BOARD OF SUPERVISORS’ MEETING MINUTES Monday, August 18, 2008 - Meeting Room, Modular Building at Sevastopol Schools 4550 STH 57, Sturgeon Bay, Wisconsin Call to Order: Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m. Pledge of Allegiance: Chairman asked all to rise and join in the Pledge of Allegiance. Establish Quorum/Roll Call: Roll call was taken. Chairman Leo Zipperer, Supervisors John Staveness, Chuck Tice, Dan Woelfel and Tom Girman, along with Clerk/Treasurer Linda Wait were in attendance. Also In Attendance: Laddie Chapman, Dick Shappell, Victoria Cerinich, Biz Virlee, Dick Weidman, Jay Zahn, Betty Zahn, Sturgeon Bay Fire Chief Tim Herlache and Door County Sheriff Investigator Jim Valley. Presentation of Agenda/Properly Noticed: The Clerk stated that the agenda was properly noticed. Motion by Tice and seconded by Staveness to adopt the agenda, as proposed. Motion carried, unanimously. Minutes: Motion by Woelfel and seconded by Tice to approve the July 21, 2008 Board of Supervisors’ meeting minutes. Motion carried, unanimously. Clerk/Treasurer Monthly Report: Motion by Tice and seconded by Girman to approve the July2008 account balances, budget vs. actual and transaction report. Motion carried, unanimously. Wait also reported that: (i) temporary Class B “Picnic” licenses had been granted to Door Devils Motorcycle Club for an August 22-24 event and to the Sevastopol Alumni Benefit for an August 29-31 event at the Town park; and (ii) $5,031.95 return of funds received from the Municipal Taxpayer Commission. Vouchers/Bills/Claims: Motion by Girman and seconded by Staveness to approve the vouchers, bills and claims for the period July-August 2008. Motion carried, unanimously. Committee Minutes: The July 18, 2008 minutes of the Ad hoc Sesquicentennial Committee were accepted and will be placed on file. Special Reports: City of Sturgeon Bay Fire Chief Tim Herlache addressed some of the confusion and misunderstanding of the County’s burning and fireworks ordinance. He provided copies of the ordinance, along with an informational handout entitled “Facts on Open Burning,” and explained that the County has adopted this ordinance based on DNR regulations to control and have uniformity in outdoor burning to allow for enforcement by the Door County Sheriff’s Department and the DNR. Chief Herlache reminded us that businesses, industries and municipalities are generally prohibited from open burning. Individuals may burn lawn and garden debris and no more than one (1) cubic yard of clean wood. Small amounts of confidential/financial and non-recyclable papers may be burned; otherwise paper should be recycled. Outdoor fires for cooking or recreation are permitted and do not require a permit. Campfires on the beach are acceptable, but must be attended at all times and burn barrels must be screened. Outdoor wood furnaces must be approved and require a permit. Other open burning requires a burn permit issued by the Fire Chief, Town Chairman or other designees. If you are concerned or suspicious about any fire, call the non-emergency number at 746-2916. Chief Herlache said only fireworks with less than ¼ grain of explosive material (sparklers, cones, snakes, caps) may be used or possessed without a permit. A permit is required to possess any other fireworks and fireworks may only be sold to persons holding valid permits. He also presented the 2007 Annual Fire Report for the Town of Sevastopol, with a narrative summarizing staff, fire prevention efforts, training and education, and maintenance of buildings and equipment. Chief Herlache also mentioned that a replacement tanker had been purchased, which is more versatile and set up for rural fires. The Fire Department also performs annual inspections of all public and commercial buildings in our community. Door County Sheriff Department, Investigator Jim Valley provided a status report on the break-in and burglary episodes in the Bark Road/Glidden Drive areas. He indicated most were summer homes and it was difficult to determine when events happened, but the investigations continue, looking for prints and evidence. Extra patrol has been added to the areas and we are interviewing neighbors for any leads. Officer Valley reminded residents that if you find your home has been entered, do not touch anything and call the Sheriff’s Department immediately. Pending Business: 1) Tourism Zone Commission. Tice reported on May revenues. 2) Comprehensive Plan. Staveness reported on the August 11th Public Hearing and indicated that the Comprehensive Plan Committee will be dissolved, with a Plan Commission to be appointed, complete a review of the Comprehensive Plan, and recommend its adoption to the Town Board. Zipperer anticipates that there will be seven (7) people on the Plan Commission, with representatives from the Board, the former Plan Committee and others. 