authorization for payment of March 2016 vouchers/bills/claims. Motion by Tice and second by Haen to approve the timely payment of vouchers, bills and claims in lieu of a March 2016 Board meeting. Motion carried.
D. Principal and interest payments due on town hall debt service. Principal payment of $95,000 and interest payment of $5,315 are due on March 1, 2016. The loan will be paid in full as of March 1, 2019. Wait will check on better interest rates for designated funds.
E. Board of Review training requirement / compliance. Wait will order the Board of Review training DVD ($32) and members can view at their convenience. At least one member is required to complete the training requirement prior to convening the 2016 Board of Review.
F. Room tax and annual reporting. Every municipality that imposes room tax must file an annual report with the Wisconsin Department of Revenue. The reporting will not take effect until May 1, 2017. Each March, the Door County Tourism Zone Commission will work with the municipalities in compiling the required information so that report may be timely e-filed.
G. Clerk/Treasurer – status. With the impending retirement of Wait, the full time clerk/treasurer job position will be advertised. Interested persons should respond with resume and salary requirements by May 1, 2016. Tentative start date would be June 15, 2016. It is anticipated that the new hire would attend the 2016 Clerks & Treasurers Institute in Green Bay on July 10-15, 2016.
Approval of Vouchers / Bills / Claims. Motion by Tice and second by Staveness to approve the vouchers, bills and claims for the period January 19, 2016 through February 15, 2016. Motion carried.
Correspondence. The following correspondence was accepted to be placed on file:
• Wisconsin Department of Administration – $939.27 received toward police & fire services provided to state facilities.
• Door County Planning – conditional use permit issued to Mike Kahr/5039 CTH P for marine construction home business, with conditions are recommended by Plan Commission and Board.
• Sturgeon Bay Fire Department – January 2015 fire report
• Office closed: February 21-29 for clerk vacation
• Spring Primary election – Tuesday, February 16th, polls open 7:00 a.m. to 8:00 p.m.
• Spring election – Tuesday, April 5th, polls open 7:00 a.m. to 8:00 p.m.
• Annual Town/Board meetings – Tuesday, April 19thbeginning at 6:00 p.m.
• Tice reported that Wisconsin Towns Association will be hiring a new attorney to replace Lee Turonie.
• Tice reported that recent legislation changes allow a municipality to sell up to three alcohol beverage license to a contiguous municipality.
