TOWN OF SEVASTOPOL Door County, Wisconsin BOARD OF SUPERVISORS’ MEETING MINUTES Monday, April 21, 2008 - Meeting Room, Modular Building at Sevastopol Schools 4550 STH 57, Sturgeon Bay, Wisconsin Call to Order: Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m. Pledge of Allegiance: Chairman asked all to rise and join in the Pledge of Allegiance. Establish Quorum/Roll Call: Roll call was taken. Chairman Leo Zipperer, Supervisors Chuck Tice, Dan Woelfel and Tom Girman, along with Clerk/Treasurer Linda Wait were in attendance. Supervisor John Staveness was excused. Also In Attendance: Laddie Chapman, John Hippensteel, Guy Fortin, Bob Bultman, Lawrie Kull, Charlie Jarman, Robert Stracka and Pat Miller. Meet the Deputy Program of the Door County Sheriff’s Department: No one in attendance. Citizen Concerns: Guy Fortin, member of Community Wind Energy, provided some background on the placement of wind turbines, the current setbacks of the County ordinance and presented maps indicating that 99% of the land in the Town of Sevastopol would not be available for turbines under the current restrictions. He also indicated the property owners could waive restrictions, as long as health and safety issues were still in place. There will be further discussion under Ordinance No. 2008-01. Presentation of Agenda/Properly Noticed: The Clerk stated that the agenda was properly noticed. Motion by Tice and seconded by Woelfel to adopt the agenda, as proposed. Motion carried, unanimously. Minutes: Motion by Woelfel and seconded by Tice to approve the meeting minutes of the Board of Supervisors of February 18, 2008. Motion carried, unanimously. Motion by Tice and seconded by Girman to approve the meeting minutes of the Special Board of Supervisors of April 7, 2008. Motion carried, unanimously. Woelfel indicated that the Door County Board of Adjustment approved the Ciepluch petition for grant of variance, despite our recommendation for denial. 7:15 p.m. Special Presentation Bob Bultman, Coordinator for Door County Invasive Species Team, gave a powerpoint presentation on the efforts of DCIST to educating, preventing, minimizing and eradicating invasive plans and reducing their negative impact to Door County. He also provided handouts on identifying garlic mustard, purple loosestrife, phragmites and other invaders. The Team promotes open information and offers a comprehensive local resource to protect Door County’s biologically diverse (plants and animals) ecosystem. Invasive species are defined as aggressive, problematic, exotic plants and animals and are a leading threat to native species. Bob also reminded that the State’s noxious weed law allows municipalities to draft their own list of noxious weeds. When surveying Door County, infestations were worse along roadways, shorelines and in parks. There will be training programs on June 9th at the City parks and June 18th at the County parks; along with a “Clean Boats Clean Waters” program at Whitefish Bay Dune Nature Center on June 7th from 8 am to noon. Bob would also provide training sessions for municipal park employees, landscapers and others working outdoors, upon request. Clerk/Treasurer Monthly Reports: Motion by Girman and seconded by Woelfel to accept the treasurer’s report for the months of March and April 2008, which includes account balances, transaction/register detail and budget vs. actual. Motion carried, unanimously. Vouchers, Bills and Claims: Motion by Tice and seconded by Girman to approve the vouchers, bills and claims submitted for March and April 2008. Motion carried, unanimously. Oral Committee Report: ● Wisconsin Towns Association. Wait reported on the Door County Unit of WTA meeting of March 27th, hosted by the Town of Sevastopol. Senator Alan Lasee and Rep. Garey Bies provided legislative updates. Tom Harnisch, WTA Education Director, provided an excellent powerpoint presentation on the bidding process. Dick Burress, Director of Door County Emergency Services, reported on officials’ rights and duties in a declared emergency and also thanked the Towns for their support of the recent fire department communications upgrade that now coincides with EMS. The next meeting of the Door County Unit will be held on Thursday, July 24th, with the Town of Sturgeon Bay as host. Committee Minutes: The following Committee minutes were accepted and placed on file: ● Dam, Park & Rec – March 11, 2008 ● Comprehensive Plan – January 23, 2008, February 20, 2008 and March 12, 2008 ● Sesquicentennial – January 17, 2008 and February 15, 2008 Pending Business: 1) Comprehensive Plan. The final comments and corrections have been referred back to Jeff Sanders at Omnni and he will be forwarding 20 copies for review by the Committee. A date for the public hearing will be set, with an open house prior to the meeting for an informal discussion and review of the maps. 2) Tourism Zone Commission. Tice reported the Town collected $1,298 for the month of February. Although the Commission has not completed a full year, the Town of Sevastopol has been outperforming many of the other communities for the months of December through February. Tice was elected Vice Chair of the Commission and will be in charge of the bylaws and changes to the intergovernmental agreement. Enforcement proceedings have also been initiated against violators. Sturgeon Bay may be closer to joining the Commission and Gardner is also discussing the matter. The Commission is currently in need of a “member at large” (non-municipal position) and continues to look for an administrative assistant. There will be a May 8th meeting at Jacksonport and a May 15th meeting at Liberty Grove, with the Annual Meeting on May 27th at the Landmark Resort in Egg Harbor. All Board members and clerks are invited to attend. Tice reported that the DCVB is working on a newspaper banner ad in the Milwaukee and Chicago areas and that each municipality would be able to place an ad at a much reduced rate to advertise a local event. Tice said the total room tax collected for 2007 amounted to $2,342,975, with the municipalities receiving 30% ($702,892), administration receiving 4% ($93,719) and the DCVB receiving 66% ($1,546,363) for promotion. The 11 members include Towns of Gibraltar, Egg Harbor, Baileys Harbor, Liberty Grove, Sevastopol, Jacksonport, Nasewaupee, Washington Island and the Villages of Egg Harbor, Sister Bay and Ephraim. 