BOARD OF SUPERVISORS' MEETING MINUTES
Monday, October 25, 2004

Call to Order:
Chairman Leo Zipperer called the meeting to order at 7:00 p.m. 

Establish Quorum/Roll Call:
Roll call was taken.  Chairman Leo Zipperer, Supervisors Tom Girman,
John Staveness, Dan Woelfel and Clerk/Treasurer Linda Wait were in
attendance.  Jo Ann Schley was absent.

Citizen Concerns:   
Laddie Chapman expressed his concerns regarding the reclassification
of Channel 19.

Pat Miller thought a newsletter would be an excellent idea and
suggested it include the entire Town and not just specific to the Dam,
Park and Rec Committee.

Charlie Jarman volunteered his experience and expertise in the areas
of land conservation and zoning for our Smart Growth planning.

Presentation of Agenda/Properly Noticed:
The Clerk stated that the agenda was properly noticed.  Zipperer also
noticed an amendment to the agenda to reflect specific items which
would be discussed under "New Business, Town Planning and Zoning
Committee Report."  Motion by Girman and seconded by Staveness to
adopt the agenda and amendment.  Motion carried.

Correspondence:
1)  Letter from Door County Corporation Counsel with request to
include "Notice to Dog Owners-Rabies Vaccinations and Dog License
Required" informational sheet with our annual tax statements.
2)  Letters from Clarks Lake Advancement Association advising of
shipments of 20,000 yellow perch fingerlings for a total cost of
$4,863.99, with request for our 2004 budgeted one-third payment of
$1,621.66 (total cost allocated among Towns of Jacksonport and
Sevastopol and the Association).
3)  Notice from Northern Door Communications advising of changes to
the EMS/VHF communications system in Door County.   Staveness advised
that our First Responder radios have been re-programmed and upgraded.
4)  Certificate of Insurance from Associated Appraisal Consultants
Inc. (informational only).
5)  Notice of Timber Cutting from Door County Clerk - Terry Poster,
5.4 acres.
6)  Notice of Informal Site Plan Review Meeting (11/10/04) before the
Door County Planning Department - Door County Parks
Department/Wisconsin Department of Natural Resources to construct
public boat launch at Olde Stone Quarry Park, with site plan.
7)  From Wisconsin Department of Administration - The final estimate
of the January 1, 2004 population for the Town of Sevastopol is
2,790.
8)  Public Service Commission of Wisconsin - Notice of Investigation
for WPSC application to issue long-term indebtedness.
9)  Notice of Drinking Water and Wastewater Funding Sources
Workshops.
10)  From the Natural Resources Conservation Service , information
and newsletter regarding the Glacierland Resource Conservation and
Development (RC&D).
The correspondence was accepted and will be placed on file, without
any item being referred to a specific committee.  

Minutes:
Motion by Staveness and seconded by Woelfel to approve the minutes of
the September 20, 2004  Board of Supervisors' meeting.  Motion
carried.

Clerk/Treasurer Monthly Reports:
Motion by Woelfel and seconded by Girman to accept the treasurer's
report for September 2004 and place on file.  Motion carried.

Vouchers/Bills/Claims:
Motion by Staveness and seconded by Woelfel to approve the vouchers,
bills and claims for the month of September 2004.  Motion carried.

Oral Committee Reports:.  
Fire/Rescue Services Committee:  Girman received a letter from
Sturgeon Bay Fire Chief Tim Herlache requesting that he be included in
future meetings of our Fire/Rescue Services Committee.  Girman
responded  that he will keep Chief Herlache informed  as to progress
in the Committee's efforts to seek means of reducing fire protection
costs without compromise to safety and quality of service. 
Discussions are ongoing with the Towns of Egg Harbor and Jacksonport.

Special Report:
7:30 p.m.  Karen Christenson, Executive Director of the Door County
Humane Society, provided some background on the Society.  It is a
private, not-for-profit organization and, except for a portion of dog
license fees,  privately funded. Municipalities are mandated to
provide care for stray animals and the DCHS would like to be under
contract with Towns and Villages to provide that service.  Following
further discussion, motion by Woelfel to disburse to DCHS the $1,000
as budgeted for 2004, conditioned upon DCHS providing a copy of its
bylaws (policy and procedures) and Board of Directors and Officers;
seconded by Staveness.  Motion carried.

Committee/Board Minutes:  The Dam, Park and Rec Committee minutes of
September 8, 2004,  the Planning & Zoning Committee minutes of
September 20, 2004 were accepted and placed on file.

