BOARD OF SUPERVISORS' MEETING – MINUTES
Date: Monday, December 21, 2015 – 7:00 p.m.
Location: Sevastopol Town Hall
4528 State Highway 57, Sturgeon Bay, Wisconsin
The meeting was called to order by Chairman Leo W. Zipperer at 7:00 p.m.
Roll Call/Quorum. In addition to Chairman Zipperer, the following Board members were present and constitute a quorum: Supervisor John Staveness, Supervisor Dan Woelfel, Supervisor Chuck Tice and Supervisor Tony Haen.
The Chairman asked all to rise and join in the Pledge of Allegiance.
Also present: Linda Wait-Clerk/Treasurer, Laddie Chapman-Cable Program Director, Brett Temme-building inspector, residents Richard Baudhuin, Joan Baudhuin and Mike Kahr.
Agenda/proper notice/adopt. Motion by Tice and second by Staveness to adopt the agenda, as noticed, with a request to move forward Item XI, A. Kahr. Motion carried.

A. Mike Kahr– application for conditional use permit at 5039 CTH
to establish home business – operate marine construction business
Staveness reported that the Plan Commission went over this request on December 17, 2015, with Kahr in attendance. Although Kahr had been granted a CUP in 2013, he was unable to accomplish the project due to weather and other circumstances. Kahr has since purchased additional acreage, for a total of 40 acres around his proposed building, some of which is under a conservation easement. The Plan Commission sends a recommendation of support to the Town Board based on the following: there has been no zoning changes in the area since the original 2013 application, the Comprehensive Plan supports home businesses, the proposed building is far enough away from the road/maintains rural character, the conservation easement will control future development and that all seven conditions proposed in the Door County Staff Report of 11/20/2015 be made a part of the CUP. Tice reminded the applicant that the Town also has ordinances in place for the regulation of outside storage and unsightly premises, which include vegetative screening, fencing, outdoor storage of equipment and other activities, and Kahr would need to comply with those regulations, in addition to any conditions outlined in the CUP. Motion by Staveness and second by Haen to forward a recommendation of support to the Door County Resource Planning Committee, and to include the recommendations as outlined by the Sevastopol Plan Commission and the Door County Planning Department. Motion carried, unanimously.
Approval of Minutes. Motion by Staveness and second by Tice to approve the Board of Supervisors’ meeting minutes of 11/23/2015 and the special meeting minutes of 12/4/2015. Motion carried.
Financial Reports. Motion by Tice and second by Haen to approve the financial reports of November 2015, including fund balances, budget versus actual YTD and transaction list. Motion carried.
Committee Reports & Minutes. The following minutes were accepted to be placed on file: PEG/Cable Channel minutes of 9/10/2015, Plan Commission minutes of 11/19/2015 and 6/11/2015, and Tourism Zone Commission minutes of 10/15/2015.
Licenses & Permits. Recaps of Independent Inspections, Ltd. building permits and Door County zoning permits issued November 2015 were accepted to be placed on file.
A. Van Bellinger Notice of Claim. Zipperer reported that in response to a claim for damages by Daniel and Betty Van Bellinger and as a result of the special board meeting held on 12/4/2015, Town attorney Randy Nesbitt has forwarded a notice of disallowance of claim and correspondence proposing an offer to purchase all Van Bellinger property (approx. 0.22 acres) west of the creek at the Clark Lake dam. An update should be available next month.
B. Muskat property at 4115 STH 42/57. Woelfel reported that a second request for an inspection and update on the underground tanks was sent on 12/4/2015 to the property owners. A response was requested by 1/15/2016.
In a letter dated 12/10/2015, the Door County Coastal Byway Council would also like to see some appearance improvements at the 42/57 split location, since it is the gateway to the coastal byway.
C. Town Roads Improvement Program 2016-2017. Under the TRIP program for 2016-2017, Sevastopol has been awarded $18,840.99 to be used toward asphalt paving costs on West Dunn Road from Reynolds to Bay Shore.