3) PEG Channel 19 Cable. Girman indicated that we will pursue posting meeting tapes on our website and the technicalities involved in putting that in place. He hopes that availability will bolster communication through the community. 4) Nuisance ordinance. Tice will be reconvening the Committee in the near future and problems could be identified on the road inspection trip in May. 5) Clark Lake “Slow No Wake” / Lake level. Zipperer reported that the DNR approved the placement of four “Slow-no-wake” waterway markers and indicated that the Clark Lake Advancement Association (CLAA) is responsible for ensuring they are place in the proper PGS coordinate locations as identified in the application. Lawrie Kull indicated that CLAA will purchase the buoys and install the buoys. Woelfel reported that the lake level is quite high and we continue to monitor the situation. Also, the fish screens are in place and CLAA is working with us to keep unwanted fish out of the lake. The pier and boat launch are in, but he cautioned users to watch for the gap between the ramp and the road. 6) Municipal Taxpayers Commission. Zipperer reported that no one was available to attend the April 17th meeting; however, he did place a call with our intent on the return of unused funds. The Commission did not have a quorum and will meet on May 29th at 9:30 am in Ephraim. Board members felt maintaining MTC as an intergovernmental unit or coalition for general and informational discussion among the municipalities and communities would be a good use. Information will be brought back from the May 29th meeting. New Business: 1) Application for Seasonal Alcohol Beverage License (Class B Beer) Motion by Woelfel and seconded by Girman to approve the applications for a seasonal Class B Beer license for the period May 1st through October 31, 2008 for the Sevastopol Dam, Park & Rec Board and the Institute & Valmy Athletic Club. Motion carried, unanimously. 2) See above Special Presentation. 3) Town Hall Building Plan/Architect Fees. Woelfel presented a memo from Henry Isaksen and indicated that up to this point, we had not incurred any architect expense. Henry indicated that he will prepare the necessary drawings for State conditional approval with a fee based upon 6.5% of the general construction costs. His fee will also include assistance with the bidding process and construction/subcontractor supervision. At the time the drawings are complete, 80% of the fee shall be due, with the remaining 20% drawn over the construction process. Henry estimates six weeks for the drawings to be submitted to the State, with groundbreaking in late August or early September, and an anticipated completion date in March 2009. He requests an initial allocation of $10,000 to be paid on or before May 15th. Cost estimates and bidding process shall be brought to the Board at the July 21st meeting. Motion by Girman and seconded by Tice to approve the $10,000 allocation. Motion carried, unanimously. Woelfel also indicated that the survey is now complete, the parcels having been combined into one. 4) Town Hall Financing. After reviewing possible financing sources, including financial institutions and the bond process, the State Trust Fund Loan Program appears to be the most viable. The current interest rate is 4.25% for a 10-year term loan with no pre-payment penalty. Woelfel would coordinate the application paperwork with the clerk and expects a brief turnaround time to dispense funds. This proposal was also given elector approval at the Annual town meeting held on April 8th. Motion by Tice and seconded by Girman to make application for borrowing of funds to the Board of Commissioners of Public Lands (BCPL) and State Trust Fund Loan Program in an amount not to exceed $900,000 for a term of ten (10) years. Motion carried, unanimously. 5) Animal Control – Reimbursement for Constable Expense. Following discussion, motion by Zipperer and seconded by Tice that if the pet owner is identified by the animal control officer and the pet is returned, the owner shall be billed for the pickup charge of $30 per call, room and board of $12 per day, for mileage reimbursement and our standard administrative/processing fee. Motion carried, unanimously. Ordinance: No. 2008-01 “Interim Control of Large Wind Turbines.” Continuing his comments, Guy Fortin provided additional information as to sound levels, economic impact, restoration requirements, financial assurances and penalties for failure to comply regarding the wind turbines. His main focus was to educate the public on wind energy. Woelfel stated that WTA had recommended that the Public Service Commission develop state standards and create a common set of guidelines for municipalities to follow. Girman indicated that the Clay Banks ordinance was very detailed. Pat Miller commented on the County’s recent enactment of its ordinance. Girman also commented that ordinance relating to wind energy must be consistent with our Comprehensive Plan. Motion by Girman and seconded by Woelfel to table the matter to the next meeting on May 19th. Motion carried, unanimously.
