BOARD OF SUPERVISORS’ MEETING MINUTES November 25, 2002 Call to Order: Chairman Zipperer called the meeting to order at 7:00 p.m. Establish Quorum/Roll Call: Roll call was taken. Chairman Leo Zipperer, Supervisors Don Haen, Tom Olsen, Jo Ann Schley, Gerry Worrick and Clerk/Treasurer Linda Wait were in attendance. Public Participation: Pat Miller asked if the correspondence on the Door County Legislative Day was a request for funds. Zipperer responded that at this point, Rob Burke of the UW-Extension is looking for issues unique to Door County for possible submission to Madison legislators and agencies. Laddie Chapman apologized on behalf of Glidden Drive Association in that some of the envelopes recently mailed out failed to include the information intended and that the matter will be corrected. Presentation of Agenda/Properly Noticed: On information provided by the Clerk that the agenda was properly noticed, motion by Worrick and seconded by Schley to adopt the agenda. Motion carried. CORRESPONDENCE: 1) Door County Planning Department. Received updated pages to Door County Zoning Ordinance amending several sections. 2) Northeast Wisconsin Technical College. Tax Levy Report with assessment of $781,721.33. 3) School District of Sturgeon Bay. Tax Levy Certification with assessment of $668,274.22 for 2002-2003 school year. 4) School District of Sevastopol. Tax Levy Certification with assessment of $2,443,133.04 for 2002-2003 school year. 5) County of Door. Certification of Apportionment of State and County Property Taxes detailing state and county taxes and charges for Town of Sevastopol. 6) Sevastopol Sanitary District #1. Certification of Equalized Full Value of all taxable property within the sanitary district, $11,677,763. 7) Wis Department of Revenue. The Final Statement of Assessments and Manufacturing Roll reporting assessed value of taxable general property (real and personal) for year 2002. 8) Wis Department of Transportation is seeking our participation in reviewing all signing on the state highway system and that we request owners to remove any non-permitted signs within the right-of-way. 9) Wis Department of Natural Resources transfer order for Managed Forest Law designation of 20 closed acres for Sylvia W. Barnard and 40 closed acres for William G. Barnard, et al. 10) Wis Department of Health and Family Services request for a list from each municipality of all retail outlets licensed to sell tobacco products. (Clerk to furnish list by 12/2/02.) 11) Wis Department of Revenue explanation of process for obtaining waivers from state mandates and criteria used for evaluating waiver requests. 12) UW Extension - Rob Burke’s response indicating peak resident population in July 2000 of 3,575 persons and total resident (year-round) population of 2,667. 13) UW Extension – Rob Burke is requesting municipalities to identify issues for a “Door County Legislative Day.” These would be issues of immediate and continuing importance unique to Door County. Responses are due by December 20, 2002. 14) RMark Inspections. Proposal from R. Mark Stevenson to issue permits and do inspections, both residential and commercial, for the Town. The correspondence was accepted and placed on file, without direction for further action. Minutes: Motion by Schley and seconded by Haen to approve the minutes of the October 21, 2002 Board of Supervisors’ meeting. Motion carried. Clerk/Treasurer Financial Reports: Motion by Worrick and seconded by Haen to accept the October 2002 treasurer’s report. Motion carried. Wait also reported receipt of the final 2002 shared revenue payment of $62,905.23 and notification of state school levy tax credit of $485,285.68 to be received in July 2003. Oral Committee Reports: Olsen reported that there will be a meeting of the Smart Growth Committee on Monday, January 13, 2003 at 7:00 p.m. in the Town meeting room. Committee/Board Minutes: Motion by Haen and seconded by Schley to accept the Sevastopol Dam, Park & Rec Committee minutes of October 15, 2002. Motion carried. Haen also reported that the concrete ramp has been installed at Clark’s Lake and the costs will be shared with Jacksonport. The trees have been planted at the Town park and Tim Smith will be starting on the driveways shortly. A big thanks to Bruce Richardson for grass cutting at the Park this fall and to Roger Opiela for his donation of time in planting the trees. CONTINUED/PENDING BUSINESS: 1) Sturgeon Bay Fire Department. Acknowledged receipt of the October 2002 fire report. 