E. 42/57 Highway Corridor. Zipperer attended the Local Officials’ meeting on 12/3/2015. Construction on the Bayview Bridge rehabilitation, roundabouts and restricted median is scheduled to begin in late March 2016.
B. Intergovernmental agreement with County of Door– new electronic voting system. With corrections to a few typographical errors, motion by Tice and second by Woelfel to approve the intergovernmental agreement outlining the responsibilities of the County and the Town with regard to the newly acquired Dominion ImageCast Evolution (ICE) equipment. Motion carried.
C. Cable program director/independent contractor and videographer agreements. Tice indicated that the renewal agreements are basically the same as previous, with some minor language changes. The one year contract covers the services, compensation per 2016 budget and terms for Laddie Chapman as cable station program director and videographer. Motion by Haen and second by Tice to approve the agreements. Motion carried.
D. Clerk/treasurer employment agreement. Motion by Haen and second by Zipperer to approve the appointed clerk/treasurer employment agreement for the year 2016, with compensation per the 2016 budget and subject to 30-day notice for amendments or changes. Motion carried.
E. Schenck SC– engagement letter for 2015 audit & financial statements. Motion by Woelfel and second by Staveness to approve the engagement of Schenck SC to provide the audit and financial reports for the year ending 12/31/2015. Motion carried.
F. 2016 meeting schedule. The draft will be brought back next month for fine tuning.
G. Local Room Taxsummary of changes. Tice provided overall collections and amounts remitted for YTD 2015. Sevastopol room tax collections YTD amount to $275,656 of which $82,697 represents the Town’s 30% share. Should collections exceed $300,000, Sevastopol would be allowed an additional member to the Door County Tourism Zone Commission. The DCTZC promotes all of Door County as a destination and as a whole. Individuals and businesses can join on and do cooperative advertising to promote their own event or activities.
Tice also reported on recent changes to local room tax that came about with Wisconsin’s 2015-2017 budget and Act 55. There are some new definitions and reporting requirements beginning in 2017, including that a municipality must file required annual room tax reports with the Department of Revenue.
H SAFEBuilt Wisconsin, LLC. Building inspector Temme explained that Independent Inspections, Ltd., has been acquired by SAFEbuilt Wisconsin, LLC. All Wisconsin inspectors will remain on board and the fee schedule remains the same as last year. SAFEbuilt has already put in some new infrastructure with new vehicles and new computers with entry and tracking capabilities. Procedures and personnel will remain the same for our community. Zipperer, Tice and Wait had the opportunity to meet SAFEbuilt building operations manager DA Mattox last week. The company also provides planning tools and code enforcement. Motion by Tice and second by Woelfel to approve the professional services agreement between the Town of Sevastopol and SAFEbuilt Wisconsin, LLC. Motion carried.
Approval of Vouchers / Bills / Claims. Motion by Staveness and second by Tice to approve the vouchers, bills and claims for the period November 24, 2015 through December 21, 2015. Motion carried.
Ordinances and Resolutions:
• Resolution No. 06-2015 TB. Motion by Tice and second by Staveness to approve Resolution No. 06-2015 TB “Appointment of Election Officials” per the list attached for the term 2016-2017. Motion carried.
• Driveway Ordinance Draft – Town of Forestville. In an effort to have uniformity among the municipalities, board members will review Forestville’s ordinance and others, take a look at driveways while out on the next road tour and bring the matter back for future discussion.
Correspondence. The following correspondence was accepted to be placed on file:
• Sturgeon Bay Fire Department – October 2015 fire report
• Lakes Gas Co. – tips and precautions for the heating season
• Wisconsin DNR – notice of grant from Knowles-Nelson Stewardship program and acquisition by The Nature Conservancy of 32 acres. Despite inquiry to the DNR, no information was provided as to parcel number, location or owner.
• Board of Supervisors’ meeting – January 18, 2016 at 7:00 p.m.
• Office closed January 20-23, 2016
