BOARD OF SUPERVISORS' MEETING MINUTES Monday, June 25, 2007 - 6:00 p.m. Meeting Room, Modular Building at Sevastopol Schools 4550 STH 57, Sturgeon Bay, Wisconsin Call to Order: Chairman Leo Zipperer called the meeting to order at 7:00 p.m. Pledge of Allegiance: The Chairman asked all to rise and join in reciting the Pledge of Allegiance. Establish Quorum/Roll Call: Roll call was taken. Chairman Leo Zipperer, Supervisors Chuck Tice, Dan Woelfel, John Staveness and Clerk/Treasurer Linda Wait were in attendance. Supervisor Tom Girman was executed. Citizens Concerns: None Presentation of Agenda/Properly Noticed: The Clerk stated that the agenda was properly noticed. Motion by Staveness and seconded by Woelfel to adopt the agenda, as proposed. Motion carried. Correspondence: 1) Updated pages of the Door County Zoning Ordinance reflecting changes to zoning districts in the Town of Liberty Grove. 2) Public Service Commission of Wisconsin notice of rescheduling technical conference on Strategic Energy Assessment. 3) Wisconsin Department of Revenue manufacturing real estate and personal property assessment roll for 2007. 4) Notice of Timber Cutting - Roger Bochek. 5) Managed Forest Law Transfer Order - Charles Jarman to Mark Jarman, 55 acres. 6) Letter from Ray Spangler in opposition to building wind turbines. 7) U.S. Department of the Interior Fish & Wildlife Service - Hine's emerald dragonfly critical habitat proposal and analysis. 8) Supply of brochures on the Door County Registry Program for Propane Tanks and Distribution Systems. 9) Letter of thanks from Door County Soil & Water Conservation Department for $1,000 contribution toward the beach contamination source identification project. 10) Sturgeon Bay Fire Department – May 2007 Fire Report. 11) Door County Planning Department – zoning permits issued for April-May 2007. 12) Independent Inspections, Ltd. - Billing recap for building permits issued May 2007. By consensus, all correspondence was accepted and will be placed on file, without any item being referred to a specific committee for further review or action. Minutes: Motion by Tice and seconded by Woelfel to approve the minutes of the Board of Supervisors’ meeting held on May 21, 2007. Motion carried. Motion by Woelfel and seconded by Staveness to approve the minutes of the initial Board of Review held on May 21, 2007. Motion carried. Clerk/Treasurer Monthly Reports/Vouchers/Bills/Claims: Motion by Staveness and seconded by Tice to accept the treasurer’s report for May 2007, and payment of vouchers, bills and claims. Motion carried. Oral Committee Reports: Comprehensive Plan Committee: Staveness reported that the Mid-Course Mapping meeting has been rescheduled to Thursday, June 28th, beginning at 6:30 p.m. at the Institute Saloon. Everyone is welcome to attend and participate; please spread the word to your neighbors. Committee Minutes: Motion by Woelfel and seconded by Staveness to accept the following minutes and place on file: Comprehensive Plan Committee minutes of April 19, 2007 and April 26, 2007; Building and Property Committee minutes of April 24, 2007. Motion carried. Pending Business: 1) Comprehensive Plan. See Oral Committee Report, above. 2) Tourism Zone Commission Agreement and Tourism Entity Agreement. Tice reported that the Commission continues to hold bi-monthly meetings. It is expected that the Town of Washington will be joining in August, with the Town of Sturgeon Bay reconsidering its decision not to participate and there is also good dialogue with the City of Sturgeon Bay. Tice stated that $11,500 in room tax had been collected for May 2007. Kerber & Rose provides the bookkeeping and recordkeeping services and is working with the bank to establish an electronic payment system. Members are in the process of sifting through property owners who may be subject to room tax. The marketing seems to be in place, with advertisement hiring to start as soon as funds are available. The next meeting is scheduled for the morning of June 28th here at the Town meeting room. New Business: 6:15 p.m. Chairman Zipperer explained the process to call a Special Town Meeting and recapped the allocation, previous discussions and budgeting for the building fund. The meeting has been properly noticed through posting and publication, with an agenda, for the sole purpose of discussion and directive to the Town Board on the purchase of property. Motion by Woelfel and seconded by Tice that the Special Town Meeting be called to order at 7:00 p.m., as noticed. Motion carried, unanimously. Pending Business: 3) Amendment to "Town and Private Road Standards." The matter was tabled to next month. 4) State/Municipal agreement for STH 57 project (from The Mill north to 800 feet past intersection with CTH P scheduled for 2009). Zipperer indicated the DOT would be seeking a $4,883 contribution from the Town for paving of parking lanes and the Town seeks a credit adjustment for previous tree damage to the Town park fence along STH 57. The matter was tabled to next month. 6:20 p.m. New Business: 2) Road Work 2007. Zipperer stated that notice was published to solicit quotes or proposals for roadwork and maintenance for 2007. Road identification and specifications were made available at the Town office and those who provided sealed bids or estimates were notified of the change in the Board meeting date. Present were Tom Ash of Northeast Asphalt, Inc., and John Kolodziej, Commissioner of the Door County Highway Department. Zipperer proceeded to open the sealed bids received from Fahrner Asphalt Sealers, LLC and Northeast Asphalt, and the estimates from Door County Highway Department. Motion by Staveness and seconded by Tice to accept the bids and estimates. Motion carried, unanimously. Zipperer stated that Fahrner did not meet the bid requirements, as it provided chipseal specifications only. Motion by Tice and seconded by Woelfel to not consider Fahrner Asphalt Sealers, LLC. Motion carried, unanimously. Motion by Tice and seconded by Staveness to award the 2007 roadwork to the Door County Highway Department. Motion carried, unanimously. 