TOWN OF SEVASTOPOL Door County, Wisconsin BOARD OF SUPERVISORS’ MEETING MINUTES Monday, January 21, 2008 - Meeting Room, Modular Building at Sevastopol Schools 4550 STH 57, Sturgeon Bay, Wisconsin Call to Order: Chairman Leo W. Zipperer called the meeting to order at 7:00 p.m. Pledge of Allegiance: Chairman asked all to rise and join in the Pledge of Allegiance. Establish Quorum/Roll Call: Roll call was taken. Chairman Leo Zipperer, Supervisors Chuck Tice, Dan Woelfel, Tom Girman and John Staveness, along with Clerk/Treasurer Linda Wait were in attendance. Also In Attendance: Chairman Zipperer introduced Kara Beeck, reporter with the Door County Advocate. Also present were Laddie Chapman, Jim Hlavacek, Lawrie Kull, Bob Stracka, Tom Hinnenthal, Ann Hinnenthal, Pat Miller and Jim Bunning. Meet the Deputy Program of the Door County Sheriff’s Department: No one in attendance. Citizen Concerns: None. Presentation of Agenda/Properly Noticed: The Clerk stated that the agenda was properly noticed. Motion by Tice and seconded by Girman to adopt the agenda, as proposed. Motion carried, unanimously. [deviation from order] Ordinance: No. 2008-02 Clark Lake “Slow No Wake.” Zipperer summarized the steps taken in support of the proposed ordinance, beginning with the joint public hearing held in September 2007 with the Town of Jacksonport and asked for Clark Lake Advancement Association (CLAA) input. Following discussion, motion by Girman and seconded by Woelfel to adopt Ordinance No. 2008-02. Motion carried, unanimously (aye-Girman, Tice, Staveness, Woelfel, Zipperer). Minutes: Motion by Staveness and seconded by Tice to approve the meeting minutes of the Board of Supervisors of December 17, 2007. Motion carried, unanimously. Clerk/Treasurer Monthly Reports: Motion by Tice and seconded by Girman to accept the treasurer’s report for the month of December 2007, which includes account balances, transaction/register detail and budget vs. actual. Motion carried, unanimously. Vouchers, Bills and Claims: Motion by Woelfel and seconded by Staveness to approve the vouchers, bills and claims submitted for December 2007. Motion carried, unanimously. Oral Committee Report: ● Fire/Rescue Services. Girman reported that City of Sturgeon Bay fire protection costs for 2008 were invoiced at $318,351.10. This represents an increase of 4.7% from last year, which is under the 5% cap that was negotiated. ● PEG Channel 19 Cable. Girman reported that Governor Doyle recently passed the Video Competition Act and we will continue to collect franchise fees. Some of the criteria lifted restrictions on ads, eliminated the PEG fee and some limits on programming. We could possible see a change in the quality of our broadcast. ● Sesquicentennial Celebration. Wait reported that a survey regarding the 150th anniversary celebration will be appearing in the next newsletter and responses would be appreciated. The event is scheduled for July 18, 2009. Committee Minutes: The following Committee minutes were accepted and placed on file: ● Dam, Park & Rec Board – November 8, 2007 ● Building & Property – December 4, 2007 ● Building & Property - January 4, 2008 Pending Business: 1) Comprehensive Plan. Staveness reported that the Committee is working on Chapter 11, Intergovernmental Cooperation and that the next meeting is scheduled for January 23rd. The Committee hopes to meet with surrounding municipalities soon and also have a final draft of the plan available for public hearing mid to end of April. 2) Tourism Zone Commission. Tice reported that online reporting and ACH payment of taxes should be implemented by April 15th. The lodging permit has been changed and extended to a 5-year period to coincide with Tourism Zone Commission re-election of officers. Notice of the upcoming annual meeting will be sent out. The by-laws are being reviewed by the attorney, along with other legal matters, including noncompliant businesses. With the Packer playoff games, Door County was promoted as available for additional lodging in the area. Programs implemented in 2007 will be reviewed to see if there was benefit in 2008. The next meeting is scheduled for February 21st, with location to be determined. 3) PEG Cable. See above Oral Committee Report. 4) Town Hall Building Plan. Woelfel reported that preliminary plan No. 6 has been completed and the Committee is moving forward to obtain a construction budget. A survey will be ordered to incorporate the Town park property and recently purchased lots into one parcel. Preliminary designs and accompanying article will appear in the next newsletter. 