BOARD OF SUPERVISORS' MEETING MINUTES
Monday, April 18, 2005 - Meeting Room behind Sevastopol Schools 
4550 STH 57, Sturgeon Bay, Wisconsin

Call to Order:
Chairman Leo Zipperer called the meeting to order at 7:00 p.m. 

Establish Quorum/Roll Call:
Roll call was taken.  Chairman Leo Zipperer, Supervisors Tom Girman,
Jo Ann Schley, John Staveness, Dan Woelfel and Clerk/Treasurer Linda
Wait were in attendance.

Door County Sheriff's Department-Deputy Report:  None.

Citizen Concerns:   
Laddie Chapman presented an example and suggested the Town might be
interested in posting "Entering Town of Sevastopol" signs on the
roadways, similar to what the Town of Jacksonport has done.
Pat Miller asked about the status of Smart Growth and volunteers. 
Chairman Zipperer responded that it would be reviewed at the May
meeting.

Presentation of Agenda/Properly Noticed:
The Clerk stated that the amended agenda was properly noticed.  
Motion by Schley and seconded by Staveness to adopt the agenda. 
Motion carried.

Correspondence:
1)  From the Door County Planning Department, updated pages of the
Door County Zoning Ordinance relating boat launch facilities.
2)  From Door County Planning Department, notice of informal
site-plan review meeting to be held on Tuesday, April 19th at 5:15
p.m., Door County Courthouse.  Choice, Inc., has applied to establish
a farm market at 4594 County HH, proposed to be located in an existing
building.  
3)  Zoning Text Amendment regarding Town halls/community centers
(Town of Union, only).
4)  Zoning Text Amendment regarding public boat launch
facilities-impervious surface ratio.
5)  Notice and request for support of 2005 Door County Legislative
Days scheduled for May 4-6, 2005 in Madison, along with 2003 Door
County Legislative Day Summary of Results and Progress. The committee
is currently working to develop the agenda for local issues and
concerns that will be presented to state officials.  Anyone interested
should contact Committee Chair Rob Burke.
6)  Notice of Timber Cutting-Michael Williams.
7)  Department of Natural Resources-printouts of land enrolled in
Forest Crop Law (FCL) and Managed Forest Law (MFL).
8)  Department of Transportation-notice of roadway maintenance and
preservation project on STH 57, from 42/57 intersection north to
Brauer Road, anticipated construction 2008.
9)  Farmland Preservation-notice of relinquishments Mark Stephenson.
10)  Independent Inspections, Ltd.-Building recaps for February and
March 2005.
11) Door County Planning Department - Construction permits for
February and March 2005.
12) Wisconsin Towns Association-notice of renewal of dues and formula
modification/increase, and Town Officials Spring 2005 workshops.
By consensus, all correspondence was accepted and will be placed on
file, without any item being referred to a specific committee for
further review or action.  

Minutes:
Motion by Girman and seconded by  Woelfel to approve the minutes of
the February 21, 2005  Board of Supervisors' meeting.  Motion carried.


Clerk/Treasurer Monthly Reports:
Motion by Schley and seconded by Girman to accept the treasurer's
reports for February and March 2005 and place on file.  Motion
carried.  

Vouchers/Bills/Claims:
Motion by Staveness and seconded by Schley to approve the vouchers,
bills and claims for the months of February and March 2005.  Motion
carried.

Oral Committee Reports:  None.

Committee/Board Minutes:  
The Dam, Park and Rec Committee minutes of February 7, 2005 were
accepted and placed on file.

Pending Business:
1)  Sturgeon Bay Fire Department. The February and March Fire Reports
were received and reviewed.  There were 3 calls in February and 4
calls in March.