3) Renewal Applications for Alcohol Beverage License. A listing of the beverage license renewal applications is attached, along with class of alcohol license, seller's permit number and cigarette license applications. Following discussion, motion by Staveness and seconded by Tice to approve the renewal applications, as attached, for the period July 1, 2007 to June 30, 2008, conditioned upon compliance with Department of Revenue alcohol beverage laws as prescribed in Chapter 125, Wis. Stats., Ordinance 03-2007 TB, and payment of appropriate license fees. Motion carried, unanimously. Renewal license applications were not received from Duncan's Bay View, Ltd., and Suzanne Moore for Class B combination beer/liquor. Accordingly, these licenses shall revert back to the Town. 4) Street light relocation - Old Highway Road/Egg Harbor Road. Zipperer stated that the Town had paid for the original installation of this street light and the City of Sturgeon Bay has paid the monthly billing. Business owners in the area have asked for better lighting at this corner. Utilizing an existing telephone pole may be the most economical method of moving the light fixture. In light of anticipated work along STH 42-57, no action will be taken at this time. 5) Newsletter - next edition topics/articles. In keeping with our goal for bi-annual issues, Woelfel would like to get an issue out early August in hopes of reaching more of our seasonal residents. Suggested topics included Clark Lake swim buoys, phosphate awareness, elections, Sesquicentennial celebration, Comprehensive Plan, Town Hall progress and room tax. Anyone interested in submitted an article is asked to do so by mid-July. 6) Nuisance law. The matter will be brought back next month. [Recess at 7:00 p.m. to attend Special Town meeting of electors.] 7:35 p.m. Special Reports: Clark Lake Watershed Study. Paul Schumacher, President of the Clark Lake Advancement Association (CLAA), provided an updated report on the basics of Clark Lake and its watershed, which is located in the Towns of Jacksonport, Egg Harbor and Sevastopol. Paul included background information on the design of the study and lake residents' response to issues as having high, medium or low priority for action. The study was contracted with UW-Stevens Point, with assistance from the DNR, Nature Conservancy and Ridges Sanctuary. Key findings of the study included good buffers and practices in the watershed, classification as an excellent to very good water quality lake, designation as to sensitive sites, reduced water clarity due to suspended lake sediment and marl, characterization of good species of aquatic plants and changes in fish populations over the years. Paul reviewed future and present threats to conditions at Clark Lake, such as water quality and clarity, land and shoreline use and invasive species. A Planning Committee has been selected to identify key recommendations and there is a proposed plan to educate and encourage constituents of the watershed area to take an active role to protect the lake and watershed areas. Paul thanked the Town of Jacksonport and Sevastopol for their support of this study. [Brief recess at 8:16 - 8:20 p.m.] Resolutions: Resolution No. 11-2007 TB "Phosphate Awareness to Improve Water Quality," with informational addendum. This ordinance was submitted by Citizens Charles Jarman, Pat Miller and Bob Stracka, and Supervisor Woelfel to support the ban/reduction on sale and use of lawn fertilizers and dishwasher detergents containing phosphorus. Motion by Woelfel and seconded by Staveness to approve Resolution No. 11-2007 TB. Motion carried, unanimously. Resolution No. 12-2007 TB "In support of Schauer Park Project - Town of Jacksonport." Zipperer stated that this matter will be brought back to the County Board, as it appears some funding is now available. The Town of Sevastopol and its Dam, Park & Rec Board support the effort for a proposed Schauer Park launch facility and extends an offer to share with the Town of Jacksonport the costs for a feasibility study. Motion by Staveness and seconded by Woelfel to approve Resolution No. 12-2007 TB. Motion carried, unanimously. George Bagnall, Chairman for the Town of Jacksonport, was present and wished good luck with this project. Resolution No. 13-2007 TB "In recognition of the Sevastopol High School Pioneer Girls Fast Pitch Softball - Champions Division III - 2007." Zipperer read in its entirety this resolution addressed to the Sevastopol Pioneers team, coaches, school, parents, family and friends. In recognition of the Pioneer girls and their success at State finals, they are thanked for the pride they bought to their school, family and community and honored for their effort, dedication and hard work to earn the title of "Division 3 Girls Fast Pitch Softball State Champions - 2007." Heather Fellner-Spetz was also noticed for her 12 years as head coach, with special thanks to parents and all others who played a role in the continued success of Girls Fast Pitch Softball at Sevastopol Schools. Motion by Tice and seconded by Staveness to approve Resolution No. 13-2007 TB. Motion carried, unanimously, with applause.