5) Nuisance Ordinance. Tice reported on the recent initial meeting of the Committee, which also includes Phil Scalish, Rob Leonard, Jim Bunning, Tom Wade. The Committee studied ordinances from other communities and the some of the concerns mentioned were abandoned vehicles and appliances, uncontained garbage, loud noise, jake/air braking, uncontrolled burning, invasive species, landfills and transportation of loose material. The next meeting is scheduled for January 24th, with Corporation Counsel Grant Thomas discussion of County ordinance. 6) Newsletter. Woelfel indicated the next issue is planned for distribution in early February. 7) Schauer Park. By email, Door County Parks Director George Pinney informed Jacksonport and Sevastopol Town Boards that the Wisconsin Waterways Commission awarded the Door County Parks Department a 50% grant to help fund a feasibility study of Schauer Park for a possible harbor of refuge and boat launch improvements. George will keep us informed on the progress and will be requesting shared funds as costs are incurred. Jacksonport and Sevastopol each budgeted $6,000, with an additional $12,000 from the County and the balance coming from the Waterways Commission. Staveness also reported that the light had been installed at the Clark Lake launch/ramp and monthly costs will be shared with the Town of Jacksonport. New Business: 1) Interim Control Ordinance. Door County Ordinance No. 2007-02, the interim control ordinance for a temporary moratorium on zoning map amendments, shall sunset on January 23, 2008. 2) Patrick Hearden – Request for refund due to incorrect assessment. Mr. Hearden requests a refund for overpayment of real estate taxes for the year 2007. The Clerk confirmed with the assessors at Associated Appraisal Consultants that as of January 1, 2007, the improvements on the property located at 4434-1 West Madeline Lane were 40% complete, rather than 100% complete. Accordingly, the improvement assessment of $232,000 should be adjusted to $91,800, resulting in an overpayment of $1,338.65. Motion by Girman and seconded by Staveness to approve the refund of $1,338.65, with statutory interest, subject to written confirmation from Associated Appraisal on the assessment correction. Motion carried, unanimously. Ordinances: No. 2008-01 Town & Private Road Standards. This new ordinance incorporates previous Ordinance Nos. 98-05, 98-09 and 05-2002 to establish minimum standard specifications and regulations relating to the construction of private roads, public roads and driveways. The ordinance states that asphalt surfaces must be a minimum of 2-1/2” thick after compacting and also addresses crown or slope as needed for driveway approaches which are higher than road surface. Attached as exhibits are “typical road cross-section” and “driveway approach for lots higher than road.” Motion by Staveness and seconded by Tice to adopt Ordinance No. 2008-01. Motion carried, unanimously (aye-Tice, Staveness, Woelfel, Zipperer, Girman). Correspondence: The following correspondence was accepted and placed on file: 1) End-of-year recap from Sevastopol First Responders. 2) City of Sturgeon Bay December 2007 fire report and invoice for 2008 fire protection service. 3) Wisconsin Division of Transportation notice of General Transportation Aids for 2008 - $164,069.28 and calculation process. 4) Door County Planning Department building/zoning permits for December 2007. 5) Independent Inspections, Ltd. billing recap for December 2007. 6) Wisconsin Public Service – contract for outdoor lighting at Clark Lake launch/ramp. 7) Website information on “2007 Door County Citizens Survey.” 8) Neher Electric Supply – State contract lighting vendor/supplier 9) Charter Communications – addition of new channel “Retro Network” to WBAY Channel 22. Announcements: ● Board of Supervisors – Monday February 18th – 7 pm ● Spring Primary/Presidential Preference Election – Tuesday, February 19th ● Tourism Zone Commission – Thursday, February 21st ● Comprehensive Plan Committee – February 23rd at 6:30 pm ● Property Management/Nuisance Committee – February 24th at 3:30 pm Chairman Zipperer also reported on: (1) requests for reduced speed limits along Gordon Road, which will be forwarded to the Door County Highway Department; (2) the Bluff Estates at Little Harbor joint petition for grant of various was approved as to non-conforming lot size; (3) possible joint grant with City of Sturgeon Bay for street work on Egg Harbor Road; (4) letters concerning the proposed roundabouts are being directed to Dan Austad of the Door County Highway Commission and to the Wisconsin DOT in Green Bay; and (5) the next session of the Door County Smart Growth/Comprehensive Plan is scheduled for January 30th.