3) PEG Cable. Girman reported that Charter’s moving of Channel 19 to the 900 range is currently on hold. 4) Sesquicentennial. Wait reported that Donna Rudolph is compiling a list of all past Board members and others to be included in our history book. To help celebrate on July 18, 2008, the UW marching band has been confirmed, with 30 marching members. Music will also be provided by the Leist Boys and Newtonburg Brass Band. Leonard Quartetti has offered to organize an art fair. Plans continue to move forward; we are looking for parade participants and volunteers to help throughout the event. 5) Town Hall project. Woelfel reported that bids will be opened on August 22nd at 2 p.m. The Building & Property Committee will then meet with Architect Henry Isaksen to review the submissions and make a recommendation to the Town Board. If you have ideas on colors, flooring and furnishings, let us know. 6) Road Work 2008 and WPS/Whitefish Bay & Harder Hill. Zipperer reported that the South Cave Point Drive project has been paved, with shouldering to be done later. The road was paved past the existing pavement and to the driveways, an additional 30-40 feet in length and 20 feet in width. Northeast will provide a separate billing and payment will be addressed at that time. North Cave Point Drive will be accomplished after Labor Day. The Harder Hill/Whitefish Bay survey has been completed and the WPS utility pole is approximately 15 feet into the right-of-way. Some residents in the neighborhood feel the intersection should be left “as is” and drivers just need to slow down. The matter will be held in abeyance for now. Zipperer indicated that the shoulders along Old Highway Road will be shored up a bit to prevent potholes and rain collection, at an estimated cost of $5,400 by the Door County Highway Department. The chip seal on County HH and Windemere has been accomplished. 7) Alcohol Beverage Licensing. No update at this time. 8) Mowing Policy. Zipperer indicated there is no written policy and reported that some “test areas” will be done along Haberli Road. We will consider the matter come next spring. New Business: 1) Aerial Photograph Project. Wait reported that Door County is planning to acquire new aerial photography next year and municipalities will be able to obtain a more detailed level at an additional cost. Pricing for our Town appears to be $535. Zipperer will discuss the matter with Tom Haight, GIS/LIO Coordinator. 2) Schauer Park. Zipperer recapped our 2007 decision to join with the Town of Jacksonport to offer financial assistance for the feasibility study of launching facilities at Schauer Park. Funds of $6,000 were budgeted for 2008 and the study is now underway. Motion by Girman and seconded by Woelfel that we allocate the $6,000 as previously discussed and budgeted for payment to the Door County Parks Department. Motion carried, unanimously. 3) Little Harbor Sign Relocation. Zipperer had been asked how far south the “Little Harbor” sign could be moved. Brad Birmingham is looking into the request. Correspondence: The following correspondence was accepted and placed on file: 1) Independent Inspections, Ltd. – Billing Recap for July 2008. 2) Door County Planning Department – Zoning permits for July 2008. 3) Approval from State Trust Fund Loan Program 4) $848.60 payment from City of Sturgeon Bay for annexed Parcel No. 022-02-32282641C (real estate taxes pro-rated) 5) Wisconsin Department of Revenue – Shared revenue payment of $8,216.76 and School Levy Tax Credit payment to County of $637,810.76. 6) Door County Board of Adjustment – (i) Grant of variance to Webster for proposed addition; (ii) grant of variance to Tanck for creation of new parcel; and (iii) notice of public hearing on Johnson petition for variance on encroachment into setbacks. 7) Managed forest law transfer order – Delchambre to Jeanquart. 8) Door County Board of Supervisors/Chairman Zipperer letter to Mary Gansberg/Lake Coordinator in support of Door County Soil & Water Department’s investigation of water quality throughout the Dunes Lake Watershed and connecting Geisel Creek and Shivering Sands. 9) Wisconsin Wetlands Association – announcement of outreach program and the inclusion of “Shivering Sands & Connected Wetlands” in Wetland Gems. 10) Bay-Lake Regional Planning Commission – July newsletter. 11) City of Sturgeon Bay – Management letter and annual financial report 2007. 12) Preliminary estimate of January 1, 2008 population – 2,871. 13) Notice of DCEC’s annual summer program, “Great Lakes Water Wars: Still a Threat?” 14) James Lutzen to Door County Treasurer – storm water runoff and flooding problems. 15) Door County Zoning Ordinance – updates.
