TOWN OF SEVASTOPOL Door County, Wisconsin BOARD OF SUPERVISORS' MEETING MINUTES Monday, May 19, 2003 Town Meeting Room behind Sevastopol Schools 4550 STH 57, Sturgeon Bay, Wisconsin Call to Order: Chairman Zipperer called the meeting to order at 7:00 p.m. Establish Quorum/Roll Call: Roll call was taken. Chairman Leo Zipperer, Supervisors Don Haen, Tom Olsen, Jo Ann Schley, Gerald Worrick and Clerk/Treasurer Linda Wait were in attendance. [deviation from order on agenda to accommodate Supervisor Olsen] Presentation of Agenda/Properly Noticed: On information provided by the Clerk that the agenda was properly noticed, motion by Worrick and seconded by Olsen to adopt the agenda. Motion carried. Correspondence: 1) Order adopting rules relating to municipal regulation of rights-of-way by Public Service Commission of Wisconsin. 2) Thank you from Dan Woelfel for Town's support of Municipal Taxpayer Commission for 2003. 3) Thank you from Doug Paulin/lightingforensicinc. 4) Door County Board of Adjustment decision granting variance petition of Norman Paul regarding setbacks. 5) Magnet Street - letter and price sheet regarding Community Magnets. 6) Correspondence from Clean Water Action Council of Northeast Wisconsin, Inc. and report on survey results regarding PCB levels in Bay and Lake. 7) Notice from DNR of aerial spraying for gypsy moths starting in late May. 8) Correspondence from Attorney Nesbitt regarding DeCramer quit claim deed and Cherry Road hiking/jogging trail. Correspondence was accepted and placed on file. Minutes: Motion by Olsen and seconded by Schley to approve the minutes of the April 22, 2003 Board of Supervisors' meeting and place on file. Motion carried. Clerk/Treasurer Monthly Reports: The treasurer's report for April 2003 was accepted and will be placed on file. Olsen suggested that the Clerk obtain insurance coverage quotes from Mutual Service Insurance Companies. Oral Committee Reports: none. Committee/Board Minutes: The April 10, 2003 minutes of the Sevastopol Dam, Park & Rec Committee were accepted and will be placed on file. Continued/Pending Business: 1) Sturgeon Bay Fire Department. Acknowledged receipt of the April 2003 Fire Reports. 2) Municipal Taxpayer Commission. Resolution from the Town of Jacksonport in support of the MTC mission. 3) Clerk attended Board of Review training on May 6, 2003 and is qualified member through 2005. New Business: Door County Planning Department - Construction Permits. The construction permits for April 2003 were accepted and placed on file. Independent Inspections Ltd. - Town Building Permits. The building permits and recap for April 2003 were accepted and placed on file. Town Zoning/Planning Committee Recommendations. Olsen reported that the Committee will not be making any sort of recommendation on the Gasper petition for variance on setback requirements. [deviation from order] Special Reports: 7:11 p.m. Dave Resch, on behalf of the Door County Tobacco Free Coalition, gave a short presentation on their goal to implement a smoke-free policy in all municipal buildings and vehicles. The Coalition strives to reduce and to prevent consumption of tobacco, emphasizes education and cessation and would like local communities and schools to be involved in their objectives. Dave distributed several informational sheets, including a list of Wisconsin municipalities that have banned smoking in governmental buildings, the "Burden of tobacco" on our County, the Door County Clean Indoor Air Ordinance, and a letter from Rhonda Kolberg, Director of the Door County Public Health Department, endorsing the efforts of the Door County Tobacco Free Coalition. Beth Krohn, Chairperson of the Coalition, and Mike Taylor, principal of S.S. Peter & Paul School, also urged support. The matter will be placed on the June 16 agenda for consideration. Schley requested resolution. New Business, continued.... 7:23 p.m. Julie Pflieger, resident at 4324 Brauer Road, expressed her concern about vehicles traveling too fast on that section of Brauer Road leading into Ripp Road, especially just before and just after school hours. Zipperer stated that in absence of a sign, the speed limit is 55 mph, but the Town does have authority to lower the speed limit by 10 mph. Zipperer will direct a letter to the Door County Sheriff's Department for action. Town Road Work 2003. Following discussion and review of the estimates provided by Aaron Daubner, Superintendent , Door County Highway Department, the matter will be placed on the June 16 agenda to prioritize projects. [Supervisor Olsen was excused at 7:37 p.m.] Public Participation: Pat Miller thanked the Supervisors for our continuing membership in the Municipal Taxpayer Commission. Terry Lappin asked if Doug Paulin's presentation last month will lead to a light ordinance. Zipperer responded that it was informational only and no action was taken. New Business, continued.... Wis DNR - MFL Transfer order. Notice of order issued by Wisconsin Department of Natural Resources for complete transfer of lands enrolled under Managed Forest Law, 40 acres closed, Green/Schrank to Green/Schrank Trust. Options for Countywide Comprehensive Planning will be held on Thursday, June 12, 2003 at 7:00 p.m. in the Sevastopol High School multipurpose room as part of the pre-planning process led by the Door County Planning Department to design a countywide comprehensive planning framework. Supervisors are urged to attend. RESOLUTIONS: No. 02-03 TB "Bluff Drive" Road Name Designation. Motion by Schley and seconded by Haen to approve Resolution 02-03 TB designating road name "Bluff Drive" for that section of Old Co. Trk Hwy OR from its south junction with Cth "B" (Bay Shore Drive) to its north junction with Bluff Court and Old Co. Trk OR. Motion carried. No. 03-03 TB Fire Wardens - Appointments. Motion by Worrick and seconded by Schley to approve Resolution 03-03 TB appointing the following persons as "fire wardens" effective immediately and such term expiring April 2005: Hugh Daubner, Rich Shappell, Tom Jung, Linda Wait and Margi Zipperer. ORDINANCES: No. 2003-02 Building Permit/Inspection Fees and Building Code. Not available at this time. No. 2003-03 Unkempt Yards. Zipperer asked for volunteers to serve on a special committee to define and determine problem areas. There was discussion on enforcement and reviewing ordinances which other municipalities had put into effect. Matter will remain as a future agenda item. Special Reports: 5-Year Plan - Citizen Input. Items for long-range planning purposes and items of concerns will be collected and recorded for discussion at future meetings. Additional items to those mentioned at the May meeting: wastewater treatment issues, hazardous waste collection, spring clean-up, Smart Growth, rezoning issues and consistency and vision for protection of borders.