2) Municipal Taxpayer Commission. Zipperer reported that the next meeting is scheduled for December 12, 2002 at 9:00 a.m. at the Gibraltar town hall. We did not allocate any funds for the Municipal Taxpayer Commission in our 2003 budget. 3) L.R.I.P. $24,450 received from the State for cost-share on Walker/Peterson road project. 4) Road Work 2002. The work scheduled for this year on Apple Lane has now been completed and the adjacent property owners were very cooperative throughout the project. The bridge at Whitefish Bay Creek has been blacktopped and the guardrails installed. This project will be cost-shared with the County of Door. Timber Ridge has been paved and shouldered. Dunn Road has been rubberized and crackfilled from Bay Shore to HH, from Hwy 57 to Bechtel, and Clark Lake from Mathey to Hwy 57. NEW BUSINESS: Door County Planning Department – Construction Permits. The building permits for September/October 2002 were accepted and placed on file. Independent Inspections Ltd. – Town Building Permits. The building permits and recap for October 2002 were accepted and placed on file. Town Zoning/Planning Committee Recommendations. Olsen reported that the Committee voted to recommend approval of Peter Trenchard’s petition for a setback variance to rebuild/repair an existing storage building, providing it did not encroach any further unto the road R/O/W. Olsen will notify the Board of Adjustment. Mileage Certification 2003. Zipperer provides annually to the Wis DOT a construction report, certified mileage report, bridge report and a listing of name changes. Timber Ridge Road was not yet complete when the reports were filed, and when completed, we can add .61 miles to the current 84.18 miles of town roads. Appointed Poll Worker List. Motion by Worrick and seconded by Schley to accept and place on file the Door County Republican Party poll worker appointments for the 2003-2004 elections. Motion carried. RESOLUTIONS: No. 05-02TB - “Ad-Hoc” Community Access Cable Committee. Motion by Worrick and seconded by Haen to approve Resolution No. 05-02TB which identifies the “duties” and term of the “Ad Hoc” Community Access Cable Committee. Motion carried. No. 06-02TB - Committee Appointments to “ad-Hoc” Community Access Cable Committee. Motion by Worrick and seconded by Schley to approve Resolution No. 06-02TB appointing membership of the Community Access Cable Committee, with Tom Girman as Chair, and as members Laddie Chapman, Jo Ann Schley, Joe McMahon, Sheila Turner, Jim Bunning, with one vacancy. Motion carried (Haen, Olsen, Worrick and Zipperer-aye; Schley-nay). No. 07-02TB – Technical College Funding. Motion by Schley and seconded by Haen to approve Resolution No. 07-02-TB which requests that the Wisconsin Legislature revisit the statutes which created the Technical College System and its funding, decision making and taxing authority. Motion carried (Haen, Olsen, Schley and Zipperer-aye; Worrick-abstains). ORDINANCES: No. 08-2002 – Race Tracks and Racing Prohibited. Following discussion on the criteria to be included in such an ordinance, exemption of existing racing events and tracks, its intent and definition, motion by Haen and seconded by Olsen to table the matter to the December 2002 meeting. SPECIAL REPORTS by Chairman: The STS feasibility study on the Whitefish Bay ramp/launch is now complete and we have been provided the final report. The driveway permit application is now in final form and the Door County Planning Department will be notifying applicants that a driveway permit, along with a Town building permit, is required from the Town. Ken Pollock, Addressing Specialist at Door County Planning Department, will assign a E911/fire number at time of application. Holding tank agreements were issued for Ralph Luisier and Rueben Plantico to replace existing systems, with no additional fee. Announcements: The next meeting of the Municipal Taxpayer Commission will be held on Thursday, December 12, 2002 at 9:00 a.m. at the Gibraltar Town Hall. The next Board of Supervisors’ meeting will be held on Monday, December 16, 2002 – 7:00 p.m. Adjourn: Motion by Schley and seconded by Haen to adjourn. Motion carried.