     In light of the several recent grass fires throughout Door
County, Sturgeon Bay Fire Chief Tim Herlache addressed issues and
concerns regarding burning permits.  He reminded residents to call the
Fire Department non-emergency number prior to burning, so that if
needed, they can respond to the location quickly.  Zipperer stated
that even though our burning permits are issued with the understanding
that the fire department is to be notified, people continue to forget
or neglect to do this. Permits will now be stamped, "Not Valid Without
Fire Department Approval."  
2)  Smart Growth.   Schley reported that several people have
volunteered to assist on an Ad Hoc Smart Growth committee.  The matter
will be brought back next month.
3)  Door County Soil & Water Conservation Department (SWCD):
Nonmetallic Mining Reclamation-NEA/PCI.  Notice of conditional
approval of Reclamation Plan, list of approved and accepted documents
for quarry operation, and condition to eliminate surface runoff.
4)  Building Permits - Enforcement and Fee Schedule.  Zipperer will
follow up with Brett Guillette, our inspector from II Ltd., on some of
the current problems.
5)  Newsletter.  Woelfel reported that the newsletter should be in
the mail this weekend or Monday.  Dan was commended for his efforts on
this project and  Laddie Chapman thanked for his work on the layout.

New Business:
1) Revaluation (RFP) for Year 2006.  The deadline for receiving
sealed proposals is Friday, May 6, 2005 at 5:00 p.m.
 
2)  Road Agreement - Town of Jacksonport re: Townline Road.  In order
to move forward with its Smart Growth compliance, the Town of
Jacksonport requested a formal agreement for maintenance of Townline
Road.  Motion by Schley and seconded by Girman to endorse the Townline
Road Agreement with the Town of Jacksonport.  Motion carried.
3)  Door County Outdoor and Refuse Burning and Fireworks Ordinance. 
Door County Corporation Counsel Grant Thomas submitted a draft
ordinance related to outdoor burning and fireworks.  Fire Chief Tim
Herlache said the ordinance would be used as an enforcement tool for
the County, along the same lines used by the State/DNR.  If the County
adopts this ordinance, citations can be issued for violations, if
warranted, usually on a complaint basis. Zipperer stated this matter
was before the County Board. There was discussion on burning barrels,
outdoor wood furnaces and construction site burning.  Motion by Schley
and seconded by Girman to endorse and go on record in favor of the
County adopting such ordinance.  Following further discussion, motion
carried (4-aye; 1-nay).  
4)  Alcohol Beverage License Applications:
	Sevastopol Dam, Park & Rec Committee.  Motion by Girman and seconded
by Schley to approve the application for Class B beer license for the
period May 1-October 31, 2005.  Motion carried.
	Institute & Valmy Athletic Club.  Motion by Staveness and seconded
by Woelfel to approve the application for Class B beer license for the
period May 1-October 31, 2005.  Motion carried.
	Glidden Lodge Restaurant, Inc.  Motion by Girman and seconded by
Staveness to approve the application for a combination Class B license
for the period May 1-June 30, 2005, subject to surrender of prior
license, confirmation of seller¡¦s permit and payment of fees.  Motion
carried.
5)  Marking Buoy - Whitefish Point.  A new shipwreck was recently
discovered 2-1/2 miles off Whitefish Point in Lake Michigan, the Ocean
Wave. The Wisconsin Historical Society would like to place a seasonal
mooring on the wreck of the Ocean Wave to help preserve it from
further damage and provide a safe access point for scuba divers. This
matter came before the Dam, Park & Rec Committee on April 4, 2005 and
installation of a mooring buoy was approved.  

Resolutions:   
Resolution No. 01-2005 TB Lauscher Road Status.  After discussion
with property owners and reviewing documentation, it was determined
that "Lauscher Road" was incorrectly identified and that the Town
holds no interest in such property. Due to lack of proper designation,
it was determined that the road remain in private ownership and be
removed from any official map of the Town, County or State, including
the Department of Transportation GTA map.  Betty Tipler stated that
she would prepare an ingress and egress easement for the benefit of
the property owners along "Lauscher Road" and have it properly
recorded.  Motion by Girman and seconded by Staveness to adopt
Resolution No. 01-2005 TB.  Motion carried.

Initial Board of Review - Monday, May 16th at 6:45 p.m. (immediately
adjourn to 8/22/05)
Board of Supervisors'meeting-Monday, May 16th at 7:00 p.m.

Special Report:
Linda Wait was congratulated for doing a fine job and dedicating her
time as Chairman of the Door County Unit of Wisconsin Towns
Association for the past two years.
All boards are in at the Clark Lake Dam.  The fish gates/fingers have
repaired and replaced, as needed.  Port-A-Pier anticipates installing
the boat ramp at Townline next week.