Continued/Pending Business:
1)  Sturgeon Bay Fire Department - The September 2004 Fire Report was
received.
2)  Municipal Taxpayer Commission - No activity over the summer, as
legislators were not in session.  The next meeting will probably be
held in November.
3)  Smart Growth.  Zipperer reported on the October 21st meeting of
the Planning & Zoning Committee.  Rob Burke, UW-Extension Coordinator,
provided an update on the status of Smart Growth/Comprehensive
Planning elements, which has been reduced to three: zoning, land
division and mapping.  Rob suggested we take a "wait and see"
attitude.

New Business:
1)   Door County Planning Department-Construction permits for
September 2004.
2)   Independent Inspections, Ltd. - Building recaps for September
2004.
3)  Town Planning & Zoning Committee.
	a)  Petition for Grant of Variance by Kenneth Laubenstein to
reconfigure lots with new descriptions.  On October 21, 2004, the
Committee recommended approval.  Motion by Staveness and seconded by
Girman that the Board recommend approval of Laubenstein's petition for
grant of variance.  Motion carried and the Clerk was instructed to
notify the Door County Board of Adjustment of the recommendation.
	b)  Text Amendment to delete section 4.08(8)(a) to eliminate
conflict with 2.05(3) regarding conditional use permit for all new or
expansions of multiple occupancy developments (definition
clarification).  Motion by Woelfel and seconded by Staveness that the
Board recommend approval of this text amendment.  Motion carried;
Clerk will notify the Door County Resource Planning Committee of the
recommendation.
	c)  Text Amendment to amend section 3.04(4) of Zoning Ordinance
requiring property owner to formally subdivide property before
construction of a secondary residence.  Motion by Woelfel and seconded
by Girman that the Board recommend approval of this text amendment. 
Motion carried; Clerk will notify the Resource Planning Committee of
the recommendation.
	d)  Text Amendment to amend section 5.02(3) of the Door County Land
Division Ordinance requiring Land-Only Condominiums to comply with
road design standards.  Motion by Staveness and seconded by Girman
that the Board recommend approval of this text amendment.  Motion
carried; Clerk will notify the Resource Planning Committee of the
recommendation.
4)  Cable Franchise Fee Use.  This matter tabled to November
meeting.
5)  Door County Soil & Water Conservation Department (DCSW):
	a)  Correspondence received from DCSW advising that Northeast
Asphalt, Inc. quarry (Mathey Road) and Premier Concrete Inc. mine
(Walker Road) need to take corrective measures in order to maintain
their respective Mining Reclamation Permits.  Although the Town does
not participate in these negotiations, copies were provided for our
informational purposes.  No formal action taken.
	b)  Door County Beaches, Water Quality and Request for Contribution.
 At the request of DCSW, we made a $500 contribution in January 2004
toward Door County beach pollution source identification work.  Bill
Schuster, County Conservationist, would like to make a presentation to
the Board in October or November on the preliminary beach results from
2004.  The sum of $1,000 was proposed to be included in the 2005
budget.
6)  Channel 19 - Reclassification.  Girman gave a brief history on
our cable channel which became operational in fall of 2003.  Since
then, lack of manpower to coordinate and operate the channel have
caused some concern as to continuity.  John Miller from Charter
Communications, suggested we limit our workload and reclassify the
channel to government only.  Jerry Sheehan, program manager, would
continue in that capacity, and the downsizing would better fit into
his schedule.  Programs would be restricted to government broadcasts,
which could include County, City and Town meetings, as selected, and
Sevastopol and Sturgeon Bay School Board meetings.  The Ad-hoc Cable
Committee unanimously agreed to a government only reclassification and
would continue to look at other avenues.  There were suggestions to
have more student involvement and perhaps an "intern" project where
the channel could be used as a teaching tool.  Motion by Woelfel and
seconded by Girman to reclassify Channel 19 on an interim basis (3-6
months) to a local government-only channel.  Motion carried.
7)  Letter of Understanding - City of Sturgeon Bay PEG Channel. 
Motion by Staveness and seconded by Girman to continue the Letter of
Understanding between the Town of Sevastopol and the City of Sturgeon
Bay for the purpose of our access to the City's PEG channel broadcast
material for re-broadcast by the Town for the period January
1-December 31, 2005.  Motion carried.
8)  Newsletter.  This matter tabled to the November meeting.

Announcements: 

General Election:  Tuesday, November 2, 2004 polls open 8 am to 8
pm.
Door County Unit Meeting of Wisconsin Towns Association:  Thursday,
November 11, 2004 - 7 pm at Jacksonport Town Hall.
Budget Hearing/Special Meeting:  Monday, November 15, 2004-7 pm with
Special Meeting immediately following.
Next Board of Supervisors' meeting will be held on Monday, November
22, 2004 - 7 pm.
